Contract for Payment of Relocation Assistance CONTRACT FOR PAYMENT OF
RELOCATION ASSISTANCE
This Contract is made and entered into this 4th day of May, 2015, by and between Chase
M. Fry and Samantha Elsasser("Tenants"), and The City of Salina, Kansas ("City").
1. Property. The Tenants reside at 330 S. Ohio, Salina, Kansas ("the Property")
currently owned by Dennis M. Fry. The City has entered into a contract for the purchase of the
Property from Dennis M. Fry, as part of the Bicentennial Center improvement project. As a
result of the project, the Tenants will be displaced and are entitled to certain relocation benefits.
2. Amount of Relocation Assistance. The City shall pay One Thousand Two
Hundred Dollars ($1,200.00) to Chase M. Fry and One Thousand Two Hundred Dollars
($1,200.00)to Samantha Elsasser as relocation assistance ("Relocation Assistance Payments").
3. Relocation Assistance. The City and the Tenants all agree that the Relocation
Assistance Payments are fair and reasonable. The Tenants both acknowledge that the Relocation
Assistance Payments were determined as a result of voluntary negotiations with the City. The
Relocation Assistance Payments shall be full satisfaction of the Tenants' rights and entitlements
to relocation assistance and notice, including any assistance and notice required under K.S.A. 58-
3508.
4. Representation of Parties. The law firm of Clark, Mize & Linville, Chartered,
Salina, Kansas, represents the City. Tenants understand that they have the right to seek
independent legal counsel of their choosing to represent them and to advise them with respect to
this matter. By executing this Contract, Tenants represent that they have either sought the advice
of separate counsel of their choosing or have elected to proceed without separate counsel herein,
and that the City's attorneys are not representing Tenants and have not advised Tenants with
respect to this matter.
5. Kansas Law Applies. This Contract and its validity, construction, and
performance shall be governed by the laws of Kansas. This Contract shall be interpreted
according to its fair meaning, and not in favor of or against any party.
6. Persons Bound. This Contract shall extend to and bind the minor children, heirs,
executors, administrators, trustees, successors, and assigns of the Tenants. The Tenants
acknowledge that they and their minor children are the sole occupants of the Property. The
Relocation Assistance Payments shall be in full satisfaction of all of the Property's occupants'
rights and entitlements to relocation assistance.
7. Merger Clause. These terms are intended by the parties as a complete,
conclusive, and final expression of all the conditions of the Contract. No other promises,
statements, warranties, agreements, or understandings, oral or written, made prior to or at the
signing thereof, shall be binding unless in writing and signed by all parties and attached hereto.
Any amendment to this Contract, including an oral modification supported by new consideration,
must be reduced to writing and signed by both parties before it will be effective.
IN WITNESS WHEREOF, the parties have hereunto set their hands the day and year first
