SUBJECT: PETITION NUMBER 3569 FILED BY GUY E. TROW REQUESTING A SEWER
LATERAL TO SERVE HOUSES ON STIMMEL ROAD EAST OF NINTH STREET.
Petition Number 3569 was signed by three of seven property owners repre-
senting 264' of 1,034' of front footage. This represents 43% of the property
owners and 26% of the frontage. Based on the above percentages, this does not
represent a valid petition. '~
The size of the six lots with houses on them, which this sewer lateral would
serve, are each to small to support a private disposal system. The only
means by which these people can expect to maintain a reasonably sanitary
condition on their property is to have access to a public sewer line.
In view of the above conditions and those set out in correspondence from the
City-County Health Department, this office strongly recommends tile construction
of a sanitary sewer to serve this area.

Private Septic Systems - Sti~mel Road
On July 6, we responsed to a request from the City Manager's
Office regarding an overflowing septic system on property located
at 219 Stim~el. An inspection of the property was made and a report
forwarded.
It appears, as the report indicated, the system has failed and
a new system or alternative method of sewage disposal will be re-
quired if the house located on the property is to continue to be
occupied. The existing condition of an open: sewage system (permitting
the surfacing of sewage) constitutes a genuine hazard to the health
of the residents. I have issued a notice to the owner-occupant of
the property to abate the existing nuisance within ten (10) days pro-
vided by ordinance. Such abatement would be accomplished by pumping
the system. This Department however, would not approve any plan to
alter or replace the existing system because there is not sufficient
land area available to accomodate an adequate'private sewage system.
Mulberry Creek has eroded the back yard of this property to the point
that it is presently within approximately 75 feet of the house.
The owner has the following alternatives available to him:
1) Have the system pumped as often as is necessary to prevent
the septic system from overflowing. National figures indicate daily
water use at 75 gallons of water per day per person. A commonly used
septic tank would have a capacity of 1000 gallons. A family of four
could experience a water use of 300 gallons per day. At that rate,
a 1000 gallon capacity septic tank would require frequent pumping in
order to prevent overflow.
2') Vacate the property.
3) Appeal to the City Commission to make a municipal sanitary
sewer available to his property. A petition for such service has
been filed with the City.

There are several other residences on Stimmel Road which are
experiencing similar problems with private sewer systems.
I would strongly recommend that the City Commission use
existing authority and make public sanitary sewer available for
reasons of public health to the residents on Stimmel Road.

An inspection was made of the property at 219 Stimmel this A.M.
The complaint was found to be valid.
The daughter of the owner was home. She stated they were going to
have someone pump the tank out. She also said that every time lzhe
creek came up the system backed up and they were planning to putt in
a new system.
It is felt that because of the size of the lot and with the washing
away of the creek bank it would be unsuitable to allow a new septic
system to be installed.
The daughter was advised to have the owner contact the Health Department
before any work was done.
I was accompanied on this inspection by Ronald Tremblay, Building
Inspection, since Building Inspection also must approve any work
done.
