This Field Internship Agreement ("Agreement") is entered into on this 20th day of
October , 2014, by and between Hutchinson Community College (hereinafter referred to as
"HCC"), and the City of Salina, Kansas (hereinafter referred to as "City").
Recitals
A. The City operates the Salina Fire Department ("SFD"), which provides, among
other things, public fire protection and emergency medical services to the citizens of Salina,
Kansas. -
B. HCC offers EMS Programs, including a National Registry Emergency Medical
Technician (NREMT) Paramedic Training Program (hereinafter "EMS Training Program")'that
provides training in the operation and maintenance of specialized medical and communication
equipment, and the recognition, reporting, and treatment of life-threatening medical and/or
traumatic emergencies.
C. HCC requires students enrolled in the EMS Training Program to complete a
specified program of study, which includes field internship training (hereinafter "Field
Internship") with an independent health care facility.
D. HCC desires to utilize SFD facilities, expertise, and opportunities for the Field
Internship of EMS students enrolled in the HCC EMS Training Program.
E. The City is willing to accept and HCC is willing to assign students for Field
Internship upon the terms and conditions hereinafter set forth.
The parties, in consideration of the mutual promises set forth in this Agreement, agree
and covenant:
1. Establishment of Field Internship Program with SFD. City agrees to allow
HCC students to utilize SFD facilities, expertise, and opportunities for purposes of the Field
Internship Program, as set forth in this Agreement.
2. Term. The primary term of this Agreement shall be from the date and year first
written above and shall be automatically renewed from year to year, unless one of the parties
notifies the other party in writing thirty (30) days prior to the end of any yearly period that the
Agreement is not to be renewed for the following year; however, this Agreement may be
terminated at any time by either party upon giving the other party sixty (60) days written notice
of the intention to terminate said Agreement.
3. Training Program Approvals. HCC shall maintain a Training Program that is
approved by the NREMT and the Kansas Board of EMS.
4. Responsibility for Costs and Expenses. City shall have no responsibility to
HCC, or to any student participating in a HCC EMS Training Program, for any meal costs,
laundering costs, travel costs, education costs, insurance costs, medical expense or any other
expense related directly or indirectly to such student's participation, including any injury or
illness contracted while participating.
5. Student Medical Insurance. Each student's personal medical insurance must
remain current throughout the duration of his or her participation in the Field Internship program.
HCC will provide proof of medical insurance upon request of City. Neither City nor HCC is
responsible for providing or procuring medical insurance coverage for the student.
6. Relationship. This Agreement does not and shall not be construed to create any
principal/agent, master/servant, employer/employee or partnership relationship of any kind
between City and HCC and/or its students. No student shall have any rights by reason of
participation in the Training Program and/or Field Internship against City for any salary
remuneration or compensation, or any employment benefits, Social Security, Worker's
Compensation coverage, disability or unemployment insurance benefits, vacation pay, sick leave,
nor any other remuneration of any kind whatsoever. Any services rendered to City by student
shall be considered incidental to the educational content of the Training Program and/or Field
Training.
7. Adherence to Rules. HCC students shall adhere to the program, standards,
policies, rules, and regulations of City during the Field Internship portion of the Training
Program.
8. HIPPA Training. Prior to Field Internship, each student will be required to
participate in a short HIPPA training program. After the training program each student shall sign
an appropriate document stating his or her understanding of, and agreement to comply with, all
HIPPA requirements. City shall be responsible for providing the HIPPA training program and
the document for signature.
9. Student Attire. HCC students will present themselves appropriately dressed and
exhibit professionalism at all times during Field Internship. HCC students will wear black or
navy slacks (jeans will be unacceptable), black shoes, a uniform shirt provided by HCC, and a
name tag provided by HCC. SFD administration has the right to prevent a student from
performing Field Training if the student's attire is deemed inappropriate for the Field Internship
setting.
10. HCC Program Director. HCC shall employ a program director and faculty who
shall be responsible for the education of the student in the Training Program and for the
assignment of students to SFD for Field Internship. HCC faculty shall make all final
determinations of successful completion of the Field Internship requirements as determined by
policies and practices of HCC EMS Training Program.

11. Enrollment of Students. HCC shall provide SFD information at least one (1)
month prior to the beginning of each Field Internship segment, which shall include dates and
hours of desired clinical assignments of students, expectations of students, expectation of SFD
preceptor personnel, evaluation forms to be utilized during Field Internship, and specific
objectives to be accomplished by the student during Field Internship. This information will be
provided for SFD approval prior to any students participating in Field Internship.
12. Orientation. HCC EMS Training Program Director or faculty shall provide
orientation to expectations, policies, regulations, and learning outcomes for the assigned
preceptor. Orientation shall be provided prior to the commencement of student Field Internship
activities and shall occur at a location as determined convenient by SFD.
13. SFD Preceptor. SFD shall designate a qualified employee who shall serve as the
preceptor for the Field Training. SFD shall make available appropriate personnel to serve as
additional educational resources to ensure adequate experiences for the students based on the
appropriate level of care currently being pursued by the student.
14. SFD Facilities. During actual patient care, SFD shall make available facilities,
equipment, supplies, and personnel appropriate for instruction of students, as approved by the
administrative office of SFD.
15. SFD Oversight and Reporting. For each student assigned to SFD for Field
Internship, SFD shall be responsible for the scheduling of ridership on SFD units; maintenance
of records of services provided in the field by students; evaluation of student performance in the
field; and reporting to HCC Emergency Services Education Director or faculty the performance
evaluation for each student.
16. SFD Licenses and Accreditations. SFD shall maintain its status as a State of
Kansas licensed ambulance service capable of providing Field Internship opportunities at the
ALS and BLS levels. HCC may terminate this agreement effective upon written notice to SFD
when it is established by HCC that any license, certification or accreditation required by SFD is
denied, revoked, or not renewed or otherwise in effect.
17. Insurance. HCC shall maintain Commercial General Liability (CGL) insurance
written on ISO Occurrence Form CGOO 01 10/96, or an industry equivalent and shall cover the
liability arising from personal injury, bodily injury, property damage, premises and operations,
products and completed operations, contractual liability and advertising injury associated with
the students participating in the Training Program. The CGL policy shall name the City, its
agents, representatives, officers, officials, and employees as additional insureds. Insurance for
the additional insured shall be as broad as the insurance for the named insured, including defense"
expense coverage, and shall apply as primary and non-contributory insurance before any other
insurance or self-insurance, including any deductible, maintained by, or provided to, the,
additional insured. If allowed by law, the CGL policy will include a waiver of subrogation in
favor of the City of Salina, its agents, representatives, officers, officials and employees. HCC
shall also maintain professional liability insurance covering errors and omissions of HCC's students
and employees participating in the Training Program. In the event coverage is provided on a

claims-made basis, the professional liability insurance shall be maintained for a period of not less
than two (2) years after completion or termination of this Agreement or, in lieu thereof, HCC
shall purchase tail coverage (extended reporting period) under which the City shall be afforded
protection. HCC will provide a Certificate of Insurance listing the City as the Certificate Holder
and evidencing compliance with the insurance requirements in this Agreement. The City
reserves the right to require complete certified copies of insurance policies procured by HCC
pursuant to this Agreement, including any and all endorsements affecting the coverage required
hereunder.
18. Indemnification. To the fullest extent permitted by law, HCC shall indemnify
and hold harmless the City, its agents, representatives, officers, officials and employees from and
against all claims, damages, losses and expenses (including but not limited to attorney fees,and
court costs) attributable to bodily injury, sickness, disease, death, or injury to, impairment, or
destruction of property, including loss of use resulting therefrom, to the extent that such claims,
damages, losses, and expenses are caused by the wrongful acts, negligent acts, errors, or
omissions arising out of or related to the services of HCC, its employees, agents, or students in
the performance of this Agreement or their participation in the Training Program or Field
Internship. Provided, however, the foregoing indemnification shall not extend to claims,
damages, losses and expenses to the extent such claims, damages, losses and expenses arise out
of the wrongful acts, negligent acts, errors or omissions of the City or any of its employees or
agents, or any default or breach of this Agreement by the City.
19. Student Waivers. The parties acknowledge and agree that, as a condition to HCC
students' participation in the Field Internship program, the City may require students to sign a
release or waiver form, together with any other documentation reasonably required by the City to
document the students' consent to the City's rules, regulations, and terms of participation in the
Field Internship program.
20. Annual Internship Needs. It is agreed that circumstances may arise on the part
of either party, which would prevent assignment of students to SFD during any given year. It is
further agreed SFD shall determine the maximum allowable number of student participants at
any one time in any Field Internship setting.
21. Withdrawal of Students. HCC shall cause any student designated by SFD
administrator or designee to be withdrawn from Field Internship immediately upon verbal
request. Withdrawal may be permanent or temporary as determined by SFD administrator. A
written justification for removal shall be provided to HCC EMS Education Director and faculty
within seven (7) days after removal.
22. No Assignment. It is agreed that all rights and privileges of each party arising out
of this Agreement shall not be transferred, assigned, or conveyed.
23. Modification. The parties agree that there shall be no modification of this
Agreement unless said modification is reduced to writing and has been signed by both parties.

24. Notices. Any notices required by this Agreement shall be sufficient if sent by the I'
parties hereto by United States first class mail, postage prepaid, to the address below:

25. Entire Agreement. This Agreement contains all the terms and conditions agreed;
upon by the parties hereto, and no other Agreement, oral or otherwise, regarding the subject;,
matter of this contract or any part thereof, shall have any validity or bind any of the parties
hereto.
26. Severability. If any clause or provision of this Agreement is illegal, invalid, or
unenforceable under the present or future laws effective during the term of this Agreement, then`
and in the event, it is the intention of the parties hereto that the remainder of this Agreement shall
not be affected thereby and it is also the intention of the parties to this Agreement that in lieu of.
each clause or provision of this Agreement that is illegal, invalid or unenforceable, that will be
added as a part of this Agreement a clause or provision as similar in terms to such illegal, invalid,
or unenforceable clause or provision as may be possible and be legal, valid and enforceable.
27. Applicable Law; Venue. The parties agree that the laws of the State of Kansas
shall govern this Agreement. The parties agree and consent that jurisdiction and venue of any
legal disputes between them shall be in the District Court of Saline County, Kansas. The parties
further agree that any legal disputes between them shall, prior to the filing of such disputes in
court, be first mediated utilizing a neutral mediator jointly selected by the parties with the
presence and participation of both parties at Salina, Kansas.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed
by their authorized representatives.
