Second reading Ordinance No. 03-10170 providing for the vacation of a portion of a public utility
easement at the vacated Scanlan Avenue between Schilling Road and the vacated Jumper Road in
the Airport Industrial Area.
BACKGROUND:
Ordinance No. 03-10170 was passed on first reading on October 6, 2003. Since that time, no
comments have been received. Agreements between the applicant and Southwestern Bell
Telephone and between the applicant and the City of Salina have been reached, as indicated in the
attached letters.
The recording, with the Register of Deeds, of Ordinance No. 03-10170 will occur once the existing
public waterline has been relocated out of the proposed easement vacation area.
RECOMMENDATION:
Adopt Ordinance No. 03-10170 on second reading.

Subject: Sewer Privatization

Shawn: This letter is to insure the City of Salina that Schwan's Food Manufacturing, Salina
(Tony's Pizza) agrees to the privatization of the sewer line presently in the section of easement to be
abandoned. This easement is located on the West side of our facility and is being abandoned for the
construction of a Cooler / Freezer addition in this area. It is our intent to take over all responsibility for the
maintenance and care of this sewer line. This includes the inspection, repair and replacement of said sewer
line on an as needed base.

have.

Dear Mr. Klanke:
SBC agrees to the vacation of the right-of-way C<a part of Scanlon Avenue from the south
side of Schilling Road, South approximately 340' by 80' ."
Mr. Harry Smith, Director of Manufacturing, Schwan's Food Manufacturing has agreed
to bear the cost of relocation of SBC facilities that currently reside in the existing utility
easement, and has provided for a new location for the cable to be placed.
