Report on validity and submittal of engineering feasibility report for Petition No. 4157, filed by
Lonnie Wilson, for thc installation of certain utility improvements.
BACKGROUND
It is prescribed by Kansas State statutes that thc City Commission consider a petition for utility
improvements and establish sufficiency on the basis that any one of the following conditions are met:
1. The petition is signed by a majority of resident owners of record of property liable for
assessment under the proposal.
2. The petition is .signed by the resident owners of record of more than one half of the area
liable for assessment under the proposal.
3. The petition is signed by the owners of record, whether resident or not, of more than one
half of the area to be assessed under the proposal.
In this case, petition signature represent 59% of the owners of record in the area liable for
assessments. Therefore, the petition clearly meets the statute requirement for sufficiency. The
Saline County Treasurer has indicated there are no delinquent taxes or special assessments on any
property within the benefit district which shall be assessed for 76% of the project costs estimated to
be $36,040. The estimated benefit district share is $27,425. The remaining 24% of the project costs,
or $8,615, will be paid by the City due to the over-sizing of the water pipeline for operational
purposes. The benefit district has been split into two areas, "A" and "B". Each tract of property in
benefit district "A" will pay their share of the costs based on adjusted front footage of each lot. Each
tract of property in benefit district "B" will be assessed costs based on square footage of each lot and
unplatted tract.
The benefit district's portion of project costs may be initially financed 100% by the City and then
repaid by the property owners over a 10 year period with the special assessment system. The owner
of the large agricultural tract on the south side of State Street is requesting a deferral of the special
assessment for a period of 15 years or until the property is platted or developed. This policy has been
applied by the City on previous projects.
RECOMMENDATION
It is recommended that the City Commission approve the engineering feasibility report for utility
improvements and adopt the resolution determining the advisability of the project. An authorization
resolution would be considered on April 6.

SCOPE OF WORK
The installation ofa watermain on State Street between Broadway Boulevard and the vacated Orange
Street to benefit Blocks 1, 2, 3, 4, and east 1/2 of Blocks 5 and 6, Elm Grove Addition to the City
of Salina; Block 1 and the North '/2 of Block 10, Leavenworth Addition to the City of Salina; and
also an unplatted tract on the south side of State Street located in the N.W. 1/4 Section 14, Township
14 South and Range 3 West.
BENEFIT DISTRICT
Benefit District "A":
Lots 1 through 9, Block 1; Lots 1 through 9, Block 2; Lots 1 through 18, Block 3; Lots 1 through 18,
Block 4; Lots 1 through 10, Block 5; and Lots 1 through 9, Block 6, all in Elm Grove Addition to
the City of Salina, Saline Co., Kansas.

Lots 1 through 7, Block 1 and the N. '/2 of Block 10, Leavenworth Addition to the City of Salina,
Saline Co., Kansas and the following described unplatted tract located in the N.W. 1/4 of Section
14, Township 14 South, Range 3 West: Beginning at a point on the south right-of-way line of State
Street that is 35 feet west of the N.W. comer of Lot 1, Block 1, Leavenworth Addition to the City
of Salina, Saline Co., Kansas; thence 492 feet west along said south right-of-way line; thence south
602.5 feet; thence east 492 feet to a point 35 feet west of the west line of Block 10, said Leavenworth
Addition; thence north 602.5 feet to the point of beginning. Said unplatted tract contains 6.805
acres, more or less.
ADOPTION OF ASSESSMENT
The assessment with accrued interest to be levied as a special assessment tax upon the property
included within the benefit district concurrent with the general property tax and shall be payable in
ten (10) equal annual installments.
The method of assessment is that 100% of the total cost of the watermain improvements assessed
against the property shall be based upon adjusted front footage for each lot Benefit District "A" and
based upon area of each lot and unplatted tract in Benefit District "B".

COST CHARGEABLE TO PRIVATE PROPERTY:
1. 100% of the total cost of 6" watermains, fittings, hydrants, valves, and any incidentals
thereto to complete the water system.
COSTS CHARGEABLE TO THE CITY:
1. Approximately 24% of the watermain cost for the over sizing of the pipeline from 6" to
10" to enhance the City's future water distribution system.
