1959 Agreement • • AGREEMENT ,• THIS AGREEMENT made and entered into this .5 day of--PtaFeh, 1959, by the ___,Water Department of the City of Salina, Kansas, and Hi-Way Sundries Store. For and in consideration of the mutual convenants hereinafter stated it is hereby agreed: 1. The Water Department shall furnish all Water- records or forms to the Hi-Way Sundries Store to use for collection and remittance of receipts and pay it five cents per account collected. • 2. A. The Hi-Way Sundries Store is to furnish the office space, light, heat and office equipment and to determine the manner and method in which the work shall be performed and to conduct the collection in the name of the Hi-Way Sundries Store and agrees that all persons shall be employed by and responsible to the Hi-Way Sundries Store and not the Water Department. B. The Hi-Way Sundries Store shall protect, indemify and hold harmless the Water Department from any loss, damage, liability and expense for all injuries, including, death or damage to property directly or indirectly arising or growing out of the performance of this contract. C. The Hi-Way Sundries Store to accept and receipt for the payment of moneys paid on accounts due The Water Department from its customers. D. The Hi-Way Sundries .Store to account .for such- moneys received and remit • the same to an authorized representative of the Water Department and keep accurate records thereof. E. The Hi-Way Sundries Store shall have'no authority to adjust or comprise any account; and shall have no authority other than herein expressly stated. 3. Either party hereto shall have the right to terminate this contract at any time by written notice to the osther, in which. event The Hi-Way Sundries Store shall surrender to the Water Department all forms and records supplied by the Water Department and account for and deliver to the Water Department all collections made. • Signed the day and year first above written.
