Olson, City Manager Dean Boyer, City Engineer Downtown Beautification Project We received final plans and specifications on the above subject project at 4:00 P.M. today. These plans were for the Santa Fe Avenue improvements from Ash Street to Mulberry Street, which we shall refer to as Phase I. We will have these documents reviewed and be ready to report on our findings at the City Commission Meeting on June 9, 1975. As you know, the detailed plans and specifications for the improvements to be made on Fifth Street and Seventh Street, which we shall refer to as Phase II, have not been prepared. I have received three (3) copies, attached hereto, of a proposed contract from White', Hamele, and Hunsley to prepare these plans and specifications. This company is the engineering consultants that prepared the Phase I, Santa Fe Avenue plans. This proposed contract contains the same fee schedule as the Phase I contract, except with a reduced maximum fee. I see nothing wrong with this contract and would suggest its approval on Monday so the plans and specifications can be completed for the Downtown Beautification Project. We are in the process of checking the validity of the petition submitted on the above subject project. This report will also be completed in time for the City Commission Meeting on June 9, 1975. Respectfully submitted, Dean Boyer .' ~ DB:MKP ENC: (3) DOWNTOWN BEAUTIFICATION PROJECT PHASE II AGREEMENT FOR ENGINEERING SERVICES THIS CONTRACT, herein called the "CONTRACT", dated the day of June, 1975, by and between the City of Salina, State of Kansas, herein called the "CITY", and White, Hamele & Hunsley, a partnership consisting of Kenneth N. White and Harry L. Hunsley, doing business as consulting engineers and plan- ners of the City of Salina, State of Kansas, herein called the "CONSULTANT". WHEREAS, the CITY desires to engage the CONSULTANT to render certain engi- neering services to the CITY. NOW, THEREFORE, the parties mutually agree. SCOPE OF SERVICES: The CONSULTANT shall perform the following services in order to prepare and complete the plans and speci- fications for improvements on Fifth Street and Seventh Street from Mulberry Street to Ash Street in Salina, Kansas, including coordination of utility improvements as follows: item I. All necessary survey, topography and location of existing conditions shall be performed by the CONSULTANT. The survey will be taken to insure all existing conditions are taken into consid- eration in final design. Item II. Final Design~ Final 'plans and specifications shall be prepared by the CONSULTANT ready 'for bid letting. Final plans will include street improvements, landscaping and the related incidentals such as lighting, benches, planters, etc., which will be proposed for construction by the CITY. The CONSULTANT shall perform additional services following com- pletion of the plans and specifications, as follows: Item III. Upon completion of final plans, the CONSULTANT shall assist the CITY in developing the contract documents and supply necessary information to obtain and evaluate bids. Item IV. Construction Staking. The Contractor shall be respon- sible for laying out and setting stakes for construction. The city engineering department shall provide for inspection of the construction. The CONSULTANT shall advise and coordinate with the CITY on problems, changes or revisions required during con- struction. -1- COMPENSATION: For the aforesaid services the CONSULTANT shall be compensated in a sum not to exceed $9,500 in accordance with the following schedule. $ 0 - $ 29,999 --- 12.0% 30,000 - 49,999 --- 11.0% 50,000 - 99,999 --- 9.5% 100,000 - 149,999 --- 9.0% 150,000 - 174,999 --- 8.7% 175,000 - 199,999 ---'8.5% 200,000 - 249,999 --- 8.3% 250,000 - 300,000 --- 8.0% The fee shall be based upon the construction cost of the improve- ments, for which the CONSULTANT provided the design; and, shall be paid 90% upon completion of the plans and specifications and 5% upon completion of letting of bids and 5% upon final inspec- tion of the completed project by the CONSULTANT hereunder. e TIME OF PERFORMANCE: The services are to commence forthwith and to be completed within 30 days from the date of this contract. PREVAILING SALARIES: Not less' than the respective salaries in the locality as determined pursuant to the attached "Determina- tion of Prevailing Salaries of Technical Positions" shall be paid to persons in the respective occupations listed therein employed in the performance of work under this CONTRACT. .5. NON-DISCRIMINATION: During the performance of this CONTRACT, the CONSULTANT agrees that he will not discriminate against any em- ployee or applicant for employment because of race, creed, color or.national origin. The CONSULTANT will take affirmative action to ensure that applicants are employed, and that employees are treated during employment without regard to their race, creed, color or national origin. Such'action shall include, but not be limited to the following: Employment, upgrading, demotion, or transfer, recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selecting for'training, including apprenticeship. The CONSULTANT agrees to post in conspicuous places, available to employees; and applicants for employment, notices to be provided by the CITY setting forth the provision of this non-discrimination clause. The CONSULTANT will, in all solicitations or advertisements for employees placed by or on behalf of the CONSULTANT, state that all qualified applicants will receive consideration for · employment without regard to race, creed, color or national origin. The CONSULTANT will cause the foregoing provisions to be in- serted in all subcontracts for any work covered by this con- tract so that such provisions will be binding upon each sub- contract. e EFFECTIVE DATE OF CONTRACT: The CONTRACT shall be effecttve~UPO~ ~'' the date of the execution of this agreement.
