TEMPORARY CONSTRUCTION EASEMENT
THIS INDENTURE, made this /lay of May, 1998, by and between SALINA T.T.
PARTNERSHIP, a Kansas General Partnership, (the "Grantor"), and the CITY OF SALINA,
KANSAS, a municipal corporation (the "City").
WITNESSETH: The Grantor for good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, does hereby grant, bargain, sell, and convey unto
the City, a temporary construction easement in, through, over, and across a certain portion of
land owned by the Grantor, as legally described on the attached and incorporated Exhibit A and
as depicted on the Engineering Drawing attached and incorporated as Exhibit B (the "Temporary
Easement") for all rights of ingress and egress of the City, its employees, contractors, and
franchisees, for the purpose of matching grade between project improvements and improvements
such as driveways and sidewalks, for a term of one year commencing with the date of this
indenture.
IN WITNESS WHEREOF, the Grantor has signed this Temporary Construction
Easement this /get-day of May, 1998.

A tract of land in the South half of the Southeast Quarter of Section 26,Township 14
South,Range 3 West of the 6`s Principal Meridian, City of Salina, Saline County,Kansas, and
described as follows;
Beginning at the Northeast corner of a tract of land as described and recorded in Book
348 at Page 979,Register of Deeds Office,Saline County,Kansas,said point being at the
intersection of the South line of Saturn Avenue and the West line of Planet Avenue in Salina,
Kansas; thence Westerly along the North line of said tract,and South line of Saturn Avenue,a
distance of 14.37 feet; thence Southeasterly,a distance of 18.80 feet to a point on the East line
of said tract,and West line of Planet Avenue, said point being 12.18 feet South of the point of
beginning; thence Northerly along said East line to the point of beginning, containing 88 square
feet, more or less.
Temporary Easement

348 at Page 979,Register of Deeds Office,Saline County,Kansas,said point being at the
intersection of the South line of Saturn Avenue and the West line of Planet Avenue in Salina,
Kansas; thence Westerly along the North line of said tract,and South line of Saturn Avenue, a
distance of 147.00 feet thence Southerly and parallel with the East line of said tract,a distance
23.00 feet; thence Easterly and parallel with said North line a distance of 11.00 feet; thence
Northeasterly deflecting 30 degrees 57 minutes 50 seconds Left,a distance of 29.16 feet; thence
Easterly deflecting 30 degrees 57 minutes 50 seconds Right and parallel with said North line, a
- distance of 111.07 feet-to a point on the East line of said tract recorded in Book 348 at Page 979;
thence Northerly along said East line a distance of 8.00 feet to the point of beginning,containing
1451 square feet,more or less, excluding the right of way described above.
