A public hearing to consider the vacation of a portion of an existing public utility easement at the
vacated Scanlan Avenue between Schilling Road and vacated Jumper Road in the Airport Industrial
Area.
BACKGROUND:
Petition number 4243 was filed on September 4, 2003 by Mr. Harry Smith, Director of Manufacturing
for Schwans Foods (Tony's Pizza), to vacate a portion of a utility easement located in the Airport
Industrial Area. Please find attached a copy of the petition and vicinity map highlighting the
proposed easement vacation.
The petition that was submitted on September 4, 2003 was to vacate the utility easement in its
entirety from Schilling Road to vacated Jumper Road immediately west of the Tony's Pizza plant.
The purpose of the easement vacation is to make room for a new 14000 square foot refrigeration
building at the plant. Several utilities, both private and public, exist in this easement and the
petitioner was notified that all utilities would need to be relocated and that new easements would
need to be dedicated. That prompted a letter from the petitioner to the Engineering Division, dated
September 15, 2003, requesting a modification of the easement vacation boundaries. The portion of
the easement that is now being proposed for vacation is the east 80 feet of the north 340 feet as
shown on the attached drawing. This would leave a 35 foot utility easement along the west side of
the former Scanlan Avenue right-of-way for relocated and existing utilities. The petitioner currently
owns all of the lots affected by this action.
The existing public utility easement was retained when the Replat of Schilling Subdivision was
completed in 1998 because there were existing utilities in the former Scanlan Avenue right-of-way.
The vacation of this section of Scanlan Avenue would not have been possible without retaining this
public utility easement.
Several meetings have taken place with the petitioner to discuss the scheduling and financial
impacts of this request. Staff has received input from all affected franchise utility companies, and
only two utilities now have any issues with the vacation. These utilities are an existing public water
main (City), and fiber optic telephone cables (Southwestern Bell Telephone). Both utilities are in
opposition to the vacation unless financial and design arrangements are made for the facilities to be
relocated to the remaining portion of the easement.
Preliminary plans for the relocation of the public waterline have been submitted, and comments and
corrections were reported to Wilson & Company Engineers and Architects. Revised plans have not
been received for the waterline relocation.

RECOMMENDATION:
It is recommended that the City Commission approve on first reading Ordinance No. 03-10170 to
vacate a portion of the public utility easement west of Tony's Pizza and just south of Schilling Road
in the vacated Scanlan Avenue right-of-way. Second reading of the ordinance will be conducted
after satisfactory agreements have been reached between the petitioner and the two affected
franchise utilities.
