Compliance Agreement COMPLIANCE AGREEMENT
This Compliance Agreement is entered into this 2nd day of April, 2013 by and between the City of Salina. Kansas
("City`) and Brian Metzger as owner of 633 S. 4ih St., Salina. Kansas ("Owner").
Recitals
A. Owner owns 633 S. 41h St., Salina. Kansas, legally described as Lot 11, Lunkenheimer Addition to the
City of Salina. Saline County. Kansas (the "Property').
B. Following a public hearing before the Governing Body of the City on July 23, 2012, the Property was
determined to be a "dangerous structure" and ordered repaired or demolished under Resolution No. 12-6923 adopted by
the Governing Body on that same date. •
C. On December 17, 2012, the Governing Body awarded a contract for demolition of six residential
structures determined to be dangerous structures, including the Property.
er has given assurances that in exchange for the opportunity to restore the Property, he will pay what
�• < ermined to be the City's costs associated with removal of the Property from the demolition contract in the
-mount of $3,350.00 and restore the Property to Salina City Code ("City Code") standards within a period of 120
consecutive calendar days.
The parties, therefore, covenant and agree:
1. Payment of City's Isolated Costs. Owner has paid to the City and the City acknowledges receipt of the
sum of$3,350 in payment of the City's isolated costs resulting from the City's removal of the Property from under its
demolition contract.
2. Code Compliance. Owner acknowledges that the Property meets City Code criteria for status as a
"dangerous structure" and violates City Code in relation to exterior property maintenance, interior property maintenance,
nuisances, and zoning. Owner agrees to bring the Property into full City Code compliance within 120 days of the date of
this Agreement ("Deadline") and in doing so shall fully comply with City Code requirements, including but not limited to
building permits, payment of fees, use of licensed contractors when required, and inspection of work. An outline of
conditions of the Property observed by city inspectors and related City Code provisions is attached and incorporated as
"Exhibit A" as a guide to assist the Owner and Owner's contractors in achieving full City Code compliance. While
Exhibit A is intended to be a comprehensive guide for Owner and Owner's contractors, identification of all work
necessary for the Property to be fully City Code compliant remains the responsibility of Owner and Owner's contractors.
3. City's Remedies. If the Property remains a dangerous structure as of the Deadline, the City shall cause it
to be demolished and the cost of demolition assessed against the Property as a special assessment. If Owner fails to bring
the Property into full City Code compliance as of the Deadline, the City may, at its discretion, pursue any legal means
available to enforce this Agreement, to require the Owner to remedy any or all of remaining City Code violations, and/or
cause any part or all of the work necessary to achieve City Code compliance to be completed and to obtain a personal
judgment against the Owner for the cost of the work or to cause the cost of the work to be assessed against the Property as
a special assessment.
4. Binding Effect — Non-assignable. This Compliance Agreement shall be binding upon the Owner and
Owner's heirs, beneficiaries, and personal representatives, but shall not be assignable by Owner.
