The undersigned Mortgagee acknowledges that the City of Salina, Kansas has acquired,
or is about to acquire, public right-of-way affecting certain real estate subject to a Mortgage held
by Mortgagee, which Mortgage is hereby released in part, strictly to the extent it affects the
public right-of-way to be acquired, as follows:
1. The name of Mortgagee is: Solomon State Bank
2. The name of Mortgagor is: Kirk Cusick (a/k/a Kirk R. Cusick) and Diane
Cusick (a/k/a Diane E. Cusick), husband and
wife, and James F. Cusick, a single person
3. The date of the Mortgage is: March 21, 2003
4. The Mortgage was recorded: April 8,2003 at Page 294 of Book 1041
5. That portion of the real estate subject to the Mortgage as released by this partial
release is depicted and legally described on the attached and incorporated Exhibits A and B.
6. This partial release shall not affect the lien of the Mortgagee as it applies to the
remaining real estate described in the Mortgage.
