tO Article III of Chapter 16.5 which shall read as follows: -~
Section 16.5-28. Discrimination prohibited: It shall be unlawful
for an employer, labor org-anization, employment agency or school which
provides, coordinates, or controls apprenticeship, on ~ job training,
or otl~er training or retraining programs, to maintain a practice of dis-
crimination, segregation, or separation because of race, sex,' religion,
Color, national origin or ancestry in admission, hiring assigrm~_nt, up-
gr~ing, transfer, promotion, layoff, dismissal, apprenticeship, or other
training or retraining programs; or in any other terns, conditions or
privileges, of employment, membership, apprenticeship, or training; or to
follow any policy or procedure ~ich, in fact, results in such practices,
without a valid business motive or occupational qualification.
Section 16.5-29. Contracts Provisions: that in all contracts entered
into by the City of Salina, Kansas, or any of its agencies or departments,
there slu~ll be included a provision that during 'the performance of the
contract tJ~at the contractors will not discr~,ninate against, any employee

or applicant for en~loyn~nt in the performance of said contract and~ every

contractor shall include a similar provisions in all subcontracts under
his contract with the City of Salina.
Section 16.5-30. Affirmative Action: Any contractor entering into
a contract witJ~ t~e City of Salina and his sub-contractors shall take
Affirn%~tive Action to insure that employees are treated equally without
regard to their race, sex, religion, color, national origin or ancestry.
Such affirmative action shall include, but not be limited to the following:
emplo~nent, upgrading, demotion or transfer, recruiting or recruitment,
advertising, layof~ or termination, rates of.pay or other forms of oom-
pensation and selection for training, including apprenticeship. ~le con-
tractor and sub-contractor shall agree, to post in conspicuous places
available to en~loyees and applicants for en~)loyment, notices to be pro-
vided by the Personnel Director setting forth provisions of this section.
~he ~ontractor and his sub-contractros shall provide all affirmative action
information and necessary doctm~nts to implement t]~ co~lianoe with the.
~r~ts of all Federal, State and Local laws and ordinances. It
shall be no excuse that the employer has a collective bargaining with
any union providing for-exclusive referral o~ approval systems. The failure
of the contractor or sub-contractors to comply with th~ z~q,,~rem~.nts of this
sectic~ shall be grouD~-~ for cancellation, termination, or suspension of the
contract in whole or in part by the Board of Cc~missioners with tAe con-
tractor or sub-contractors until satisfactory proof of intent to cc~ly
shall be submitted to and accepted by the Board of C~mtissi~s.
Section 16.5-31. Human Relations Conmission to Administer: The
Human Relations Coam%ission of the City of Salina shall be th~ ad~inistra-
-rive agency of this ordinance and shall receive, investigate and conciliate
complaints of discrimination or other violations of this ordinance. After
the filing of a written notarized cc~plaint witil the Human Relations
C~-~-~,,~ssion by an aggrieved individual, the said Copanission sJ~all investi-
gate the san~ and in the event that said investigation reveals t~at
probable cause exists of violations of any of tt~ provisions of Chis
ordinance, the ti~ Human Relations C~,~,~ssion shall inm~iately e]ndeavor
to eiiminate said unlawful practice by conference and conciliation. In
the event that conciliation fails to eliminate said practices, then the
Human Relations Commission shall hold a hearing as .provided by in Section
16.5-4 of the Code of the City of Saliva. The Human R~lations C~w$ission
or any of its me~nbers or staff shall not disclose the proceeding o~:results
of said conciliation in the event that the complaint is resolved.
Section 2. This ordinance shall be in full force and effect from
and after its adoption and publication in the official city news[~xper.
Adopted by the Board of Con]nissioners of the City of Salina, Kansas,
and signed by ~he Mayor this day of August, 1974.
