BACKGROUND: Ordinance No. 13-10715 was passed on first reading on September 16th, with the second reading scheduled to be heard on September 23, 2013 when the City Attorney desired to assist staff in clarifying language relating to the codes recognized and adopted by the city, therefore it was asked to be postponed until the October 7th meeting allowing for the City Attorney and Building Official to clarify language as to the allowable codes in which instruction would be recognized as appropriate training for continuing education materials. Since that time the city staff and City Attorney have clarified the Continuing Education Codes which are acceptable, acceptable and recognized by the City of Salina Building Services Department. The ordinance as modified clarifies the required code instructional code families which will be recognized by the department, and they include but not limited to the: International Building and Residential Codes, International or Uniform Plumbing Codes, International or Uniform Mechanical Codes, National Electrical Code, Americans with Disabilities Act (ADA), Americans with Disabilities Act Accessible Guidelines (AADAG) or other training approved by the Building Official. With this clarification, city staff is desiring the second reading be approved and adopted into the required continuing education requirements of the City of Salina. ORDINANCE NUMBER 13-10715 AN ORDINANCE AMENDING CHAPTER 8, ARTICLE III, DIVISIONS 2 AND 3, SECTIONS 8-175 AND 8-189 OF THE SALINA CODE PERTAINING TO CONTINUING EDUCATION REQUIREMENTS. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That Section 8-175 of Chapter 8, Article III, Division 2 of the Salina Code is hereby amended as follows: Section 8-175. Continuing education requirements for certain qualified individuals. Any person serving as the qualified individual for a Class A, B or C general contractor or a Class D contractor/owner license shall, as a precondition of serving as the qualified individual for renewal of the license, be required to complete eighteen hours (18) hours of continuing education courses related to the building trades during the term of the license of which three (3) hours each calendar year [for a total of nine (9) hours] must be instruction on codes that are equivalent to or newer than the City of Salina's adopted codes. These will include, but not be limited to the International Building/Residential Codes, International or Uniform Plumbing Codes, International or Uniform Mechanical Codes, National Electrical Codes, Americans with Disabilities Act (ADA), Americans with Disabilities Act Accessibility Guidelines (ADAAG), or other training approved by the Building Official. The building official shall promulgate the regulations necessary to administer compliance with these continuing education requirements. Section 2. That Section 8-189 of Chapter 8, Article 111, Division 3 of the Salina Code is hereby amended as follows: Sec. 8-189. Continuing education requirements. Any person licensed as a journeyman or master in the plumbing, electrical, or mechanical skilled trade license category shall, as a precondition of renewal of the license, be required to complete eighteen hours (18) hours of continuing education courses related to the building trades during the term of the license of which three (3) hours each calendar year [for a total of nine (9) hours] must be instruction on codes that are equivalent to or newer than the City of Salina's adopted codes. These will include, but not be limited to the International or Uniform Plumbing Codes International or Uniform Mechanical Codes , or National Electrical Codes. Continuing education courses must be applicable to the skilled trade for which the journeyman or master is licensed. The building official shall promulgate the regulations necessary to administer compliance with these continuing education requirements. Section 3. Repealer. That existing Sections 8-159 and 8-189 are hereby repealed. Section 4. Summary of ordinance for publication. That this ordinance shall be in full force and effect after its adoption and publication by summary once in the official city newspaper.
