PERMANENT TRAIL EASEMENT
THIS INDENTURE, is made this October 8, 2013, by and between SALINE COUNTY, •
KANSAS ("County") and the CITY OF SALINA, KANSAS, a municipal corporation, ("City"):
Grant: County, for good and valuable consideration, hereby conveys unto the City, in
perpetuity, a permanent easement ("Easement") in, on, over, under and through the real estate
legally described on the attached and incorporated Exhibit A and depicted on the attached and
incorporated Exhibit B ("Real Estate") for the purposes of constructing, maintaining, repairing,
replacing, and operating a surfaced frail for use by the public in accordance with City regulation.
Term: The Easement shall be perpetual.
Ownership: County covenants that it owns the Real Estate and has the right, title and
capacity to grant the Easement.
Maintenance: City acknowledges that it shall be responsible for maintenance of the Real
Estate subject to the Easement.
Binding Effect: The Easement and these acknowledgements, agreements, and covenants
SHALL BE BINDING UPON AND SHALL RUN WITH THE REAL ESTATE.
IN WITNESS WHEREOF, the parties have hereunto caused this instrument to be
executed the day and year written above.
