Escrow AgreementESCROW AGREEMENT THIS AGREEMENT is made this 27th day of August, 2012, by and between Jennifer L. Adams and Robert D. Umsheid III, (Referred to in this Agreement as "the Property Owner") and the City of Salina, Kansas (Referred to in the Agreement as "the Escrow Agent"). RECITALS A. Property owner is the owner of real estate legally described as: Lot 13, Block 6 Eastview Estates Addition (referred to in this Agreement as "the Real Estate") B. Special Assessments have been levied against the Real Estate and bonds have been issued by the City of Salina, Kansas, in payment of the costs of the public improvements for which the special assessments were levied. C. Pursuant to Salina Ordinance Number 88-9252, the Property Owner wishes to deposit with the Escrow Agent funds which, when held in an interest-bearing account, will generate sufficient interest such that the share of annual payments of bond principal and interest attributable to the Real Estate can be made. D. The Escrow Agent is willing to receive such payment from the Property Owner and to hold such funds, subject to the terms and conditions of this agreement. SO NOW, THEREFORE, the parties agree as follows: 1. Payment. The Property Owner deposits with the Escrow Agent the sum of Thirty Two Dollars and 02 /100 Dollars ($32.02), the receipt of which is hereby acknowledged by the Escrow Agent. 2. Investment. The sum deposited by the Property Owner with the Escrow Agent shall be deposited by the Escrow Agent in an escrow account under the City's Special Assessment Escrow Fund and invested as permitted by law. 3. Annual withdrawal. In January of each year, the Escrow Agent shall transfer from the escrow account an amount necessary to pay the annual bond principal and interest payments attributable to the Real Estate and the $10.00 annual administration fee. The amount necessary to pay bond principal and interest will be transferred to the City's Bond and Interest Fund and the administrative fee shall be transferred to the City's General Fund. 4. Termination. This Escrow agreement shall terminate on the date coinciding with the payment from the escrow account of the,final annual installment of bond principal and interest attributable to the Real Estate. 5. Binding effect. This Escrow Agreement shall be binding upon and insure to the benefit of the heirs, executors, administrators, devisees, legatees, successors and assigns of the parties. The amounts they gave you were for the 2011 tax year not the 2012. The Treasurer's Office does not have the 2012 information uploaded to their system so they can not give you that information. When I asked, I got the some amounts you got below on the 2011 statement. The specials for 2012 will be $1256.57. This amount includes a nuisance abatement in the amount of $158.00. Since the first half of the taxes are not due until December 2012, they will probably not accept payments for the 2012 specials until sometime in November but that is just my guess. hope all of this helps. The Treasurer's office kept giving me the run around because I guess they just get crazy when it comes to "Specials". Shandi said we can pay on your 2012 taxes anytime and that we could definately pay the $1145.74 to the treasurer's office at any time. So is that what you want to do? The buyer needs to be aware that the 2012 specials will have to be paid with the 2012 taxes since the payoff is after the August 20th deadline. The new amount will be $2,060.98. However, if the borrower does not pay off the specials on August 20th we will have to recalculate the payoff amount and they will have to pay the 2012 specials with the 2012 taxes. The payoff amount for August 201h is $3,179.55, with payment made payable to the City of Salina. If the borrower does want to pay the specials off on August 20th I will need the names of all owners listed on the property to put on the escrow agreements. All property owners are required to sign the escrow agreements (there will be 2 sets) and have their signatures notarized. The payment and escrow agreements will have to be in my office on August 20th. Please let me know if the borrower would like to go through with this so I can start working on the escrow agreements. The amounts they gave you were for the 2011 tax year not the 2012. The Treasurer's Office does not have the 2012 information uploaded to their system so they can not give you that information. When I asked, I got the some amounts you got below on the 2011 statement. The specials for 2012 will be $1256.57. This amount includes a nuisance abatement in the amount of $158.00. Since the first half of the taxes are not due until December 2012, they will probably not accept payments for the 2012 specials until sometime in November but that is just my guess.
