RESOLUTION NUMBER 3119

• A RESOLUTION DETERMINING THE POLICY OF THE BOARD OF COMMISSIONERS OF
THE CITY OF SALINA, KANSAS, IN REGARDS TO INSTALLATION OF GENERAL IMPROVEMENTS
IN UNDEVELOPED PROPERTY WITHIN THE CITY, SPECIFYING THE TIME FOR PAYMENT OF
SAID IMPROVEMENTS, AMENDING SECTION 1 (a) OF RESOLUTION NUMBER 3113 AND
REPEALING EXISTING SECTION 1 (a) THEREOF.
BE IT RESOLVED by the Governing Body of the City of Salina, Kansas:
• Section 1 . That Section 1 (a) of Resolution Number 3113 adopted
by the Board of Commissioners on the 6th day of December, 1971, be amended to
•
read as follows:
"(a), That the petitioner or petitioners requesting the
installation of streets, sidewalks, water lines, storm or
sanitary sewers or any other general improvements mentioned
in K.S.A. 12-6a02, which confer a special benefit upon
unimproved or undeveloped property located within a specified
area within the city shall be required to pay a minimum of
' fifty (50) percent of the cost of the improvements which will
: i be assessed against their property, In cash, to the City
Clerk, within five (5) days after the end of the protest
i - period mentioned in K.S.A. 12-6a06 or within fifteen (15)
days after approval of petition filed in accordance with
K.S.A. 1970 Supplement 12-6a04 (f) ; Provided, however,
' that in lieu of the cash deposit above provided for the L.
petitioner or petitioners may file with the City Clerk
within the same period of time an indemnity bond or
agreement executed by one or more sureties acceptable to
the City of Salina, which bond or agreement shall agree to
indemnify or hold harmless the City of Salina from any loss
resulting from the special assessments levied against their
property as a result of said improvements."
Section 2. That Section 1 (a) of Resolution Number 3113 of the
City of Salina, Kansas, is hereby repealed.
Section 3. This Resolution shall be in full force and effect
from and after its adoption and publication in the official city newspaper.
Adopted by the Board of Commissioners and signed by the Mayor
this 28th day of February, 1972.

BE.IT RESOLVED by the Governing Body of the City of Salina, Kansas:
Section 1, That It Is hereby determined to be the policy of the

. • (A). That the petitioner or petitioners requesting the

property within the benefit district has improvements located thereon which
are assessed by the County Clerk of Saline County for taxation purposes.
Section 3. That this resolution shall not apply to sidewalks
requested pursuant to K. S. A. 12-1803 or for sewer or water lines if the
City Commission determines,the Installation of the same are necessary for
,I the health and general welfare of the area.
w i Section 4. Resolution Number 3064 of the City of Salina, Kansas,
is hereby repealed. .
Section 5. This resolution shall be In full force and effect
from and after Its adoption and publication in the official city newspaper. •

APPORTIONMENT OF COST
COST CHARGEABLE TO PRIVATE PROPERTY:
1. 100% of the total cost of curbing, guttering, paving, grading,
storm sewer, drainage and any incidentals thereto, except Item
No. 1 , listed below.
2. 100% of the total cost of 6-inch water mains , fittings , valves,
water service lines and any incidentals thereto to complete
the water system, except Item No. 2, listed below.
3. 100% of the total cost of sanitary sewer pipe, manholes and
construction thereof, and any incidentals thereto to complete.

COST CHARGEABLE TO CITY:
1 . 100% of the total cost of curbing, guttering, paving and grading
Within the limits of a street intersection.
2. 100% of the total cost of fire hydrants.
ADOPTION OF ASSESSMENT
The assessment with accrued interest to be levied as a special
assessment tax upon the property included within the benefit district
concurrent with the general property tax and shall be payable in ten
(10) equal annual installments.
The method of assessment shall be based on the adjusted front
footage of each lot of land and without regard to buildings or improvement
of land.
