Standard General Conditions. The General Conditions of the Contract for the Construction of Buildings, Standard Form of the American Institute of Architects, hereinafter referred tows the "Standard General Conditions", are hereby made a part of these specifications and of any contract subse- quently entered into. A copy of these Standard General Conditions may be seen in the office of the Architect -Engineer. 2. Supplementary General Conditions. These supplementary general condi- tions and the specifications following shall take precedence over and shall modify any pages or statements of the above mentioned Standard General Conditions and shall be used in conjunction with them. a. Definition of Terms. (1) Contract Documents. The term "Contract Documents" shall include the following. 1. Drawings 5. Technical Specifications 2, Special Conditions 6. Agreement 3. General Conditions 7. Proposal 4, Standard General Conditions by Reference (2) Architect -Engineer. The term "Architect -Engineer" or "Architect" shall mean the firm of Wilson -Shaver, Architects -Engineers, Salina, Kansas, acting within the authority entrusted to them. The term "Architect -Engineer" has the same meaning as the term "Architect" in the Standard General Conditions and the two terms are used interchangeably throughout the contract documents. All questions of bidders, and of the Contractor after award of the contract, shall be directed to Wilson -Shaver. Any prospective bidder in doubt as to the true meaning of any part of the contract documents may submit to Wilson -Shaver a written request for an interpretation thereof. Official interpretation, modification or revision of the contract documents prior to awarding of contract will be made only by addendum, duly issued and mailed or delivered to each party having a set of contract documents. (3) The Phrase "or Equal". Wherever the phrase "or equal" appears in these specifications, it shall be construed to mean that mate- rial or equipment will be acceptable only when such material or equipment is composed of parts of equal quality, is of equal workmanship and finish, and will accomplish the desired end as efficiently as the brand or make of material or equipment which has been named in the technical specifications; all as approved by the Architect -Engineer. (4) Work. The term "work" shall mean the furnishing of mate" rials, tools, equipment, incidentals, and other items required for construc- tion purposes or incorporated in the finished work; together with performing the necessary operations to complete the construction under the terms of the contract documents in accordance with the plans and specifications. GC -1 b. Specifications. Titles to divisions and paragraphs of these contract documents are introduced for convenience and shall not be taken as a part of the specifications, and furthermore, shall not be taken as a complete or correct segregation of the several units of materials and labor. No responsibility, either direct or implied, is assumed by the Architect -Engineer for omissions or duplications by the Contractor or his subcontractors, due to real or alleged errors in arrangement of mat- ter in these contract documents. C. Measurement. Before ordering any material or doing any work, each Contractor shall verify all measurements at the building and shall be responsible for the correctness of same. No extra charge or compensation • will be allowed on account of difference between actual dimensions and the measurements indicated on the drawings; and any difference which may be found shall be submitted to the Architect -Engineer for consideration before proceeding with the work, d. Examination of the Premises. Before submitting his proposal for the work, each bidder shall have examined the premises and satisfied himself as to the existing conditions under which he will be obliged to operate, or that will in any manner affect the work under this contract. No allowances will be made subsequently in this connection in behalf of the Contractor for any errors or negligence on his part. e. Permits and Fees. Each Contractor shall obtain and pay for all permits, give all legal notices and pay all fees required for the work of his contract. Each Contractor and his subcontractors shall pay all special assessments or taxes on labor and materials used in the construction of this building, which are or may be levied by the State or National government having jurisdiction over such operations. This item shall include all special taxes, such as Social Security, etc. f. Laying Out Building. The General Construction Contractor shall have the main lines of the building laid out for him at the site by a licensed surveyor or registered civil engineer and shall include the cost of such surveyor's or engineer's service in his proposal. The General Con- struction Contractor shall be responsible for laying out the work from • the lines established by the surveyor or engineer, L. Storage Sheds. Each Contractor shall provide, maintain and remove, when directed, suitable substantial and watertight storage sheds upon the premises in which he shall store all materials which could be damaged by the weather, _h. Water for Building Purposes. Each Contractor shall provide and pay for all water required under his contract. This shall include all means of conveying same to point of use. _i. Electrical Energy. Each Contractor shall apply for and have separate meter set, and pay for all current used in his part of the work He shall also provide all temporary wiring necessary. GC -2 �. Temporary Heat. If temporary heat is required, the General Construction Contractor shall provide approved heating apparatus and adequate and proper fuel, and maintain fire as required. Temporary heating apparatus shall be installed and operated in such manner that fin ished work will not be damaged thereby. k. Equipment. Except as otherwise specified, each Contractor shall furnish at his own cost and risk, all tools, apparatus, hoists, derricks, including power for same, scaffolding and all temporary work and materials necessary for the execution of his contract. Temporary equipment shall be installed in such a manner that the finished work will not be damaged by smoke, falling mortar, concrete or other causes. • 1. Handling Materials. Each Contractor or subcontractor shall be responsible for the proper care and protection of all his materials, equipment, etc., delivered at the site and for any damage to his work, or material, from the date of signing the agreement until the final payment is made, and shall make good, without cost to the Owner, any damage or loss that may occur during this period. Should any material be found defective or in any way contrary to the contract, this material, no matter in what stage of completion, may be rejected by the Architect -Engineer and shall be removed from the premises at once. M. Relations Between Contractors and/or Subcontractors. Each Con- tractor or subcontractor shall cooperate with other Contractors or sub- contractors to the end that undue delay in the construction is avoided. The General Construction Contractor shall install frames for chases and openings and shall install inserts and sleeves for the work of other Contractors; provided such frames; inserts and sleeves are furnished at the proper time, and provided the locations for same are accurately identi- fied by the respective Contractor. In the event such facilities are not furnished by the applicable Contractor at the proper time or are not accurately located, thay shall be installed or relocated at the expense of the Contractor who is at fault, at no additional expense to the Owner. Any existing work damaged shall be repaired at the expense of the offending Contractor. . n. Inspection. Each Contractor shall maintain proper facilities for inspection and safe access to all parts of the work. No work shall be enclosed or permanently covered until approved and should any work be covered without the Architect -Engineer's approval, it shall be uncovered by the Contractor for examination. o. Alterations. The Owner reserves the right to alter any part of the plans or specifications at any time. The additional cost of construc- tion, if any, resulting from such alterations as may be desired shall be charged as "extra", and if any alteration reduces the cost of construction such reduction shall revert to the Owner as a "credit". The amount of "extra" or "credit" for each alteration shall be agreed upon in writing between the Architect -Engineer or Owner and the Contractor in advance. No claim for extras will be allowed unless such extra work shall have been ordered by the Owner or Architect -Engineer in writing and the price of same agreed upon before hand. [e�7 _R. Samples. When so requested, each Contractor shall furnish to the Architect -Engineer, for approval, samples of any materials to be used in the work herein described under his contract. All materials furnished must be fully equal to the approved samples. _q. Approval of Samples. Contractors shall make written request to the Architect -Engineer for, and obtain his approval of, the use of any materials, construction, etc., other than those mentioned as standards in the specifications, or indicated on the drawings, and of materials, con- structions, etc., proposed for the use when "approved" materials or work are specified without mentioning any standard by name. Subcontractors shall make all requests for approval through the respective Contractor. • r, Protection of the Public and Owner's Property. Each Contractor shall assume all responsibility for protection of the public against injury., from the time his contract is signed until final acceptance of the work by the Owner. He shall maintain adequate protection for all his work and materials. He shall be responsible for any loss or damage caused by him or his workmen to the Owner's property, or to adjacent areas, and shall make good any loss, damage or injury to same without cost to the Owner, The General Construction Contractor shall provide and main- tain guard fences, lights and other protection facilities as required by public authority or local conditions. Each Contractor shall protect all existing walks, trees, shrubs, lawns, etc., which are to remain; and any damage to such must be repaired or the item replaced in kind. S. Contractor's Liability Insurance. Each Contractor shall, during the continuance of the work under this contract, and also any extra work in connection therewith, maintain workmen's compensation insurance, public liability and property damage insurance, and other necessary insurance in sufficient amounts to protect himself from any liability or damage for injury, including death, to any of their employees, the public or other persons, including any liability or damage to property. t. Builder's Risk Insurance. The Owner shall maintain fire, tornado, wind and hail insurance upon the entire structure on which the work of this contract is to be done, and upon all materials in or adjacent thereto and intended for usethereon, Any loss shall be made adjustable with and • payable to the Owner as trustee. U. Sanitary Arrangements. The General Construction Contractor shall, at the beginning of the work, provide on the premises where directed, a suitable temporary convenience and enclosure for the use of all workmen on the job, shall maintain same in sanitary condition and remove same and all its contents at the completion of the work; or shall make arrangements to use existing facilities. V. Bond. Each Contractor shall, within 10 days from and after the execution of his contract, and before commencement of the work, furnish and deliver to the Owner, to be filed with the proper authority, and meeting the approval of all parties concerned as required by law, a legally issued GC -4 surety bond meeting the approval of, and running to, the Owner in an amount not less than the total contract price of said improvements, condi- tioned upon the prompt, full and complete performance by the Contractor of his covenants and agreements contained in the contract documents and indemnifying the Owner against all claims, loss or damage which he may sustain or suffer by reason of any injury to persons or property occassioned by the action of the Contractor or his employees. The cost of the bond shall be included in the lump sum bid. W. Addenda. Any addenda issued prior to the time of the bidding shall be covered in the proposal, and in closing a contract they shall become a part thereof. • X. Guarantee. Each Contractor shall guarantee his work for a period of one year from the date of acceptance by the Owner and shall leave same in perfect order at completion; and neither shall the final certificate of payment nor any provision of the contract documents relieve the Contractor of his responsibility for negligence, faulty materials or workmanship within the period above mentioned. Upon receipt of written notice, he shall remedy any defects and shall pay all expenses for any damage done to other work. 1. Payments to Contractor. Not later than the fifteenth day of each calendar month the Owner will make a 90 percent partial payment to each Contractor, based upon a duly certified and approve estimate, for work performed and materials delivered to the site during the preceding calendar month under his contract. The final payment and 10 percent balance will be made upon acceptance of the completed work by the Owner. Z. Use of Completed Portions, The Owner reserves the right to take possession of and use any completed or partially completed portions of the building, and further reserves the right to install equipment and facilities which are not a part of the contract, notwithstanding the fact that the time of completion of entire work or portions thereof may not have expired; but suchtaking possession or installation of facilities shall not be deemed an acceptance of any work not completed in accordance with the contract documents. The Owner, in taking possession of completed • portions or in installing such equipment and facilities, shall do so at his own risk and shall cause to be repaired at his own expense any damage which may occur either directly or indirectly by reason of such action. aa. Cleanup. Each Contractor shall keep the premises reasonably clean at all times, and shall remove all rubbish as often as designated by the Architect -Engineer. Each Contractor shall clean up around the new building when completed and leave the grounds in a neat and clean condition. At the completion of the work, the General Construction Contractor shall have all glass throughout the building washed clean, removing all stains, etc., and taking care not to scratch the glass. GC -5 SPECIAL CONDITIOiNS 1. Scope. The work to be done under these specifications consists of furnishing all materials and performing all work as shown and designated for the City, County, Board of Education Administrative Office Building, Salina, Kansas, as shown on the drawings and as hereinafter specified. The work will be done under the general supervision of Wilson -Shaver, Architects -Engineers, Salina, Kansas, who will represent the Saline County - City Building Authority, hereinafter known as the Owner. 2. Basis of Bidding. The work shall be divided into "General Construction • Work", 'Nechanical Work", "Electrical Work", "Movable Partition Work" and "Elevator Work" as listed on the proposal form. Each bidder is requested to submit prices for each division of work listed for which he wishes to submit a bid. Each successful bidder will become a prime contractor for that Part of the project for which he is awarded a contract. As a prime contractor he will be required to comply with all of the provisions of these Special Conditions and of the General Conditions and Labor Standards. These provisions shall include, but shall not be limited to, requirements for bid security, insurance coverage, permits and fees, storage sheds, water for building purposes, electrical energy, temporary heat, sanitary facili- ties, telephone service, etc. At his option, a prime contractor may furnish his own storage facilities, water, electrical energy for light and power, etc., or may make arrangements with other prime contractors for these fa- cilities and for use of temporary service meters already installed. The work is divided as follows: a. General Construction Work. Part I - General Construction Work shall consist of all general construction, including furnishing all mate- rials and performing all work as specified in Sections 1 through 17 and Sections 24 through 27 of the Technical Specifications, and in addition, all work required to construct and leave openings in walls, floors and ceilings for installation of piping, electrical conduits and other items specified to be furnished and installed under other divisions of the work. The work shall include the installation of framing, anchors and inserts furnished by Others for support of items to be installed by them, provided • the location of such openings, inserts and anchors are made known prior to the construction of such wall, floor or ceiling in which the item is to be located and further providing that no undue delay is caused thereby. b_ Mechanical Work. Part II - Mechanical Work shall consist of all mechanical work, including furnishing and installing all plumbing, venti- lating, heating and air conditioning, piping, ductwork, equipment items and materials. Mechanical work shall include all trenching and backfilling for piping within.the building and all trenching and backfilling for and installation of all water, gas and sanitary sewer lines from the building to and including connections (except connection to gas main) with respective utility lines (existing or by Others) at the approximate locations shown on SC -1 the drawings, together with tunneling under obstructions encountered during trenching operations. All items of work and equipment shall be as shown on the drawings and as specified in Sections 1, 21 and 22 of the Technical Specifications. C. Electrical Work. Part III - Electrical Work shall consist of all electrical work, including furnishing and installing all light and power wiring and facilities including fixtures; installation of conduits, junction boxes and wiring to point of connection with equipment; making electrical connections to all equipment items; telephone conduits, alarm and public - address systems • d. Movable Partitions. Part IV - Movable Partition Work shall con- sist of furnishing and installing movable partitions on first and second floors at all indicated locations in arrangement as shown. All partition components shall be as designated for the location and as specified in Sections 1 and 18 of the Technical Specifications. e, Elevators. Part V - Elevator Work shall consist of furnishing and installing two passenger elevators operating from basement to third floor level and one private elevator operating from second to third floor level in hoistways completed by others at locations shown. All items of work and equipment shall be as shown on the drawings and as specified in Sections 1, 19 and 20 of the Technical Specifications. f. Alternate Proposals. The variations in work to be performed under the Alternate Proposals for each of the Parts are described in Section 1 of the Technical Specifications. 3, Drawings, The drawings governing the work, and to which reference is made throughout these specifications consist of 56 sheets, identified under Project File No. 1528 or 65-85, dated 1 March 1967, and titled as follows: CITY, COUNTY, BOARD OF EDUCATION ADMINISTRATIVE OFFICE BUILDING SALINA, KANSAS 4. Location. North of Ash Street between Seventh and Ninth Streets, Salina, Kansas. 5. Definition of Terms. In addition to the terms defined in the General Conditions, the term "Owner" shall mean the Saline County -City Building )j Authority, Salina, Kansas, and the term "Contractor" shall mean the part- nership, corporation, or individual entering into a prime contract with the Owner for the performance of any work for the project. 6. Proposal and Signature. The bidders shall use the form of proposal attached in presenting bids. Each bidder shall fill out each division of the proposal, including any alternates listed, pertaining to work for which he wishes to submit a bid. Bids shall represent the amount of money re- quired by the bidder for furnishing all labor, materials, tools, equipment SC -2 and incidentals, and for completing the work as herein defined. The amount of the proposal shall be filled out in both words and numerals. In case of conflict between words and numerals, the words, unless obviously incorrect, shall govern. The proposal must be signed with the full name and address of the bidder; if a partnership, by a member of the firm with names and addresses of each member in full; and if a corporation, by an officer in the corporation named, with the corporate seal attached to such signature. No telegraphic proposals or telegraphic modifications of proposals will be considered. Proposals received after the time advertised for the opening of bids will be returned unopened. Each proposal shall be sealed in an envelope marked "Proposal for City, County, Board of Education Administrative Office Building, Salina, Kansas," and shall be designated as to Part of Work • for which the Proposal is submitted. 7. Bid Security. Each bidder is requested to furnish with his proposal a certified check or cashier's check on a solvent bank, or an acceptable bidding bond, payable to the Treasurer Saline County -City Building Authority, Salina, Kansas. Bid securities shall be in the amount of five per cent of the total bid. The bid security will serve as a guarantee that the bidder will file all bonds required and that he will enter into the contract, should it be awarded to him in accordance with the terms of his bid, within 10 days after the certification of the award. Should the successful bidder fail to enter into contract with the Owner, then the security check or bond shall become forfeited as liquidated damages, and the money realized there- from will be turned to the use of the Owner. 8. Liability Insurance. Each Contractor shall take out and maintain such general bodily injury liability and property damage liability insurance and automobile bodily injury liability and property damage liability insurance as will protect him and any subcontractor performing work covered by this contract for claims for damages for personal injury, including accidental death, as well as from claims for property damage, which may arise from operations under this contract, whether such operations be by himself or by any subcontractor or by anyone directly or indirectly employed by either of them, and the amount of such insurance shall not be less than: as Workmen's Conpensation Insurance. Workmen's compensation and employer's liability insurance as required by law fully to cover all employees. b. Bodily Injury and Property Damage Insurance. A comprehensive general bodily injury and property damage policy, including automobiles, covering the work to be performed. The policy shall be written to provide a minimum coverage of $100,000 for each person, with an aggregate of $300,000 for each occurrence of bodily injury liability; a minimum of $50,000 for property damage arising from one accident, with not less than $100,000 for aggregate damages to, or destruction of, property during the policy period; except, in case of automobile damage coverage the minimum provided shall be not less than $50,000 per accident for any vehicle used j on the project, whether owned, hired or nonowned. SC -3 11 9. Statutory Bond, In addition to the bond requirements specified in the General Conditions, a Statutory Bond will be required from each Contractor, which will be a surety bond, running to the State of Kansas and conditioned that the Contractor, as principal, shall pay all indebtedness incurred for labor, supplies, equipment and materials furnished in making the improve- ments called for by the contract documents. 10. Award of Contract. The site of construction is being cleared under separate contract by the Urban Renewal Agency of Salina, Kansas. The Owner will sign construction contracts within 60 calendar days from the date bids are opened. • 11. Commencement and Completion. Immediately upon award of the contract, the Contractor shall start submittal of shop drawings, placing of material orders, mobilization of construction equipment and working crews, and similar preparatory measures, but shall not start construction at the site until he receives a date of availability of site from the Owner in writing. The Contractor shall complete the entire work incidental to final acceptance, including cleanup, within the number of calendar days specified in the proposal. 12. Work by Others will be prosecuted in the vicinity during construction of the City, County, Board of Education Administrative Office Building, including construction of the Salina Public Library; site development of the Civic Center; construction of perimeter streets; and relocation of utilities. Each Contractor shall schedule his operations to the mutual benefit of all the Contractors. 13. Cooperation and Coordination. The General Construction Contractor shall be responsible for coordination of the work of all prime contractors. Each prime contractor shall coordinate the work of his subcontractors. Other prime contractors shall cooperate with the General Construction Con- tractor in coordinating their work with the General Construction Contractor's schedule so as not to cause delay in the work. 14. Sales Tax Exemption. Materials and equipment incorporated into this • project are exempt from the payment of sales tax under the laws of the State of Kansas and such sales tax shall not be included in the proposal of the bidders. The Owner will provide the Contractor with a proper ex- emption certificate number within 10 days of the contract date. Should the Owner fail to provide an exemption certificate number within the re- quired time period, the Contractor shall be reimbursed monthly for all sales tax amounts for which he becomes liable until such certificate number is provided. To minimize the Contractor's record keeping expense, the Owner shall provide an exemption certificate number within 60 days of the contract date or it shall be presumed that the project will proceed on a non-exempt basis, and the contract amount shall be equitably adjusted in writing in a lump sum amount sufficient to cover the Contractor's sales tax expense. Upon issuance of a proper exemption certificate number to the Contractor, the Contractor shall assume full responsibility for his own proper use of the certificate number, and shall pay all costs of any legally assessed penalties relating to the Contractor's improper use of the exemp- tion certificate number. ?' SC -4 15. Temporary Office. The General Construction Contractor shall provide and maintain a temporary office at the site of construction from beginning to completion of work. Office shall be for the use of the General Construc- tion Contractor and the Architect -Engineer; shall be weatherproof; shall have sufficient window lighting to read drawings; and shall be furnished with a table not less than 42 by 72 inches in size. The General Construction Contractor shall provide a telephone in the temporary office for his own use and for the Architect -Engineer's use in matters pertaining to this project. The telephone shall be installed as soon as is practicable and the telephone number shall be given to the Owner and Architect -Engineer. • 16. Shop Drawings for work specified under Sections 2 through 20 shall be submitted to Wilson -Shaver, Architects -Engineers, 205 1/2 South Santa Fe, Salina, Kansas; three sets will be retained by the Architect -Engineer. Shop drawings for work specified under Sections 21 through 27 shall be sub- mitted to Wilson -Shaver, Architects -Engineers, 631 East Crawford, Salina, Kansas; four sets will be retained by the Architect -Engineer. Each Con- tractor shall include a transmittal letter with each submittal of shop drawings, catalog data and samples. The following information shall be shown in tabular form in the transmittal letters: 1. Project name. 2. Project location. 3. Architect -Engineer's file number. 4. Item number (sequence number within the submittal). 5. Drawing number or catalog page. 6. Description of item being submitted. 7. Name of manufacturer or fabricating firm. 8. Quantity submitted (number of drawings, pages, etc). 9. Contract drawing or specification reference to which submittal pertains. 10. Indication as to whether the submittal is a first submittal or resubmittal; if a resubmittal, the date of the previous submittal. 17. Contract Documents for Construction. Each prime contractor will be issued sets of plans and specifications for construction as follows: General Construction Contractor - 15 complete sets Mechanical Contractor - 9 complete sets Electrical Contractor - 6 complete sets Movable Partition Contractor - 4 complete sets Elevator Contractor - 4 complete sets If Contractor requires more than the designated quantity to be furnished, he may request additional quantities from the Architect -Engineer, and will be charged for same at standard rates for reproduction. SC -5 0 18. Referenced AIA General Conditions of the Contract - Indemnification. Subparagraph 4.18.3 is hereby revised to read as follows: "4.18.3 The obligations of the Contractor under this Paragraph 4.18 shall not extend to the liability of the Architect, his agents or employees arising out of (1) the preparation or approval of maps, drawings, opinions, reports, surveys, Change Orders, designs or specifications, or (2) the giving of or the failure to give directions or instructions by the Architect, his agents or employees provided such giving or failure to give is the primary cause of the injury or damage." 19. Stated Allowances. Contractor shall include in his Proposal price cash allowances stated in Proposal and in Technical Provisions. Contractor shall purchase "Allowed Materials" as directed by the Owner and Architect on basis of lowest and best bid of competitive bids. If actual price for purchasing "Allowed Materials" is more or less than stated "Cash Allowance", contract price shall be adjusted accordingly. Adjustment in contract price shall be made on the basis of the purchase price without additional charge for overhead, profit, insurance or any other incidental expenses. Cost of installation of "Allowed Materials" shall be included in applicable Sections of contract specifications covering this work. SC -6 LABOR STANDARDS WAGE RATES (a) There shall be paid each laborer or mechanic of the Contractor or subcontractor engaged in work on the project under this contract in the trade or occupation listed in the Schedule of Occupational Classifications and Minimum Hourly Wage Rates starting on Page LS -8, not less than the hourly wage rate established by the L.S. Secretary of Labor as shown opposite the same, regardless of any contractual relationship which may be alleged to exist between the Contractor or any subcontractor and such laborers and mechanics. (b) Any wage determinations required by State law are also listed in the Schedule starting on Page LS -8; and.in the case of any difference between them and the determinations of the U.S. Secretary of Labor as to the minimum rates fixed for any trade or occupation, the higher rate shall be the appli- cable minimum for such trade or occupation. (c) If, after the award of the contract, it becomes necessary to employ any person in a trade or occupation not classified in the wage determinations, such person shall be paid at not less than such rate as shall be determined by the officials mentioned above. A report of the action taken shall be sent by the official to the Secretary of Labor. Such approved minimum wage shall be retroactive to the time of the initial employment of such person in such trade or occupation. The Contractor shall notify the Owner of his intention to employ persons in trades or occupations not classified in sufficient time for the Owner to obtain approved rates for such trades or occupations. In the event the officials cannot agree on the proper classi- fication or minimum rate to be paid, the question accompanied by the recommendation of.the officials shall be referred to the Secretary of Labor for final determination. . (d) The specified wage rates are minimum rates only, and the Owner will not consider any claims for additional compensation made by.the Contractor because of payment by the Contractor of any wage rate in excess of the applicable.rate contained in this contract. All disputes, in regard to the payment of wages in excess of those specified in this contract shall be adjusted by the Contractor. (e) Except as may be otherwise required by law, all. claims and disputes pertaining to the classification of labor employed on the project under this contract shall be decided by the Owner's governing body or other duly designated official. LS -1 APPRENTICES Apprentices shall be permitted to work only under a bona fide apprenticeship program registered with a State Apprenticeship Council which is recognized by the Federal Committee on Apprenticeship, U.S. Department of Labor; or if no such Council exists in a State, under a program registered with the Bureau of Apprenticeship, U.S. Department of Labor. The allowable ratio of apprentices to journeymen in any classification shall not be greater than the ratio permitted to the Contractor as to his entire work force under the registered programs. Any employee listed on a payroll at an apprentice wage rate, who is not registered as above, shall be paid the wage rate determined by the Secretary of Labor for the classification of work he actually performed. The Contractor or subcontractor will furnish to the Owner written evidence of the registration of his program and apprentices as well as of the appropriate ratio and wage rates, for the area of con- struction prior to using any apprentices on the contract work. (29 CFR 5.5(a) (4)) OVERTIME COMPENSATION This contract is subject to the applicable provisions of the Contract Work Hours Standards Act, Public Law 87-581, 87th Congress. (a) Overtime Requirements. No Contractor or subcontractor contracting for any part of the contract work shall require or permit any laborer or mechanic to be employed on such work in excess of eight hours in any calendar day or in excess of forty hours in any workweek unless such laborer or mechanic receives compensation at a rate not less than one and one-half times his basic rate of pay for all hours worked in excess of eight hours in any calendar day or in excess of forty hours in such workweek, as the case may be. ('b) Violations: Liability for Unpaid Wages: Liquidated Damages.. In the event of any violation of the clause set forth in paragraph (a), the Contractor and any subcontractor responsible therefore shall be liable to any affected employees for his unpaid wages. In addition, such Contractor or subcontractor shall be liable to the United States (in the case of work done under contract for the District of Columbia or a territory to such District or to such territory), for liquidated damages. .Such liquidated damages shall be computed, with respect to each individual laborer or mechanic employed in violation of the clause (a), in the sum of $10 for each calendar day on which such employee was required or permitted to work in excess of eight hours or•.in excess of forty hours in a workweek without payment of the overtime wages required by the clause (a). LS -"2 (c) Withholding for Unpaid Wages and Liquidated Damages. The State library administrative agency which has provided financial assistance for this contract may withhold, or cause to be withheld, from any monies payable on account of work performed by the Contractor or subcontractor, the full amount of wages required by the contract and such sums as may administratively be determined to be necessary to satisfy any liabilities of such Contractor or subcontractor for liqui- dated damages as provided in clause (b). (d) Insertion of Clauses in Subcontracts. The Contractor agrees to insert the foregoing clauses (a), (b), and (c), this clause (d), and the following three paragraphs in all sub- contracts. Employees Covered, Except as otherwise expressly provided in the Act,!/the provisions of the Act shall apply to all laborers and mechanics, including watchmen and guards, employed by any Contractor or subcontractor in the performance of any part of the work contemplated by any such contract. , Regulations. The Regulations issued by the U.S. Department of Labor with respect to the Act (and incorporated by reference in the Regulations issued by the U.S. Department of Health, Education, and Welfare with respect to the Library Services and Construction Act, Public Law 597, 84th Congress, as amended) shall apply to this contract. Penalty. Any contractor or subcontractor whose duty it shall be to employ, direct, or control any laborer or mechanic employed in the performance of any work contemplated by this contract who shall intentionally violate any provision of this Act, shall be deemed guilty of a misdemeanor and for each and every such offense shall upon conviction, be punished by a fine not to exceed $1,000 or by imprisonment for not more than six months, or by both such fine and imprisonment, in the discretion of the court having jurisdiction thereof. - POSTING MINIMUM WAGE RATES The Contractor shall post at appropriate conspicuous points at the site of the project a schedule showing all determined minimum wage rates fdr the various classes of laborers and mechanics to be engaged in work on the project under this contract and all deductions, if any, required by law to be made from unpaid wages actually earned by the laborers and mechanics so engaged. l/ "Act" as used in this and the following two paragraphs refers to the Contract Work Hours Standards Act, Public Law 86-581, 87th Congress. LS -3 PAYMENT OF EMPLOYEES The Contractor and each of .his subcontractors shall pay each of his employees engaged in work on the project under this contract in full (less deductions made mandatory by law) in cash and not less often than once each week less legally required deductions and also deductions made pursuant to the regu- lations prescribed under the so-called "Anti -Kickback Statute" (48 Stat. 848; 18 U.S.C. 974; 40 U.S.C. 276c); Provided, that when circumstances render payment in cash infeasible or impracticable, payment by check may be effected upon consideration that funds are made available in a local bank and checks may be cashed without charge, trade requirements, or inconvenience to the worker. "ANTI -KICKBACK STATUTE" AND REGULATIONS • The Contractor and each of his subcontractors shall comply with the following statutes (and with regulations issued pursuant thereto, which are incorporated herein by reference (29 CFR Part 3)) Title 18 U.S.C., Section 874 11874. Kickback from public works employees. --Whoever, by force, intimi- dation, or threat of procuring dismissal from employment or by any other manner whatsoever induces any person employed in the construction, prosecu- tion, completion or repair of any public building, public work, or building or work financed in whole or in part by loans and grants from the United States, to give up any part of the compensation to which he is entitled under his contract of employment, shall be fined not more than $5,000 or imprisoned not more than five years, or both.'.' Title 40 U.S.C., Section 276c: "276c. Regulations governing Contractors and Subcontractors. --The Secretary of Labor shall make reasonable regulations for Contractors and Subcontractors engaged in the construction, prosecution, completion or repair of public buildings, public works or buildings or works financed in whole or in part by loans or grants from the United States, including a provision that each Contractor and Subcontractor shall furnish weekly a statement with respect to the wages paid each employee during the preceding week." Section 1001 of Title 18 shall apply to such statements. WAGE UNDERPAYMENTS AND ADJUSTMENTS The Contractor agrees that, in case of underpayment of wages to any worker on the project under this contract by the Contractor or any subcontractor, the Owner shall withhold from the Contractor out of payments due, dh amount sufficient to pay such worker the difference between the wages required to be paid under this contract and the wages actually paid such worker for the total number of hours worked and that the Owner may disburse such amount so withheld by it for and on account of the Contractor to the employee to whom such amount is due. The Contractor further agrees that the amount to be withheld pursuant to this paragraph may be in addition to the percentages to be retained by the Owner pursuant to other provisions of this contract. LS -4 CONTRACTORS' AND SUBCONTRACTORS' PAYROLLS (a) The Contractor and each of his subcontractors shall prepare his payrolls. on forms prescribed and in accordance with instructions to be furnished by the Owner. Within seven (7) days after the regular payment date of the payroll, the Contractor shall deliver to the Owner a certified legible copy or copies of each such payroll. Each such payroll shall contain the state- ment required by the Federal Regulations issued pursuant to the "Anti - Kickback Statute", which are incorporated herein by reference. (b) The Contractor shall not carry on his payrolls any person not employed by him. The Contractor shall not carry on his payrolls employees of a sub- contractor but such employees must be carried only on the payrolls of the employing subcontractors. (c) Each Contractor or subcontractor shall preserve his weekly payroll records for a period of three (3) years from the date of completion of the contract. The payroll records shall set out accurately and completely the name and address, correct occupational classification, and hourly wage rate of each employee, hours worked by him during the payroll period, and full weekly wages, and the deductions made from such weekly wages, and the actual weekly wages paid to him. Each Contractor or subcontractor shall make such payroll records available at all times for inspection by the Owner or his authorized representatives, and by authorized representatives of the State library administrative agency, the U.S. Office of Education and the Depart- ment of Labor. Each Contractor or subcontractor will permit such representa- tives to interview employees during working hours on the.job. NONDISCRIMINATION CLAUSE During the performance of this contract, the Contractor agrees: (1) The Contractor will not discriminate against any employee or applicant for employment because of race, creed, color, or national origin. This section covers the variations in work to be included in the Alternate Proposals. The general outline of principal features contained herein does not in any way limit the responsibility of the Contractor to perform all work and furnish all plant, labor and materials required by the specifications and drawings to achieve the intended com- pletion of all work under the respective Base Proposal and accepted Alternate Proposal(s). • 2. General Construction Work. a. Alternate No. G-1, Under this alternate proposal, Bidders shall quote the difference in cost for furnishing and installing granite fascia and trimband as furnished by granite producers other than the Cold Spring Granite Company. Alternate granites shall be equal in quality and colors to the Cold Spring granite included in the Base Proposal. (See Section 4) b. Alternate No. G-2. Under this alternate proposal, Bidders shall quote the difference in cost for furnishing and installing fixed windows and single hung windows on first and second floors as made by manufacturers other than Alenco Aluminum Products and reversible windows on third floor as made by manufacturers other than Hopes Windows, Inc. Alternate window walls and windows shall be equal in quality to the Alenco Hopes windows included in the Base Proposal. (See Section 8) C. Alternate No. G-3. Under this alternate proposal, Bidders shall quote the total amount to be added to the Base Proposal for constructing fixed partitions on first and second floors at all locations shown for Movable Partitions to be bid by Others under Part IV - Movable Partition Work. Fixed partitions shall be constructed with 3 -1/4 -inch trussed steel studs spaced 16 -inches on center anchored at top and bottom to concrete structure, with metal lath and 3/4 -inch plaster both sides. Plaster shall be placed from floor to 1 -1/2 -inches minimum above top of ceiling and shall • be painted as specified for other similar plaster work. A slightly recessed 4 -inch vinyl cove base shall be installed at base of partitions as shown on Detail "A" Sheet 16 of Drawings. Partitions shall be complete with hollow metal frames, 1/4 -inch polished plate glass, 1 -3/4 -inch walnut veneer solid core wood door of style and sizes as shown for movable partitions. Glazed hollow metal panels shall be furnished for all locations as shown for glazed panels in movable partitions. Hollow metal frames shall be similar and equal to those shown and specified for similar partition con- struction to be included in Base proposals. Additional hollow metal frames shall be furnished and installed at borrowed light locations. The amount of $8,500 shall be included in the alternate proposal price as the stated allowance for "Finish Hardware" for these alternate partitions. d. Alternate No. G-4. Under the alternate proposal, Bidders shall state the net difference in price to be added to or deducted from Base Proposal amount for omission of all granite facing material and substituting limestone and marble facing material in lieu thereof as follows: Construct building fascia and bridge railing facing panels of 2 -inch thick limestone and trim band just below fascia of 7/8 -inch thick marble. Construct spandrels of 3 -inch thick limestone and sills of first and second floor windows and head of first floor windows to be limestone of sizes and shapes shown. 7/8 -inch thick marble shall be applied on columns and all other interior locations scheduled for granite. In general, lime- stone shall be substituted for all exterior locations where "granite" is indicated and marble shall be substituted for all interior locations where • granite is indicated and at all exterior locations where "dark granite" is indicated. All dimensions as indicated on drawings except thickness of facing materials shall be adhered to and all facing materials shall be securely anchored in accordance with shop and setting drawings fur- nished by stone or marble producer using not less than number and type of anchors as required by the Uniform Building Code. e. Alternate No. G-5. Under this alternate proposal, Bidders shall quote a lump sum amount to be deducted from Base Proposal amount for omission of construction of the concrete service drive along north side of building within construction limits shown on Sheet ME -1 and as detailed on Sheet S-10 of the Drawings including all combined concrete curb and gutters and concrete pavement. f. Alternate No. G-6. Under this alternate proposal, Bidders shall quote a lump sum amount to be deducted from Base Proposal amount for omission of construction of concrete walks along north side of building within con- struction limits shown on Sheet ME -1 and as detailed on Sheet S-10 of the Drawings. E. Alternate No. G-7. Under this alternate proposal, Bidders shall quote a lump sum amount to be deducted from Base Proposal amount for omission of construction of retaining wall complete with guardrail and foundation drain line from points of connection with equipment locker to east and west ends of retaining wall as shown within construction limits shown on Sheet ME -1 • and as detailed on Sheets 6 and S-10 of the Drawings. Equipment locker in- cluding gates shall be constructed as shown and if this alternate is accepted dowels shall be installed horizontally projecting on each side of equipment locker for future connection to retaining wall. h. Alternate No. G-8. Under this alternate proposal, Bidders shall quote a lump sum amount to be deducted from Base Proposal amount for omission of construction of 18 -inch storm drain line and drainage structures including the drainage inlet complete with frame and grates and the storm drain manhole under service drive along north side of building within construction limits as shown on Sheet ME -1 and as detailed on Sheet S-10 of the Drawings. FIM • 3. Mechanical Work. No Alternates. 4, Electrical Work a. Alternate No. E-1, Under this alternate proposal, Bidders shall quote a lump sum amount to be deducted from Base Proposal amount if conduits, con- ductors, switches and outlets are to be installed in open top steel stud, metal lath and plaster partitions in lieu of in movable metal partitions at all indi- cated locations on first and second floors, 5. Movable Partition Work. No alternates. 6. Elevator Work. No alternates. 1-3 SECTION 2 - EXCAVATION, FILLING AND BACKFILLING 1. General. The work to be done under this section consists of excavating for basement floor, foundation drain lines, foundations and footings to the lines and grades shown on the drawings; installa- tion of foundation drain lines and placing of drainage fill; backfilling to existing ground surface or to a minimum depth of 30 -inches above top of footings, whichever provides greater cover, outside the building; backfilling to bottom of base course within the building; construction of conpacted fills to elevations shown, and stockpiling all excavated material that is suitable for use in final grading in locations on the . Civic Center Area as directed by the Architect -Engineer. Final grading will be done by Others under a separate contract. 2. Site Preparation. a, Work by Others. Existing buildings, slabs, walks, trees, shrubs, fences and similar or related items will be removed and disposed of by the Urban Renewal Agency of Salina, Kansas, prior to start of construction under this contract. Basements, wells and cisterns will be removed to three feet below the existing ground surface and filled to the existing ground surface by the Urban Renewal Agency. The area of new construction will be graded to the existing ground surface by the Urban Renewal Agency. Eighth Street paving will be removed by the City of Salina. Underground utility mains will be disconnected and abandoned in place, and aboveground utility poles and lines will be removed, by the City of Salina or the re- spective utility company. b. Work by Contractor. The Contractor shall strip or burn all grass and weed growths within the limits of the building, and shall remove all existing foundations, utility mains, service lines and similar items en- countered in new construction to at least 12 inches below limits of new construction. The Contractor shall remove all debris and waste resulting from his operations and shall dispose of them outside the Civic Center Area at locations secured by the Contractor at no additional cost to the Owner. No foreign material such as weeds, grass or debris shall be covered • by structures or slabs, or incorporated in fills or backfills. 3. Barricades and Warning Signs. During performance of excavation and backfill and during construction, the Contractor shall furnish and install at appropriate locations adequate barricades, warning signs, lights and flares to protect the general public and workmen. 4. Subsurface Investigations. Information concerning physical conditions at test hole locations is from logs of drill holes. While the borings are representative of subsurface conditions at their respective locations and for their respective vertical reaches, local minor variations characteristic of the subsurface materials of this region may be anticipated. 2-1
