Your 2008 DCP Contract has been approved. However, Section 1101 of the Food, Conservation, and Energy Act of 2008 provides that payments are not authorized to producers on a farm having 10 or less base acres of covered commodities and peanuts. My review shows that this enrolled farm has 10 or less base acres of covered commodities and peanuts. Accordingly, DCP payments will not be issued to producers on this farm. If you believe I have not properly reviewed this farm's records in determining that the farm has 10 or less base acres of covered commodities and peanuts, you may appeal this determination to the county committee by filing a written request no later than 30 days after you receive this notice in accordance with the FSA appeal procedures found at 7 CFR Part 780. If you appeal to the county committee, you have the right to an informal hearing which you or your representative may attend either personally or by telephone. If you appeal this determination to the county committee, you may later appeal any adverse determination of the county committee to the FSA State Conunittee or the National Appeals Division. We periodically receive documents from the Farm Service Agency that need to be executed on behalf of the City for each of these properties. Parcel # 1: Located east of the river and north of Magnolia. This parcel is adjacent to the Elks Club, and is leased to Arnold Tillberg. The FSA designates this as Farm # 311, in the name of Arnold Tillberg. It is approximately 11 acres in size. Tillberg pays us $70 per year for cropland. Parcel # 2: Located on the west side of the river channel, but east of the levee, immediately north of Iron Avenue. This is designated as FSA Farm # 1108, in the name of the City of Salina and is about 9? acres in size. David Abbott has been given permission to use this parcel for haying according to the list maintained at General Services, however, we do not have a formal lease on this property. Mr. Abbot does have leases on two other parcels, totaling 31 acres for a grand total of $15 per year. The most recent lease we have of record for the subject property is to Don Mattison. The Mattison lease was terminated in 1995. Parcel # 3: Located at the City landfill, and leased to Dennis Swenson. The FSA designates this as Farm # 1225, under the name of Dennis Swenson. Our agreement with Swenson provides that Swenson is to pay us 40% of crop proceeds and government payments less 40% of the cost of fertilizers and hervicides used. You had written the Farm Service Agency in December 2002, authorizing Don Hoff to sign on behalf of the Swenson Lease at the landfill. (Copy attached). The FSA is asking for a similar letter on the other two parcels. This year, Shawn O'Leary signed for the Tillberg property, I signed for the City of Salina property, and Don Hoff signed for the Swenson Lease. If you want only Shawn and Don to be the designated signatories, which makes sense —these properties are all flood or landfill properties, we can recall the one I signed and re -sign it. Finally, we should probably get a written lease executed with Mr. Abbot to formally authorize use of the property and provide for indemnification. Those provisions require all Highly Erodible Land (HEL) fields to have a conservation plan developed and approved by the SALINE COUNTY CONSERVATION DISTRICT by 1990 in order to remain eligible for USDA Farm Programs. Any conservation work called for in the plan must, be completed by 1995. The enclosed information represents the first step in that program. It indicates those fields which are designated as HEL (Highly Erodible Land). The fields on the photos are marked either HEL or N (Non Highly Erodible). Fields are designated either HEL or N regardless of whether the conservation work is already completed or not. IF the conservation work has already been completed, then, the work must be reviewed and the .plan updated and certified by the SALINE COUNTY CONSERVATION DISTRICT. If the field is designated as HEL and has NO previous conservation plan, then a new plan must be developed by 1990.
