REGULAR MEETING OF THE BOARD OF COMMISSIONERS

The Regular Meeting of the Board of Commissioners met in the Commission
Meeting Room, City -County Building, on Monday, July 17, 1995, at 4:00 p.m.
There were present:

AWARDS - PROCLAMATIONS
PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME

CONSENT AGENDA
(6.1) Approve the Minutes of the Regular Meeting of July 10, 1995.
Moved by Commissioner Brungardt, seconded by Commissioner
Seaton, to approve all items on the consent agenda. Aye: (4) . Nay: (0) .

DEVELOPMENT BUSINESS
ADMINISTRATION
(8.1) Second Reading Ordinance Number 95-9696 providing for the vacation
of part of the public utility easements in Lots 1 and 2, Block 1 and Lots 1
through 3, Block 2 in the Grain Belt Subdivision.
Judy Long, City Clerk, explained this is a second reading.
Shawn O'Leary, Assistant Director of Engineering and Utilities,
explained that all the conditions of the ordinance have been met.
Moved by Commissioner Seaton, seconded by Commissioner
Brungardt, to approve Ordinance Number 95-9696 on second reading. Aye:
(4), Perney, Brungardt, Seaton, Maxwell. Nay: (0). Motion carried.
(8.2) Second Reading Ordinance Number 95-9697 granting DS&O Rural
Electric Cooperative Association, Inc. an electric franchise.
John O'Leary, Attorney, was present representing DS&O.
Jerry Rumbaugh, General Manager for DS&O, spoke in favor of the
ordinance. He mentioned other areas that had dual franchises. Services and
rates were explained. Mr. Rumbaugh stated that DS&O rates are higher than
KPL's but are lower than those in Topeka and other areas. He was confident
that DS&O can carry the service load and explained that DS&O shuts off service

in order to conserve energy. He explained how DS&O customers receive
refunds every other year of about $30.00 per household.
Dennis Kissinger, City Manager, and Roy Dudark, Director of
Planning and Community Development discussed initial investment costs and
their applicability to this franchise with Mr. Rumbaugh.

95-225 Moved by Commissioner Brungardt to procedurally carry this
ordinance forward by approving the second reading. Seconded by Commissioner
Seaton. Aye: (3) Brungardt, Seaton, Maxwell. Nay: (1) Perney. Motion

(8.3) Resolution Number 95-4891 authorizing and directing the issuance,
sale and delivery of $1,900,000 principal amount of General Obligation Municipal )
Temporary Notes (landfill project), Series, 1995-1.
Bob Biles, Director of Finance and Administration, explained the
temporary note bids were received at 2:00 p.m. today . The low bid was from
Bank IV at 4.23855%.

Brungardt, to adopt Resolution Number 95-4891. Aye: (4) . Nay: (0) .

1 (8.4) Report on bids received for HVAC equipment for the upstairs
meeting rooms at the Bicentennial Center.
Phil Chamoff, Bicentennial Center Director, explained the bids
received and the need for the equipment.

95-227 Moved by Commissioner Brungardt, seconded by Commissioner
Seaton, to award the contract for HVAC equipment to Pestinger Heating and
Air Conditioning in the amount of $28,696. Aye: (4) . Nay: (0) . Motion
carried.

that the Regular Meeting of the Board of Commissioners be adjourned.
