Agr Airport Security AIRPORT AUTHORITY-COUNTY LAW ENFORCEMENT CONTRACT This contract is made and entered into this theLf'-day of ~~003, by and among Saline County, Kansas (the "County"), the Saline County Sheriff s Department (the "Sheriffs Department"); the Salina Airport Authority (the "Authority"), and the City of Salina, Kansas (the "City"). Recitals A. The Authority is a political subdivision of the City of Salina created by City ordinance pursuant to the provisions ofK.S.A. 27-315 and operates the Salina Municipal Airport (the "Airport") and the M.J. Kennedy Air Tenninal (the "Tenninal"). B. The current provider of scheduled airline service to the residents of Saline County and the City of Salina is Air Midwest, Inc., d/b/a US Airways Express. C. On November 5,2002 the Transportation Security Administration (TSA) assumed the responsibility for passenger security screening at the Tenninal. D. The Authority is required by 49 CFR Part 1542 to provide a unifonned law enforcement officer at the TSA's air carrier security checkpoint ("Security Checkpoint") in accordance with a signed memorandum of Agreement between the Authority and the TSA. E. On June 19,2003, the Authority and TSA signed a Memorandum of Agreement, which sets out the general tenus and conditions for law enforcement response to the TSA security checkpoint at the Airport. (See attached Exhibit A). F. The Authority and the County, subject to the approval of the Sheriff, desire to contract for services of the Sheriffs Department in providing unifonned law enforcement officer services at the Tenninal pursuant to K.S.A. 12-2908. G. The parties wish to assure that any Sheriffs Department personnel perfonning the duties of the Sheriffs Department under this agreement are authorized to enforce the ordinances of the City of Salina, as authorized by K.S.A. 12-2907. H. Any reference to "the Sheriff' in this contract shall include the Sheriff of Saline County and the Sheriffs designees, including full or part-time deputies and reserve deputies. NOW, THEREFORE, for the consideration hereinafter set forth and upon the tenus and conditions enumerated, the parties agree as follows: 1. Purpose of Contract. This contract is for the purpose of securing the enforcement of all laws and to provide for a visible law enforcement presence by the Sheriff at all TSA Passenger Screenings at the Security Checkpoint within the Tenninal. 2. Area of Service. The area to be served under this contract shall be primarily the Tenninal; however, the authority of the Sheriff under this contract shall extend to the entire Airport. 3. Duties and Authorization to Enforce City Ordinances. The County, by and through the Sheriff, shall enforce all applicable federal, state, and local laws and regulations while on duty under this contract. The Sheriff is hereby authorized to enforce the ordinances of the City of Salina while on duty under this contract. 4. Scheduling and Levels of Service. (a) The Sheriff shall be present (with a patrol vehicle) at the Security Checkpoint for all TSA Passenger Screenings in accordance with Exhibit A for a period of time commencing no less than fifteen (15) minutes prior to the scheduled flight departure time and continuing until the TSA passenger screening is completed, unless otherwise directed by the Authority in specific cases. Staffing and scheduling of Sheriff's Department personnel necessary to fulfill the responsibilities of the Sheriff's Department under this contract shall be in the sole discretion of the Sheriff. (b) The Authority shall notify the Sheriff of air carrier flight schedules, provide the Sheriff with copies of all TSA security directives and infonnation circulars, and include the Sheriff or other designated officer in all meetings with the TSA. The Authority will notify the Sheriff of any air carrier or charter flight schedule changes as soon as is reasonably possible. Records maintained by the Sheriff shall document the time required on duty under this contract. Perfonnance of these duties is estimated to require approximately five (5) hours per week. (c) The County agrees that court appearances by the Sheriff, although in relation to enforcement actions originating while on duty under this contract, shall not fall within the scope of duties to be perfonned and compensated under this contract. (d) The Sheriff shall attend meetings ofthe Authority's governing body and report on enforcement needs and problems at the request of the governing body when given 24 hours notice. At all other times the Sheriff shall meet with the Authority's Executive Director as needed about enforcement needs and problems. 5. Security Checkpoint Functions: The Sheriff shall be responsiblt: at the Security Checkpoint for the following functions: a. Provide an anned deterrence to criminal activity. b. Respond to situations where an individual is interfering with the activities of the screening checkpoint. c. Take appropriate action if a violation of the law occurs. d. When requested by an on-duty screener, assist in preventing prohibited items ITom entering the sterile area. e. Notify Federal authorities to detennine ifthe case will b(~ handled in the Federal venue. 2 f. Provide for the overall security of the screening checkpoint, screeners and passengers. g. Take control of illegal items that are discovered at the checkpoint, such as fireanns. 6. Compensation. In exchange for the services perfonned by the Sheriff while on duty under this contract, the Authority shall pay to Saline County the sum of $22.50 per hour and pay the premium for the law enforcement liability insurance policy referred to in paragraph 10. The Sheriff will furnish a billing for hours of service (from the 26th day of the month to the 25th day of the month) the last day of the month. 7. Expenses. The County shall not be responsible for any expenses related to the operation of the Security Checkpoint. The County shall provide and maintain all vehicles, fuel, and equipment necessary to carry out the duties assumed under this contract. 8. Payment of Wages and Benefits: Law Enforcement Training: The County shall assume all responsibility for payment of the wages and all other benefits of the Sheriff, including but not limited to, health insurance, workmen's compensation and liability insurance, and no County officer or employee shall have a claim to pension or other rights or benefits granted by the Authority to its employees. The County shall bear all local expenses for training of the Sheriff in confonnance with state law. 9. Complaints and Discipline. Any complaint about the perfonnance of the Sheriff's Department shall be directed to the Sheriff. The Sheriff shall detennine whether the complaint is justified and warrants disciplinary action, including tenninatiol1, transfer or other action involving specific officers. 10. Hold HarmlesslPolice Liability Insurance. The Authority agrees to hold the County and the Sheriff's Department hannless from any claim by the Authority against the County or the Sheriff's Department relating to services provided by the Sheriff's Department under this contract. The Authority also agrees to acquire and maintain a law enforcement liability policy with liability limits of $500,000/$1 ,000,000 (the "Policy") relating to its operation of the Airport, which policy shall name the County and the Sheriff's Department as additional insureds. 11. Records. The Sheriff shall keep reasonably detailed records suftìcient to make periodic reports to the Authority governing body on the fulfillment ofthe Sheriff's responsibilities under this contract. 12. Tenn. This contract shall become effective on August 1,2003; shall be for a primary tenn of the remainder of the current calendar year; and shall renew automatically thereafter for sequential tenus of one calendar year unless notification to the contrary is given by one party to the others no later than the December 1st prior to the subsequent January 1st renewal date. 13. Tennination: This Agreement may be tenninated as otherwise provided in this Agreement or as follows: 3 a. Termination bv Agreement. In the event that the parties all agree in writing, this Agreement may be terminated on the terms and date stipulated therein. b. Termination by Cancellation. This Agreement may be cémceled without cause by any party upon thirty (30) days prior written notice to the other parties. 14. Non-assignable. This contract shall not be assignable by either party. The LEO can depart when the screening process is complete. 2. A LEO will be present at the checkpoint for all charter flight passenger screening, 3.
