We, the undersigned, being residents and property owners in
the City of Salina, Kansas, do hereby petition your honorable body for:
Vacation of North-South alley located in Blocks Three (3) and Four (4) , Elm Grove Addition
to the City of Salina, Saline County, Kansas, together with vacation of extension of said
alley from the North line of Block Three (3) across Ash Street to the South line of Block
Four (4) in Elm Grove Addition (The location of the alley being requested to be vacated is
highlighted on Exhibit A hereto.) See second page

Alley in Elm Grove Addition
Vacation of the above described alley and extension thereof across Ash Street is
requested since said alley has not been used for an extended period of time for public
purposes. The undersigned further are not advised of the existence of any public utilities
within said alleyway.
The undersigned would request that the vacated alley revert to the owners of
adjacent land thereto adjoining on each side in proportion to their respective frontages,
all in accord with K.S.A. 13-443.
For clarification purposes the undersigned, LOJ Enterprises, LLC, is the current
fee title holder of record of Lots Ten (10) through Eighteen (18) inclusive Block Four (4)
and Lots Ten (10) through Seventeen (17), inclusive, Block Five (5), Elm Grove Addition
to the City of Salina, Saline County, Kansas, said property constituting a part of that
property titled in LOJ Enterprises, LLC, and reflected in Certificate of Survey prepared
by Barry J. Hummel recorded in Book 1003, Pages 880 — 881, records of the Register
of Deeds of Saline County, Kansas, and described as follows, to-wit:
A tract of land in the Southwest Quarter (SW/4) of Section Eleven (11), Township
Fourteen (14) South, Range Three (3) West of the Sixth Principal Meridian in
Saline County, Kansas more particularly described as follows:
Beginning at a point 766.25 feet East and 75 feet North of the Southwest corner
of said Section 11;
Thence on an assumed bearing of N00°00'00"E a distance of 833.74 feet to the
southerly right-of-way of the Union Pacific Railroad;
Thence N68°27'30"E along said right-of-way, a distance 35.93 feet to the
southerly right of way of the former Salina Northern Railroad;
Thence S61°42'30"E along said right-of-way, a distance of 3.00 feet;
Thence continuing along said right-of-way, on a curve to the left having a radius
of 717.50 feet, an arc distance of 274.75 feet, said curve having a long chord of
273.07 feet and-a bearing of S72°40'42"E;
Thence S00°00'00"E a distance of 764.20 feet to a point on the North right-of-
way of State Street;
Thence N90 000'00"W along said right-of-way, a distance of 296.75 feet to the
Point of Beginning.
The undersigned Bohm Farm & Ranch, Inc., is purchasing from LOJ Enterprises,
LLC., a portion of the real estate titled in LOJ Enterprises, LLC., and constituting part of
Lot Eighteen (18) and all of lots Ten (10) through (17), Block Five (5), Elm Grove
Addition to the City of Salina, Saline County, Kansas. The specific tract being
purchased by Bohm Farm & Ranch, Inc., from LOJ Enterprises, LLC is described as
follows, to-wit:
A tract of land in the Southwest Quarter (SW/4) of Section Eleven (11), Township
Fourteen (14) South, Range Three (3) West of the Sixth Principal Meridian in
Saline County, Kansas, also being a part of Block Five (5), part of Block (4) and
part of vacated Orange Street, in Elm Grove Addition to the City of Salina, Saline
County, Kansas, described as follows:
Commencing at a point 766.25 feet East and 75.00 feet North of the Southwest
corner of said Section 11;
Thence on assumed bearing of N00°06'01"W, along.the West line of the original
tract described and shown on Certificate of Survey recorded in Book 1003, at
Pages 880 -881, records of the Register of Deeds of Saline County, Kansas, a
distance of 436.10 feet to the point of beginning;
Thence continuing N00°06'01"W, along said West line, a distance of 397.40 feet
to the Southerly right-of-way of the Union Pacific Railroad;
Thence N68°27'30"E along said Southerly right-of-way, a distance 35.93 feet to
the southerly right-of-way of the former Salina Northern Railroad;
Thence S61°42'30"E along said right-of-way, a distance of 3.00 feet;
Thence continuing along said Salina Northern right-of-way, on a curve to the left
having a radius of 717.50 feet, an arc distance of 274.69 feet, said curve having
a long chord of 273.02 feet and a bearing of S72 047'36"E, to the Northeast
corner of the original tract described and surveyed on Certificate of Survey
recorded in Book 1003, at Pages 880— 881 aforesaid records;
Thence S00 005'54"E along the East line of said above original described tract, a
distance of 392.22 feet;
Thence N89 050'35"W, a distance of 296.73 feet to the Point of Beginning.
