Wayne Avenue; George Court; Jodi Court; Lasha Court of the Golden Eagle Estates Addition No. 4; approximately 809 square
yards of concrete drainage ribbon to serve Lots 1-18,Block 1, Lots 1-15, Block 2, and Lots 1-28,Block 3, of the Golden Eagle
Estates Addition No.4, Lots 1-4, Block 6 of the Golden Eagle Estates Addition and Unplatted Tract#1.
Hereby propose that such improvement be made in the manner provided by Article 6a, Chapter 12 of the Kansas Statutes Annotated,as
amended.
(B) The estimate or probable cost of such improvement is:
Five hundred Fifty-Three Thousand Thirty-six dollars and twenty cents($553,036.20)
(C) The extent of the proposed improvement district to be assessed as indicated on the attached plat and is described as follows:

Shall be based upon equal assessments for each equivalent residential unit within the improvement district.
(E) The proposed apportionment of costs between the improvement district and the improvement district and the City-at-large is:
One Hundred percent ( 100 %)to be assessed against the improvement district includes:
The curb, guttering, grading, and paving of Huntington Road, Sherwood Lane Wayne Avenue,Falconview Drive, George
Court,Jodi Court, and Lasha Court(less the west Huntington Road curb and gutter and the Sherwood Drainage Crossing).
Also the installation of approximately 809 square yards of concrete drainage ribbon.
One Hundred percent ( 100 %)to be assessed against the City.-at-large includes:
The construction of the Sherwood Drainage Crossing and approximately 1,312 lineal feet of curb and gutter along the west
side of Huntington Road.
(F) We further propose that such improvement be made without notice and hearing as required by K.S.A. 12-6a04(1)as amended.

Shall be based upon equal assessments for each equivalent residential unit within the improvement district;except that Unplatted Tract
#1 shall be assessed as if it contained six residential units,the assessment having been determined based on the front footage of
Unplatted Tract#1 and the average front footage of the platted lots abutting Wayne Avenue. Cost of particular portions of the
improvements shall be further apportioned as provided in Section E of this Petition.
(E) The proposed apportionment of costs between the improvement district and the improvement district and the City-at-Lage is:
One hundred percent(100%)of the total cost of the improvements to the approximately 125 lineal feet of Huntington Road from
Sherwood Lane to the north property line of Lot 1, Block 6 of the Golden Eagle Estates Addition, including grading, pavement,curb and
guttering and any incidentals necessary to complete the residential street(to be known as"South Huntington Road")shall be assessed
to the following properties within the benefit district: Lots 1-4, Block 6 of the Golden Eagle Estates Addition.
One hundred percent(100%)of the total cost of the improvements to Huntington Road, Sherwood Lane,Wayne Avenue, Falconview
Drive, George Court,Jodi Court,and Lasha Court, including grading, pavement,curb and guttering and any incidentals necessary to
complete the residential street(less the west curb and gutter of Huntington Road,the Sherwood Lane Drainage Crossing,and a portion
of the improvements to Huntington Road referenced above as South Huntington Road)shall be assessed to the following properties
within the benefit district: Lots 1-18, Block 1, Lots 1-15, Block 2, Lots 1-17, Block 3, all in the Golden Eagle Estates Addition No.4; and
Unplatted Tract#1.
One hundred percent(100%)of the total cost of backyard swale/concrete ribbon drainage system shall be assessed to the following
properties within the benefit district: Lots 1-18, Block 1, Lots 1-15, Block 2,and Lots 1-28, Block 3,all in the Golden Eagle Estates
Addition No.4.
One hundred percent(100%)of the total cost of approximately 1,312 lineal feet of curb and gutter along the west side of the part of
Huntington Road to be constructed shall be assessed to the city-at-large.
One hundred percent(100%)of the total cost of the street and drainage improvements to complete Sherwood Lane Drainage Crossing,
including grading, pavement,curb and gutter and all incidentals necessary to complete the residential street crossing shall be assessed
to the city-at-large.

AND
WAIVER OF CERTAIN RIGHTS IN CONNECTION THEREWITH
TO: The Governing Body of the City of Salina,Kansas
1. The undersigned, being the owners of record of all property (the "Property") described in the
petition filed with the City of Salina, Kansas (the "City") on December 8, 2005 (the :'Petition")
and described in Resolution Number 05-6229 adopted by the governing body of the City on
December 12, 2005,regarding the following improvements:
Curb, guttering, grading and paving of: Huntington Road from
Sherwood Lane to Wayne Avenue; Sherwood Lane from Huntington
Road east to Falconview Drive, including construction of the Sherwood
Drainage Crossing; Wayne Avenue to the east lot line of Lot 17,Block 3;
Falconview Drive from its existing terminus north to Wayne Avenue; and
George Court, Jodi Court, and Lasha Court of the Golden Eagle Estates
Addition No.4.
Approximately 809 square yards of concrete drainage ribbon to serve
Lots 1-18, Block 1, Lots 1-15, Block 2, and Lots 1-28, Block 3, of the
Golden Eagle Estates Addition No. 4, Block 6 of the Golden Eagle

(the "Improvements"), hereby request that the estimated or probable cost of the Improvements,
as set forth in the petition and in'Resolution Number 05`6229, be revised as shown on the
attached revised feasibility report(the "Cost"):
2. We hereby acknowledge and agree that the revised estimated or probable cost of the
Improvements is$590,424.53.
3. The proposed apportionment of Costs between the improvement district and the City-at-large
will be the same as set forth in the Petition and Resolution Number 05-6229:
One hundred percent (100%) of the total cost of the improvements to the
approximately 125 lineal feet of Huntington Road from Sherwood Lane to the north
property line of Lot 1, Block 6 of the Golden Eagle Estates Addition, including
grading,pavement, curb and guttering and any incidentals necessary to complete the

drainage system shall be assessed to the following properties within the benefit
district: Lots 1-18,Block 1,Lots 1-15,Block 2, and Lots 1-28,Block 3.
One hundred percent(100%) of the total cost of the approximately 1,312 lineal feet
of curb and gutter along the west side of the portion of Huntington Road to be
constructed shall be assessed to the city-at-large.
One hundred percent (100%) of the total cost of the street and drainage
improvements to complete Sherwood Lane Drainage Crossing, including grading,
pavement, curb and gutter and all incidentals necessary to complete the residential
street crossing shall assessed to the city-at-large.
4. We hereby propose that the improvements be made without notice and hearing and hereby
waive any right to a notice and hearing as provided under K.S.A. 12-6a04. We further waive any
right to protest the inclusion of said property in the improvement district or protest the proposed
assessments under the laws of the State of Kansas, including K.S.A. 12-6a06.
5. We further hereby consent to the amendment of Resolution No. 05-6229 to reflect the revised
cost of the Improvements, and agree to the following:
a) Waiver of formal notice of and the holding of a public hearing by the Governing
Body for the purpose of considering special assessments against the Property;
b) Consent that the City may immediately proceed to issue its general obligation
bonds and/or temporary notes to finance the costs of the Improvements in
accordance with K.S.A. 12-6a01 et seq., in the amounts set forth in the
amendments to Resolution No. 05-6229.
6. I understand that my name may not be withdrawn from this amendment to the petition after
the Governing Body commences consideration of this amendment or later than seven (7) days
after this amendment to the petition has been filed with the City Clerk.
