Olson, City Manager Dean Boyer, City Engineer Fourth Street Improvements - Right-of-Way Ownership Prescott Avenue to Crawford Avenue In checking the land history in the Southwest Quarter (S.W.1/4) of Section Thirteen (13), Township Fourteen (14) South, Range Three (3) West of the Sixth Principal Meridian in Saline County, Kansas, the following information was found: The Original Townsite Plat which included an area bounded on the east by Front Street, on the west by Ninth Street, on the north by North Street and on the south by South Street was filed in 1862. None of the land in the Original Townsite Plat was in the above mentioned quarter, but the south boundary of the Original Townsite Plat, which was South Street, is the north boundary of the above mentioned quarter. The Patent Deed on this quarter is dated 1870 and there is no evidence of any railroad obtaining any right-of-way grants at this time. In 1882, the Salina and Southwestern Railroad purchased a 60-foot right-of-way along the east line of the above mentioned quarter, which we know as Fourth Street, from Prescott Avenue south to the south line of the above mentioned quarter or Crawford Avenue. This purchase indicated that no right-of-way in this quarter was granted to the railroad. In 1883, Beebe's Second Addition to the City of Salina was filed for record. This is the area from Prescott Avenue north to Center Street. The plat shows Fourth Street platted full width with no railroad shown. Other plats in this area from Prescott Avenue north to South Street are similar to Beebe's and we could find no evidence of railroad right-of-way being granted or purchased in this area. In summary, Larry Bengtson's explanation appears to be correct in stating that; from Prescott Avenue to the north, the Salina and Southwestern Railroad owned no right-of-way and occupied the street right-of-way with the permission of the City. From Prescott Avenue to the south, the Salina and Southwestern Railroad purchased right-of-way prior to the property being incorporated into the City, so the City now occupies the railroad right-of-way with the railroads permission. Olson, City Manager FROM: Dean Boyer, City Engineer SUBJECT: Fourth Street Improvements Project Cost Estimates Right of way - The following reflects the probable cost of the East 20 feet of the 20 lots which face Fifth Street between Prescott and Crawford. It does not reflect any cost for the two houses facing Prescott on the West side of Fourth Street. The single lane of pave- ment could be paved without buying right of way from these two lots. Also, these two lots are in the N.D.P. project~ for the downtown area and could be obtained at the time this project was initiated. 20 lots @ $1,500.00 = $30,000. O0 Construction - The following reflects the probable cost of constructing a single lane of pavement with open drainage on the West side of the railroad tracks from Prescott to Crawford.
