KNOW ALL MEN BY THESE PRESENTS, that this 15th day of November, 2002, THE
CITY OF SALINA, KANSAS, a municipal corporation, hereinafter referred to as GRANTOR,
for an in consideration of the sum of Ten Dollars ($10.00) cash in hand paid by GARY D. RAY,
Trustee of the Revocable Inter Vivos Trust of GARY D. RAY, dated December 1, 1980,
hereinafter referred to as GRANTEE, and other good and valuable consideration, the receipt and
sufficiency of which are hereby acknowledged, has granted, sold, conveyed, assigned and
delivered, and by these presents does hereby grant, sell, convey, assign and deliver unto said
GRANTEE, GRANTOR'S 1/16th royalty interest, as more particularly set forth in Section 2(b)
of the Addendum of Oil and Gas Lease, dated July 1, 2002, in and to the existing oil and gas
lease dated January 22, 1963, (the "Lease") or extension thereof, covering the following
described real estate located in Saline County, Kansas:
The West 40 Acres of the East Half of the Northwest Quarter (E/2 NW/4) of Section
Twenty (20), Township Fourteen (14) South, Range Two (2) West of the 6th P.M.
It is understood and agreed that this conveyance covers and includes said 1/16th interest in and to
all oil royalties due to be paid under the terms of the Lease, or extension thereof, insofar as it
covers the real estate above described.
TO HAVE AND TO HOLD the above described property, together will all and singular
the rights and appurtenances thereto in any wise belonging unto the said GRANTEE herein, its
respective successors and assigns.
IT IS FURTHER UNDERSTOOD and agreed that GRANTOR retains a 1/16th interest
royalty interest under the Lease,
GRANTEE agrees that it will not unreasonably withhold its consent to lease or
exploration of the above described property.
Pursuant to K.S.A. 79-1437e a real estate validation questionnaire is not required due to
exception no. 6.
