CALD~,IELL BOARD OF CITY COMMISSIONERS CITY OF SALINA Re: Alley first west of Santa Fe Avenue between Republic Avenue and Beloit Avenue Gentlemen and Mrs. Cooper: Attached please find the past history of pe'titions and the action taken by the City Commissioners on above alley. There is no indication in the records that th, is alley has ever been closed or vacated. The Kansas Power and Light Company, Southwestern Bell Telephone Company and Salina Cable TV System, Inc. are occupying this alley under their franchise agreements at the present time. It appears that Lots l, 3, 9 and ll'are using this alley for entrance into their garages. Lots 5 and 7 enter from Santa Fe Avenue through a ten foot (10') curb cut that used to be an east-west alley. There are no other curb cuts on Santa Fe Avenue; Mr. Bassett called the owners who reside adjacent to the above alley' and explained to them that garages built backing on this alley .were a violation; and that this topic was discussed at the last City Commission meeting. They were advsied that i.f the alley was vacated, one-half would be their property and one-half would go to the school. The opinions of these residents are as follows: Mr. and Mrs. John Warders - Lot 1 - 1000 South Santa Fe Avenue .- The owner of Lot l, Hr. Warders, resides in Manhattan, Kansas. The renter of this propertY was contacted and he advised that the owner did not want the alley vacated. Gentlemen and rqrs. Cooper Page 2 December 10, 1971 Mr. Richard Bennett - Lot 3 - 1002 South Santa Fe Avenue Mr. Bennett stated that the alley is used to gain access to his garage and rear parking. Mr. John D. Goben - Lot 5 - 1006 SoHth Santa Fe Avenue Mr. Goben said that even though he signed the petition, h'e did not want to move his building. He did not realize that the alley would be divided between the resiclents and the school. If the alley is not going to be vacated, Mr. Goben would like to have it open for traffic so he would not have to place his garbage cans on Santa Fe Avenue. Mr. and Mrs. Gale German - Lot 7 - lOl2 South Santa Fe Avenue Mr. and Mrs. German stated that as they did not use this alley, its vacation wouldn't affect them but they did not want to move their garage. Mr. Allen Archer - Lot 9 - lO14 South Santa Fe Avenue Mr. Allen Archer lives at 622 Highland and owns the above property. 'tie advised that he does not want the alley closed because it is used to reach the garage on the property. A motion was made by Commissioner Casebeer, seconded by Commissioner Stark to refer the petition to the City Manager to be checked and for a reporl- bac.k next week. Ayes: (5). Nays: (0). Carried. Commissioners'~ Room Salina, Kansas August 5, 1968 The City M~nager reported on Petition Number 3011, for the vacation of the north and south alley first west of Santa Fe Avenue, be-iween Republic and Beloit. After considerable discussion, a motion was made by Commissioner Casebeer, seconded by Commissioner Waddell to table the petition for further study, until the meeting of August 19, 1968. Ayes: (5). Nays: (0). Mo~ion carried, Commissioners~ Room Salina, Kansas August 12, 1968 Petition Number 3012 was filed by Mrs. J. D. Goben, for the vacation of the north and south alley first west of Santa Fe Avenue, between Reputlic and Beloit. A motion was made by Commissioner Stark, seconded by Commissioner Waddell to refer the petition to the City Manager to be checked, and for a neport on August 19, 1968. Ayes: (5). Nays: (0). Motion carried, Commissioners~ Room, Salina, Kansas August 19, 1968 The City Commissioners reconsidered Petitions 3011 and 3012 for the vacation of the north and south alley first west of Santa Fe Avenue, between Republic and Beloit. A motion was made by Commissioner Rundquist, seconded by Commissioner Waddell that no action be taken on these petitions. Ayes: Yost, Rundquist, Stark, Waddell (4). Nays: Casebeer (1). Motion carried.
