(Approximately 905 North 8th Street) At their May ]8, ]982 meeting, the City P]annin9 Commission conducted a public hearin9 on Application #Z82-3. After hearing all of the testimony presented, the City Planning Commission, by a unanimous vote (6-0), approved a motion recommending that this app]ica- tion be approved, based upon the following findings of fact: ]. The application is consistent with the intent and purpose of the zoning ordinance (Section 36-]0]). 2. The permitted uses in the "C-5" district are compatible with other permitted uses on property in the vicinity. 3. Adequate public utilities exist to serve the request area. 4. No errors in the application of the Zoning regulations are known to have occurred. 5. This application is not the result of changed or changing conditions in the area. instead, it is made necessary by the applicant's desire to expand his present business. if you approve the attached ordinance for First Readin9 today, Second Reading would be schedule for June ]4, ]982. The Saline County Treasurer certifies that there are no delinquent property taxes on this property. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain land therein, hereinafter described has been timely complied with, and SO NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT "C-5". SERVICE COMMERCIAL DISTRICT. That the Zoning District Map of the City of Salina, Kansas, hereto duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 36 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to-wit: Lot 6, Block 28, Reimold~s Military Replat to the City of Salina, Saline County, Kansas shall become a part of District "C-5". SERVICE COMMERCIAL DISTRICT. That the use of said described property shall be subject to all the conditions, restrictior and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 36 of the Salina Code, with reference to the SERVICE COMMERCIAL DISTRICT. Section 2. This ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
