Kenneth Bieberly, for the vacation o~ the west ten feet (10') of Tenth Street right-of-way adjacent to Lots 4, 6 and 10, Bristol Addition to the City of Salina, Kansas. Tenth Street between Ash Street and Park Street was platted as an eighty foot (80') wide street, having forty feet (40') of right-of-way on each side of the street centerline. Our street classification map indicates Tenth Street to be classified as a local street which requires only thirty feet (30') of right-of-way each side of the street centerline. The petitioner desires to construct an addition to the existing Kansas Department of Human Resources (Job Service Center) building at the north- west corner of Ash Street and Tenth Street. In order to construct the addition as planned, the petitioner is required by current zoning codes to do one of the following: (a) obtain a vacation of thirteen feet (13') of right-of-way on the west side of Tenth Street; (b) obtain a thirteen foot (13') building setback variance from the Board of Zoning Appeals; or (c) a combination of both (a) and (b). Our department would recommend this vacation request be denied. The vacation of public right-of-way adjacent to the proposed downtown develop- ment area would not appear to be prudent at this time. Traffic patterns and parking plans for the proposed downtown improvements have not been finalized and to grant any vacation of public right-of-way in this area would limit the available options for this redevelopment project. We suggest the petitioner file a variance request for thirteen feet (13') with the Board of Zoning Appeals.
