Addition from District "R-2" (Multiple-Family) to District "C-5"
(Service Commercial) (Approximately 928 North Fifth Street) (Referred
back to Planning Commission on May 18, 1981)
At their June 2, 1981 meeting the Planning Commission reconsidered Application
#Z81-6. The applicant (Gene Revels) was present and spoke on behalf of his
application. Two motions were made on this application - one to recommend
approval and one to recommend denial. Both motions ended in a tie vote,
constituting a "Failure to Recommend" from the Planning Commission. Kansas
Statutes 12-708 provides that upon receiving a "Failure to Recommend", the
governing body may take such action as it deems appropriate.
To approve the application the City Commission must pass the attached
Ordinance on first reading. Second reading would then be scheduled for
June 22, 1981. To deny the application the City Commission must simply pass
a motion doing so.

AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE
SAME BEING CHAPTER 36 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN
AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN
THE CITY. AND PRESCRIBING THE PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning
District Map, the rezonlng of certain land therein, hereinafter described has
been timely complied with, and SO NOW, THEREFORE,
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. AMENDMENT. DISTRICT "C-5". SERVICE COMMERCIAL DISTRICT.
That the Zoning District Map of the City of Salina, Kansas, hereto duly adopted
and published as a part of Ordinance Number 8526, the same being Chapter 36 of
the Salina Code, be and it is hereby amended so that the following described
property be rezoned as follows, to-wit:
Lot Fifteen (]5), Block Four (4), EpJscopal Military Institute
Addition to the City of Salina, Saline County, Kansas
shall become a part of District "C-5", SERVICE COMMERCIAL DISTRICT. That the use
of said described property shall be subject to all the conditions, restrictions
and limitations as made and provided for in Ordinance Number 8526, the same being
Chapter 36 of the Salina Code, with reference to the SERVICE COMMERCIAL DISTRICT.
Section 2. This ordinance shall be in full force and effect from and
after its adoption and publlcation once in the official city newspaper.
