Application #Z81-3, filed by Bill Chaffee, requesting rezoning of Lots 1
and 2, Block 10, Shalimar Plaza Addition to the City of Salina from District
"C-1" (Restricted Business) to District "C-2" (Neighborhood Shopping)
(Approximately 2100 South Ohio)
At their April 7, 1981 meeting the Salina City Planning Commission held a public
hearing on Application #Z81-3. Discussion of the case centered around traffic
generation and access to Ohio for the request area. There was some discussion
about the unutilized commercial ground in this area and the overall effect of
its development on the capacity of Ohio Street.
The Planning Commission then passed a motion (4-3) recommending approval of
the application based upon the following findings of fact:
The change in classification, to the best of current data, would
be consistent with the intent and purpose of the zoning ordinance
(Sec. 36-101).
Every permitted use in the proposed "C-2" zone is compatible with
the permitted uses of property in the vicinity.

Adequate public utilities are available in the request area to meet
its anticipated needs.
No errors in the application of the zoning regulations are known to
have occurred.
This amendment is not made necessary due to changing conditions in
the area.
To complete action on this application in accordance with the Planning Commission
recommendation, the City Commission should pass the attached ordinance on 1st
Reading today. Second Reading would then be scheduled for April 27, 1981. The
County Treasurer certifies that there are no delinquent taxes on this property.

AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE
SAME BEING CHAPTER 36 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN
AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN
THE CITY AND PRESCRIBING THE PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning
District Map, the rezoning of certain property therein, hereinafter described
has been timely complied with, and SO NOW, THEREFORE,
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section I. AMENDMENT. DISTRICT "C-2". NEIGHBORHOOD SHOPPING DISTRICT.
That the Zonin9 District Map of the City of Salina, Kansas, hereto duly adopted
and published as a part of Ordinance Number 8526, the same bein9 Chapter 36 of
the Salina Code, be and it is hereby amended so that the following described
property be rezoned as follows, to-wit:
Lots 1 and 2, Block 10, Shalimar Plaza Addition to the
City of Salina, Saline County, Kansas
shall become a part of District "C-2". NEIGHBORHOOD SHOPPING DISTRICT. That
the use of said described property shall be subject to all the conditions,
restrictions and limitations as made and provided for in Ordinance Number 8526,
the same being Chapter 36 of the'Sallna Code, with reference to the NEIGHBORHOOD
SHOPPING DISTRICT.
Section 2. Thls ordinance shall be in full force and effect from and
after its adoption and publication once in the official city newspaper.
