The attached petition requests the vacation of Scanlan Avenue between Schilling
and Jumper Roads. The reason for the request is to permit the construction of
a security station (@20' X 21') adjacent to the west entrance of the main plant
of Tony's Pizza. The plant currently observes no setback as it is constructed
to the property line. Their options to accomplish this objective appear to be:
Request vacation of Scanlan Avenue;
Request vacation of a portion of Scanlan Avenue and then
file for a variance; or
Request specific approval from the City Commission to utilize
street right-of-way for their purpose.
In researching option #1, the Engineering Department made traffic counts on Scanlan
Avenue both north and south of its intersection with Jumper Road. The completed
report is attached, but in summary, it is felt that, at this time, the traffic
load is too great for us to recommend that the street be vacated in its entirety.
Option #2 would require vacation of approximately 45' of the 80' right-of-way
on Scanlan, in order to avoid the necessity of a variance (20' for the addition
and 25' for the required setback). Since this would leave the City with an
inadequate right-of-way remaining we would be back to vacating the entire street
as discussed above. Vacation of a minimum of approximately 20' would be necessary
to keep the structure off of public property. This would, however, require the
filing of a variance application in order to get around the 25' setback required.
Since one stipulation of granting a variance is that the applicant cannot bring
the condition upon himself, it would appear extremely unlikely that a variance
would be approved.

Therefore, Option #3 would appear to offer the best solution to satisfy the needs
of both the City and Tony's. There is precedent for using public land for
private purposes as evidenced by subdivision entrance signs at Bonnie Ridge,
Country Hills and Country Club Heights and also the overhangs and planters
in the downtown area. However, since this request involves a structure, it
is important that a time limit be placed upon it. Tony's has indicated that
the security station is intended to be temporary, so it is recommended that
the resolution authorizing its location, should you desire to do so, limit
its existence to 5 years.
Therefore, in order to accomplish this, it is recommended that the attached
resolut.ion be adopted.

A RESOLUTION GRANTING SChSqtN'S SAT.F.S ENTERPRISES, INC. A TEMPORARY
LICENSE TO CONSTRUCT AND MAINTAIN A SECURITY BUILDING ON A PORTION OF
SCANLAN AVENUE.
WHEREAS, Schwan's Sales Enterprises, Inc. is in the process of
constructing an addition to its manufacturing facilities located in the
Schilling Subdivision to the City of Salin~, Saline County, Kansas, and
it is necessary for security purposes to temporarily construct a security
building on the west side of the existing structure; and,
WHEREAS, after due investigation it has been determined that the
temporary use of the unimproved portion of Scanlan Avenue for a security
building would not in any way cause a hazard or obstruct the use of
Scanlan Avenue; and,
NOW THEREFORE, BE IT RESOLVED by the Governing Body of the City of
Salina, Kansas:
Section 1: That Schwan's Sales Enterprises, Inc. is hereby granted
a license to use a part of the unimproved portion of Scanlan Avenue for
the purpose of constructing a security building approximately 20' x 21'
and to use a part of the unimproved part of Scanlan Avenue for security
purposes.
Section 2: This temporary license permit shall be in full force
and effect for a term of five (5) years from the date of adoption of
this resolution.
Adopted by the Board of Cc~nissioners and signed by the Mayor this
day of March, 1981.

Traffic volume on Scanlan Avenue
Attached is a sketch showing the location of two traffic counters
to record the traffic volume on Scanlan Avenue. These counters were in
place for four days and the figures below are an average of these daily
counts. Counter No. 1 located on Scanlan Avenue, just north of Jumper
Road, recorded an averaoe two-way traffic volume of 976 vehicles per
day. Counter Ho. 2 located on Scanlan Avenue, just south of Jumper
Road, recorded an average two-way traffic volume of 611 vehicles per
day.
It was estimated that 35% to 40% of the traffic volume recorded
on Counter No. 1 was generated by Tony's employees and the remainder
of 60% to 65% is the normal traffic volume generated by the Air
Terminal, K.T.I. Gym and other facilities in the area.
Approximately 95% of the traffic volume recorded on Counter No.
2 is generated by the Air Terminal, K.T.I. Gym and other facilities
in the area. A very small percentage of Tony's employees are using
this section of Scanlan Avenue.
A full scale study of the traffic movements was not made at the
intersection of Scanlan Avenue and Jumper Road. However, during the
time I was there checking the traffic counters, it was observed that
approximately 75% of the traffic approaching this intersection from
the south proceeded straight through the intersection. Approximately
20% of this traffic made right turns onto Jumper Road and 5% made left
turns onto Jumper Road. Approximately 80% of the traffic volume
approaching the intersection from the north made left turns onto Jumper
Road, 15% proceeded straight through and 5% made right turns onto
Jumper Road.
The traffic counts indicate a majority of the traffic on Scanlan
Avenue, south of Jumper Road, is generated during the late afternoon
and evening hours. Seventy percent of the total traffic on this
section of the street occurs between 4:00 P.M. and 9:00 A.M. There is
no doubt that the activities at the K.T.I. Gym are generating much of
this traffic. The Recreation Department reports that there is an average
of 250 to 300 vehicles using the gym parking lot each night.
During the summer months the traffic volume at both the counter
locations will increase, due to usual activities at the baseball diamonds,
south of Tony's

Scanlan Avenue has never been officially classified as an arterial
or collector street. However, Scanlan Avenue runs the full length of the
base area and is protected with stop and yield signs, as if it was a
collector street.
If there are any additional studies needed, please advise.

Reference our telephone conversation, Thursday, 18 December 1980, concerning
the abandoning of Scanlon Road between Nickell Barracks, Kansas National
Guard, and Tony's Pizza Manufacturing at the Smoky Hill complex, Salina,
Kansas.
The closure of the road will not adversely affect the operation of the
Kansas National Guard; in fact, the closure will enhance the security of
both properties.

Gentlemen:
We understand that the Salina Airport Authority, at the request
of Schwan's Sales Enterprises, Inc., has requested the vacation
of Scanlan Avenue between Schilling Road and Jumper Road. The
vacation of the public roadway is upon the condition that easements
will be granted in order for Southwestern Bell Telephone Company to
continue to maintain utility services along the east side of this
right of way.
Based on the above condition, we have no objection to the vacation
of this street.
