PETITION NO. 3803 - filed by Linda Baalman and Gene R..Engberg for the
vacation of the utility easement along the north side of Lot Nineteen
(19), Block Seven (7), Replat of Edgemere Addition to the City of Salina,
Kansas.
The utility companies (Kansas Power & Light Co., Salina Cable Television
Service and Southwestern Bell Telephone Co.) indicate they have no existing
facilities in the above easement and state they have no objection to the
proposed utility easement vacation. This area is being served with City
utilities (water and sanitary sewers) without using this easement.
The petitioners represent 100% of the property owners affected .by this
vacation request. We, therefore, recommend that the utility easement
on the north side of Lot Nineteen (19) be vacated, but we suggest the
scope of this petition be expanded to include the vacation of the entire
utility easement between Lots Nineteen (19) and Twenty (20), Block Seven
(7), Replat of Edgemere Addition.
The legal description for the above utility easement vacation is as follows:
"Beginning at a point on the west line of Lot Nineteen (t9),
Block Seven (7), Replat of Edgemere Addition to the City of
Salina, Kansas, that is five feet (5') south of the north-
west corner of said Lot Nineteen (19); thence east along a
line that is parallel to the north line of said Lot Nineteen
(19) a distance of one hundred five feet (105'); thence north
a distance of ten feet (10'); thence west along a line parallel
to the south line of Lot Twenty (20), said Block Seven (7) a
distance of one hundred five feet (105') to the west line of
said Lot Twenty (20); thence south along the west line of said
Lot Twenty (20) and said Lot Nineteen (19) a distance of ten
feet (10') to the point of beginning.

AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF A CERTAIN
UTILITY EASEMENT IN BLOCK SEVEN OF THE RECORDED PLAT OF THE REPLAT OF EDGEMERE
ADDITION TO THE CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Section 1. That a portion of the east-west utility easement in
Block 7 shown on the recorded plat of the Replat of Edgemere Addition to the
City of Salina, Saline County, Kansas, and more particularly described as
follows:
Beginning at a point on the west line of Lot Nineteen (19), Block
Seven (7), Replat of Edgemere Addition to the City of Salina, Saline
County, Kansas, that is five feet (5') south of the northwest corner
of said Lot Nineteen (19); thence east along a line that is parallel
to the north line of said Lot Nineteen (19) a distance of one hundred
five feet (lOSI); thence north a distance of ten feet (lO'); thence
west along a line parallel to the south line of Lot Twenty (20), said
Block Seven (7) a distance of one hundred five feet (105') to the west
line of said Lot Twenty (20); thence south along the west line of said
Lot Twenty (20) and said Lot Nineteen (19) a distance of ten feet
(10') to the point of beginning
be and the same is hereby vacated.
Section 2. This ordinance shall take effect and be in force from and
after its adoption and publication once in the official city newspaper.
