Nye APPROVED FOR AGENDA: Second Reading Ordinance #81-8834 - Zoning Application #Z80-14 by Leo Eisenberg and Company, requesting rezoning of a tract of land in the Southwest Quarter of Section 19, Township 14 South, Range 3 West. The first reading was on January 19, 1981. The applicant and their attorney, John Mize, has requested that this ordinance be placed on the Commission agenda. The applicant would like this Commission to consider this matter, rather than have it carry to the next Commission, which assumes office April 20, 1981. The City'~ ordinances and regulations require generally that second reading of rezoning ordinances not be considered until the subdivi- sion process is completed. The subdivision process, because of the necessity of preliminary and final platting approval by the Planning Commission and final plat approval by the City Commission and, of course, the necessary technical work, involves from 90 to 100 days. So, therefore, it is liketythis matter would not be considered until the next Commission is seated. If the Commission approves this ordinance, it will not be published nor become effective until the final plat is approved and filed with the Register of Deeds, which is our normal process. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain land therein, hereinafter described has been timely complied with, and SO NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. AMENDMENT, DISTRICT "R-l". SiNGLE-FAMILY RESIDENTIAL DISTRICT. That the Zoning District Map of the City of Salina, Kansas, hereto duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 36 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to-wit: A tract of land in the South half (S/2) of the Southwest Quarter of the Southwest Quarter (SW/4 SW/4) of Section Nineteen (19), Township Fourteen (14) South, Range Two (2) West of the Sixth Principal Meridian in Saline County, Kansas, being more particularly described as follows: Beginning at a point that is forty feet (40') north and seven hundred ninety feet (790.00') east of the southwest corner of said Section Nineteen (19); Thence North Zero degrees fifty-nlne minutes and nine seconds East (N.OO°59=O9"E,) along a llne parallel to the west line of the Southwest Quarter (SW/4) of said Section Nineteen (19) a distance of six hundred thirty-one and ninety-eight hundredths feet (631.98'); Thence South eighty-nine degrees fifty-eight minutes and twenty-four seconds East (S.89°58'24"E.) a distance of three hundred eighty-three and eighty-four hundredths feet (383.84'); Thence South one degree fourteen minutes and forty-nine seconds West (S.OI°14'49"W.) a distance of slx hundred thirty-one and eighty-three hundredths feet (631.83'); Thence South zero degrees zero minutes and zero seconds West (S.OO°OO'OO"W.) a distance of three hundred eighty and ninety-seven hundredths feet (380.97') to the point of beginning. Section 2. AMENDMENT. DISTRICT "C-3". SHOPPING CENTER DISTRICT. That the Zoning District Map of the City of Saline, Kansas, hereto duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 36 of the Saline Code, be and it is hereby amended so that the following described property be rezoned as follows, to-wit: A tract of land in the South half (S/2) of the Southwest Quarter of the Southwest Quarter (SW/4 SW/4) of Section Nineteen (19), Township Fourteen (14) South, Range Two (2) West of the Sixth Principal Meridian in Saline County, Kansas, being more partlcularly described as follows: Beginning at a point that is forty feet (40') north and fifty feet (50') east of the southwest corner of said Section Nineteen (19); Thence North zero degrees fifty-nine minutes and nine seconds East (N.OO°$9'Og"E.) along a line parallel to the west line of the Southwest Quarter (SW/4) of said Section Nineteen a distance of six hundred thirty-two and twenty- nlne hundredths feet (632.29'); Thence South eighty-nine degrees fifty-eight minutes and twenty-four seconds East (S.89°58'24"E.) a distance of seven hundred forty feet (740.00'); Thence South zero degrees fifty-nine minutes and nine seconds West (S.OO°59'Og"W.) a distance of six hundred thirty-one and ninety-eight hundredths feet (631.98'); Thence South ninety degrees zero minutes and zero seconds West (S.90°O0'O0"W.) a distance of seven hundred forty feet (740.00') to the point of beginning. Said tract contains 10.74 acres, more or less. shall become a part of District "C-3". SHOPPING CENTER DISTRICT. That the use of said described property shal! be subject to all the conditions, restrictions and limitations as made and provided for in Grdinance Number 8526, the same being Chapter 36 of the Salina Code, with reference to the SHOPPING CENTER DISTRICT.
