ITEM: Second reading of Ordinance No. 03-10133 levying special assessments for street, drainage and utility improvements for the 2001/2002 special assessment projects. BACKGROUND On March 17,2003, the City Commission received the final breakdown of costs for four (4) separate public improvement projects, including 137 properties which involved special assessment financing. Following a review of the project, the City Commission scheduled a public hearing for April 7, 2003 and instructed the City Clerk to publish a notice of the public hearing and to mail a notice of the public hearing to each property owner in the benefit districts. These projects were constructed in 2001 and 2002. A map of the project locations is attached and below is a summary of the total project costs. The primary issue at this point in the process is not whether the special assessments should be levied against the properties, but rather that the final costs have been properly calculated and distributed. Other key dates in the process are as follow: May 12, 2003 July 7,2003 Publish assessment ordinance; begin pre-payment period and mail final statement to property owners. WHEREAS, the Governing Body ofthe city of Salina, Kansas (the "City") has authorized the following improvements (collectively, the "Improvements") in the City: PROJECT NO. 01-1265 FIFTH & STIMMEL SANITARY SEWER IMPROVEMENTS The installation of sanitary sewer mains and associated sanitary sewer pump station to serve 32 developed tracts ofland in the area of North Fifth Street and Stimmel Road in the northern part of the City of Salina, KS. PROJECT NO. 01-1274 SOUTH MARYMOUNT ROAD STREET IMPROVEMENTS Curbing, guttering, paving, grading, sidewalk and drainage of South Marymount from Crawford Street to Mariposa Drive. PROJECT NO. 02-1327 W ATERMAIN IMPROVEMENTS N.E. QUADRANT - MAGNOLIA & MARKLEY ROADS The installation of watermain and incidentals necessary to provide a public water system to platted and unplatted tracts located northeast of the intersection of Magnolia and Markley Roads in the City of Salina, Kansas. PROJECT NO. 02-1373 TASKER LANE DRAINAGE IMPROVEMENTS Drainage improvements (storm sewer installation) between Lots 7 & 8, Block 1, Tasker Addition to the City of Salina, Kansas; and WHEREAS, pursuant to proceedings regularly had according to law, contracts have been let for the construction of the Improvements and the Improvements are complete. WHEREAS, the Governing Body has determined that the total cost of the Fifth & Stimmel Sanitary Sewer Improvements is $359,481.17 and that $170,000 thereof shall be assessed against the improvement district for such improvements and that the remaining costs shall be paid by the city-at- large; and WHEREAS, the Governing Body has determined that the total cost of the South Marymount Road Street Improvements is $1,222,467.35 and that $423,101.56 thereof shall be assessed against the improvement district for such improvements and that the remaining costs shall be paid by the city-at- large; and WHEREAS, the Governing Body has determined that the total cost of the Watermain Improvements N.E. Quadrant - Magnolia & Markley Roads is $99,570.07 and that $77,335.79 thereof shall be assessed against the improvement district for such improvements and that the remaining costs shall be paid by the city-at-large; and WHEREAS, the Governing Body has determined that the total cost of the Tasker Lane Drainage Improvements is $11,314.36 and that $5,657.18 thereof shall be assessed against the improvement district for such improvements and that the remaining costs shall be paid by the city-at- large; and WHEREAS, the Governing Body has after due notice, met and determined the amount of such special assessments; and WHEREAS, the Governing Body held a public hearing to consider each of the proposed assessments. That the owner of Tract No. 18741 in Project No. 02-1327 has requested a deferral of the special assessments levied on said tract hereunder; said tract qualifies under K.S.A. 12-6,110 et seq. for a deferral of special assessments; and the City hereby grants a deferral of the special assessments levied hereunder on said tract for a period of 15 years or until such property is platted or developed, whichever occurs first. Section 3. Said amounts so levied, apportioned and assessed as aforesaid will be due and collectible in fifteen equal installments, the first becoming due with the taxes levied for the year 2003, and one of said installments falling due each and every year thereafter until all are paid and all to be collected with interest as in this ordinance provided; HOWEVER, that the owner of any piece or parcel of property liable for any such assessments may redeem his property, in whole or in part, from such liability by paying to the City Treasurer the entire amount, or a portion thereof, chargeable against the same, as in this ordinance provided, at any time within thirty days after the first publication of this ordinance and before the issuance of bonds of said City in payment of the balance of the cost of said improvements, and to the extent of any such payment, the property so paid on shall not thereafter be liable for any further assessments for the cost of said improvements, nor for any part of said bonds. Section 4. There is hereby levied further and assessed against such lots and pieces of ground described in this ordinance, interest at such rate per annum as shall be borne by bonds hereinafter to be issued for the payment of the remaining unpaid cost of such improvements to be hereafter determined and fixed by ordinance. Interest on the assessments shall begin to accrue in accordance with Section 2 above. Section 5.
