Application #CP00-2/2A, filed by Millenium Homes, requesting approval of a combined
preliminary/final plat of a 5 acre tract located in the SW 1/4 of Sec. 10, T14S, R3W of the 6th
P.M. in Saline County to be known as the Millenium Addition. The subject property is located
on the north side of West State Street west of the City Animal Shelter.
Information
The applicant operates a manufactured home sales business and wishes to locate a display
lot and construct a sales office for Millenium Manufactured Homes on this 5 acre site which
is just west of the Salina Animal Shelter. The animal shelter site has been annexed as an
island and is actually located within the city limits. This site is part of a larger 48 acre tract
owned by Joan Wilson. The subject property is already zoned IL (Light Industrial) in the
County which permits this type of use, however, Section 2.01.2 of the County's Subdivision
Regulations requires that vacant land be platted prior to being developed with any
commercial or industrial use. Pursuant to the City's Interlocal Agreement with Saline County,
this subdivision plat must be reviewed and approved by both the City and County Planning
Commissions.
Lot Desion
The proposed plat would consist of a single rectangular lot that would be 714 ft. deep and
have 274 ft. of frontage on Old Highway 40. The applicant is proposing to use the front
portion of the lot for manufactured home display and a sales office. A detention pond would
be constructed in the center portion of the lot behind the display area. The rear 1/4 of the
lot would be used for additional manufactured home storage. The County's IL district
regulations do not contain any minimum lot size requirements but do allow buildings to be
constructed within 10 ft. of a front property line. Staff does not know the specific location of
the proposed sales office.
Street Access
Although this lot would have 274 ft. of frontage on Old Highway 40 no direct driveway access
to Old Highway 40 is proposed. The applicant is proposing to create a private road
(Millenium Drive) that would run north from Old Highway 40 and provide access to the
manufactured home sales lot as well as any interior lots that may be platted in the future.

It is staff's understanding that this road would be considered a public access road and be
built to County gravel road standards but would be privately maintained and not maintained
by the County Road and Bridge Department.
Utilities
There are no public utilities in the vicinity and this site is not within a rural water district
service boundary. The applicant's plans are to utilize a well for domestic water and a septic
system for handling wastewater discharge. Fire protection to this site would be provided by
RFD #7 which has a station on N. Old Highway 81. The applicant may wish to consider
applying for a fire contract with the City of Salina for fire protection.
Drainage
The applicant has submitted a drainage study prepared by Central Plains Engineering and
Environmental Consultants. The City Engineering Department has reviewed this report and
is in basic agreement with the calculations and conclusions contained in the study. It is
staff's understanding that the southern and northern portions of the lot would drain to the
center pond and then be pumped via a discharge pipe to the ditch system along Old Highway
40.
The subject property is also located within the mapped 100 year flood plain for Mulberry
Creek due to its elevation. Therefore, the applicant will either need to elevate his proposed
office building to 1 ft. above the Base Flood Elevation of 1230.5 or floodproof the walls to 1
ft. above that elevation.
One of the challenges the applicant faces is finding a way to make the sales office
handicapped accessible while meeting the flood plain elevation requirements. The natural
ground elevation on the proposed building site is 1225 and the lowest floor elevation of the
building would need to be 1231.5. One option for the applicant would be to elevate the
building some but also floodproof the building to 1 ft. above the BFE.
Easements and Dedications
The right-of-way for Old Highway 40 is already established (65 f. from the center line) and
no dedication of additional right-of-way is being proposed. The applicant and the adjoining
property owner to the east, Joan Wilson, are each proposing to dedicate 30 ft. for a private
roadway (Millenium Drive) that would provide access to this 5 acre tract and the remaining
43 acres still owned by Joan Wilson. This 60 ft. strip would be dedicated to Saline County

either as an access easement or easement for roadway purposes but ownership of the
underlying land in this strip would be retained by the adjoining property owners. Because the
County would not be maintaining this roadway and it would be jointly owned and maintained
staff believes some sort of shared maintenance agreement needs to be entered into by the
two owners.
The applicant is proposing to dedicate a 20 ft. utility easement along the west property line
and a 10 ft. easement along the north property line. These easements would most likely be
used by KPL to bring electric power into the site.
A 235 ft. x 110 ft. area in the center of the lot is being set aside as a drainage easement the
applicant is proposing to dedicate a 16 ft. drainage easement along the west side of the
access road to accommodate a ditch that would carry runoff from the south end of the lot
north to the detention pond. The City Engineering Department reports that it believes the
proposed width of this easement (16 ft.) is too narrow to accommodate a ditch that would
meet the City's design criteria of an 8 ft. bottom and 4:1 side slopes. The Engineering
Department would recommend at least a 24 ft. easement width. The applicant has
addressed this by making the 60 ft. access easement a utility and drainage easement as
well.
Conformance with Comprehensive Plan
The City's Future Land Use Plan shows this site as being in a Secondary Growth Area of the
city and as being suitable for future industrial development. However, both the City and
County's industrial zoning districts allow commercial uses within industrial zones.
Planning Commission Action
The Planning Commission considered this final plat application at their April 4, 2000 meeting.
Following presentation of the staff report and comments from the applicant, the Planning
Commission voted 7-0 to approve the proposed final plat of the Millenium Addition subject
to the following conditions and corrections:
1. Plans for the sales office structure on the site shall be prepared and/or certified by a
licensed architect and reviewed and approved by the City's Building Official prior to
issuance of a building permit.

2. Design plans for the proposed detention basin including associated ditches and
pumps shall be reviewed and approved by the City and County Engineer prior to
issuance of a building permit for any building within the subdivision.
3. The applicant shall satisfactorily complete construction of the ponding area and shall
sign and record a maintenance agreement providing for maintenance of the ponding
area prior to issuance of any occupancy permit for any building within the subdivision.
4. The plat boundary shall be revised to incorporate an additional 30 ft. from the
adjoining land to the east to create a full 60 ft. road access easement and a roadway
maintenance agreement shall be signed and recorded by the abutting property owners
prior to issuance of a building permit for any building within the subdivision.
5. The applicant and the adjoining property owner to the east shall satisfactorily
complete construction of the north-south access road to the County's minimum
standards prior to issuance of an occupancy permit.
6. A revised plat drawing containing all technical corrections on staffs corrections
checklist in addition to the widened access easement shall be submitted prior to City
Commission consideration of the plat.
City Commission Action
The necessary additions and corrections noted in Item #6 have now been made to the plat
drawing. If the City Commission concurs with the action of the Planning Commission, a
motion should be made to authorize the Mayor to sign the Millenium Addition plat.

Jeff Nelson, 1661 W. Republic. I would be willing to answer any questions
that you might have in reference to the drainage and also anything that
would be related to this.
Mr. Thompson asked have you had a chance to look over the staff
recommendations?
Mr. Nelson stated yes we are agreeable to the conditions put forth.
Mr. Thompson asked have you visited with an architect about developing
an office which would be user friendly for people and keeping in mind the
elevation that it would have to serve?
Mr. Nelson stated yes we have and in essence that is the nature of our
business, we are in manufactured housing and we will be using a
manufactured home as an office. We have talked to the people to make
.... sure that the entrance to the home is ADA accessible. We anticipate
building a berm where the office unit would sit. It would sit on the north
edge of the property at the highest elevation that typical manufactured
homes are installed. This would be a unit that would also be used as an
inventory item if eventually sold. It will not be a permanent building until a
later date when we do put a permanent building in. It will have to be
bermed but the office will be bermed and of course the flood elevation will
be above the floor stage and of course in talking to Mike Peterson as far as
the ADA recommendations we have talked with the people that have some
input on that as far as making sure that the front door is accessible to meet
ADA requirements, we assume that we will have to build a ramp again to
meet those conditions, we are aware of that sir.
Mr. Umphrey asked is your proposed structure a conventional building or a
modular structure or what?
Mr. Nelson stated it is a manufactured home. It is built to the national HUD
Code, in other words it is a unit that we will use as a temporary office until
such time as we replace it with a permanent structure, but it does meet all
of the national building codes as required with the HUD requirements for
manufactured homes.
Mr. McDowell asked is your office is going to be at the far end?
Mr. Nelson stated no sir it would be in the first 400 feet. There is
approximately from the very south end of the property to where the
detention pond starts, approximately a two foot elevation change. We will
try to set our office unit about in the middle of the display area in the front
towards the west property line, the front door facing east. That is one of
the higher elevations.

Mr. McDowell stated I thought you said north or somebody did. What kind
of signage are you going to have? It is really not part of the plat approval
bUt I am just curious.
Mr. Nelson stated well initially we will have temporary signage which is
required by the State for licensing, we have to have a sign out there to
identify our place of business.
Mr. McDowell asked you have a sign out there now?
Mr. Nelson stated right which we have to have to get our licensing.
Mr. Nelson asked are there any other questions?
Mr. Thompson stated hearing none are there any members of the public
that would care to address the Commission? Hearing none we will bring it
back to the Commission for possible action.
MOTION: Mr~ Perney moved to recommend to the City Commission approval of
Application #CP00-2/2A, as this application is essentially in conformance
with the Comprehensive Plan and does not require any rezoning or any
other action, subject to the six staff report recommendations.
