GRANT OF PERMANENT SIDEWALK EASEMENT
Kurt D. Fredrickson and Jean E. Fredrickson, Trustees of the Kurt Fredrickson Trust
dated October 14, 2005 and Thomas H. Cure and Rhonda Kay Cure, trustees of the Thomas H.
Cure Trust UtA dtd September 26, 2003 ("the Grantors"), being the owners of the hereinafter
described real estate, do hereby give, grant, dedicate, and convey unto the City of Salina,
Kansas, a municipal corporation, (the "Grantee")
A permanent easement, in perpetuity, over and across a strip of real property situated on
Magnolia Road and located on Lot 1, Block 1 of Key Acres Addition to the City of Salina,
Saline County (according to the corrected plat thereto) legally described and depicted on
the attached Exhibit A for the purpose of pedestrian use by the public of the public
sidewalk constructed thereon; with full authority to enter upon the easement to construct
the sidewalk and, if Grantor fails to fulfill its legal responsibility relating to the safe
condition of the sidewalk, with full authority to enter upon the easement to maintain,
repair or replace the sidewalk on the basis allowed by law.
Grantors acknowledge that this Grant of Permanent Sidewalk Easement shall neither alter
nor affect the Grantors' obligation to maintain the described real estate.
Grantors hereby covenant that they are the lawful owners of the described real estate
and have the right, power, and authority to convey the rights granted hereby.
Grantors further covenant that: (1) Grantors are the Trustees under the Trusts; (2) the
Trusts are revocable trusts; (3) the Trusts remain in full force and effect at this time; (4) Grantors
are the duly qualified and acting Trustees under the Trust; and (5) as such Trustees, Grantors are
authorized, pursuant to the Trusts and without any limitation whatever, to convey all of the above-
described Permanent Sidewalk Easement.
