COMMISSION ACTION MOTION BY SECOND BY TO: ORDINANCE NUMBER 84-9048 (Published in The Salina Journal · 198q) AN ORDINANCE PROVIDING THE METHOD OF BILLING AND COLLECTICN OF COMBINED BILLS FOR WATER AND SEWERAGE SERVICE; PROVIDING FOR A DELINQUENCY PENALTY AND THE PRCCEDURE FOR DISCONNECTION OF SERVICE FOR NONPAYMENT; AMENDIHC SECTION ~49-93 OF THE SALINA CODE AND REPEALING THE EXISTING SECTION. BE IT ORDAIHED by the Governing Body of the City of Salina', Kansas Section 1. That Section 41-93 of The Saline Code is hereby amended to read as follows: "Sec. u, 1-93. Billincj and collection; penalty for delinquent acccounts; disconnection of service for nonpayment. (a). Ail water meters, except those specifically installed for .the sole purpose of irrigating yards and lawns, shall be read and biits for water ,and sewerage service (or either.) rendered monthly· and such bills shall be collected as a combined bill for water and sewerage service furnished each customer. Each bill shall be payable upon the renderin9 of such bill and if not paid on or before the specified due date as shown on the bill, such bill shall be considered delinquent and subject to a delinquency penalty. (b). Alt bills unpaid fifteen (15) d~ys after date of ~issue shall be ,considered delinquent and subiect to an additional charge of ten percent (10%) on the gross amount of the biltin9. (c). if the rendered bill and delinquency penalty are not paid within ten (10) days after the bill is declared delinquent, then a termination notice shall be issued. The termination notice shall provide the customer of record with the followin9 information: (1) The amounf, due on.the unpaid balance; (2) The customer's right to a hearing before the department; provided such request is made at least three {3) workin9 days prior to termination date; (3) Notice that service will be terminated in seven (7) days if the bill remains unpaid, If the customer of record is not the occupant where · water servi.ce is provided, then the department shall provide similar notification to the occupant. The request for a hearin9 must be no later than three (3) workin9 days before the date of discontinuance. Such hearir'gs will be conducted by one or more of the following representatives: director of utilities, water office supervisor, or such other representative of' similar management grades as may be appointed, by the director of utilities. The department is authorized to discontinue and disconnect wa(er service for any customer who shall be delinquent in the payment of bills. Customers are responsible for furnishing the department with their correct address for billing purposes. (d). If the service to the property shell be disconnected, .it shall remain disconnected until suct~ customer shall pay the fuji amount of ail water and sewer bills, including such cash deposit as the director of utilities may require and a service charge of ten dollars ($10.00). (e). All water meters which are installed for the soie and specific purpose of irrigatin9 yards and lawns shall be read and bills for such water service rendered monthly during the months of May through October, inclusive, water consumed during the months of November :brough April, inclusive shall be metered and the meter read and the bill for such water consumed during this period rendered with the May reading. Payment for such water service furnished would be due and payable in the same procedure therein provided for the collection, notification and disconnection of servi~e for delinquent accounts shall be applicable. {f). It shall be the duty of the representative of the city at the time in charge of the collection of water and sewerage service rates, to notify the director, of utilities of all delinquencies in the payment of monthly bills, and said director shall proceed immediately to qisconnect service to any customer who is in arrears for the period hereinbefore specified." Section 2. That the existing Section ~1-93 of The Salina Code is hereby repealed. Section 3.
