AGENDA SECTION ORIGINATING DEPARTMENT: APPROVED FOR NO: 5 AGENDA: CITY MANAGER’S OFFICE ITEM NO. 2b BY: Page 1 BY: Mike Schrage ITEM: Consider acceptance of public drainage easement dedication and approval of covenants related to a storm drainage pipeline located on Lot 1, Block 1 of the Hurd Plaza Addition and the Suburban TV and th Appliance Center site at 1900 South 9 Street. BACKGROUND: Hageman School at 409 West Cloud was constructed in 1953 at a time when much of the surrounding neighborhood was undeveloped. As part of the site improvements for the school site, a concrete inlet was constructed at the eastern edge of the playground t hat collected stormwater runoff from the th school yard and transmitted it over to a stormwater in 9 Street (Old US 81) through an 8 inch storm pipeline. Because most of the surrounding land was undeveloped and some of it still outside the city th limits, no easement was obtained for the 500 ft. of pipeline extending over to 9 Street. Over time the surrounding area developed with a filling station being moved in on the Suburban TV site in 1960, Playland Amusement park and Southview Plaza being developed in 1962, Hurd Plaza in 1985 and finally Auto Zone in 1997. Hurd Plaza and Auto Zone were not allowed to discharge their ponds into the existing 8 inch storm pipeline because of the lack of easement across Suburban’s property. th In 1998, the City’s contract ors working on the South 9 Street widening project disconnected this th pipeline from the storm sewer under 9 Street based on the belief t hat it was an undocumented sanitary sewer line connected to the storm sewer system. It has remained disconnected since that time. Elements of Drainage Easement and Maintenance Covenants In discussions held between City staff, representatives of Genesis Health Clubs and representatives of USD No. 305 regarding the Genesis Health Club addition, it was recognized that this pipeline and th the ability to transmit stormwater over to the storm sewer system in 9 Street was important to the school district’s future plans for their property and a plan was developed to put the existing pipeline back into service. The comprehensive Drainage Easement and Covenants document prepared by the City Attorney contains the following elements: th 1. The City of Salina agrees to reconnec t the 8 inch storm pipeline to the 9 Street storm sewer system. 2. USD No. 305 agrees to dedicate a 20 ft. public drainage easement across their holdings between the Hageman School site and Auto Zone’s property. 3. USD No. 305 agrees to maintain the existing 8 inch storm pipeline until such time as it is replaced with a new line built to the City’s specifications for public storm sewers. 4. SSS Properties (owners of Suburban TV) agree to dedicate a 20 ft. public drainage easement across the north 20 ft. of their property. 5. USD No. 305 and in the future t he City of Salina agree to repair SSS Properties’ parking lot if it is damaged by pipeline installation or repair work done within the 20 ft. drainage easement. Auto Zone has previously dedicated a public drai nage easement across their property so if this easement agreement is approved the result would be a 500 ft. l ong continuous drainage easement th from the Hageman School site to South 9 Street that would be available to serve the future drainage needs of the school district’s property. RECOMMENDED ACTION: Staff has identified the following options for the City Commission’s consideration. 1.) Accept the offered drainag e easement dedications and pr oposed covenants for the storm th pipeline running from the former Hageman School site over to South 9 Street, and authorize the Mayor to execute said documents. 2.) Provide additional direction regarding revision of the proposed easement and agreement. 3.) Reject the offered drainage easement dedication and covenants. Encl: Vicinity map Easement documents
