An ordinance amending Chapter 40, Division 3, Article I, of the Salina Code by amending section 40-
36 to provide for a two year ineligibility period after an application for a taxicab driver’s license has
been denied.
BACKGROUND:
Current Salina Code provides that a taxicab driver’s license a pplicant must wait two years before
reapplying if the license was revoked pursuant to Section 40-39. Specifically, the licensee is ineligible
to reapply for a license for a period of two years from the date of the revocation. Section 40-36 does
not provide for the same two year ineligibility per iod for a non-licensed applicant that is denied a
license for reasons that would otherwise result in a revocation.
City staff previously encountered situations where an applicant who had been denied a license,
inquired about the time-frame for re-applying. Current city code is silent as to that question. The
proposed amendment provides a two y ear ineligibility period consis tent with current city code
regarding revoked licenses.
FISCAL NOTE:
The ordinance has no fiscal impact.
RECOMMENDATION:
Adopt Ordinance No. 10-10573 on first reading.
