On August 27, 1984 the public hearing date was set for September 17, 1984 for
Engineering Project 83-707 for the curbing, guttering, paving and grading of
North Third Street, East Harsh and East Otis Avenues.
This hearing is being held for the purpose of receiving comments, written or
oral, on the method of assessment for this Engineering Project.
Ordinance Number 84-9042 should be introduced for first reading at the
conclusion of the public hearing and then adopted on September 24, 1984.

Dear Mr. Nye:
In regard to the above project which has been authorized
by Resolution Number 83-3596 of the Board of Commissioners,
it is our opinion that the curbing, guttering, paving, and
grading of North Third Street, East Harsh Avenue, and East
Otis Avenue does nothing to enhance the value of my described
property 1-00570-02280.
Over the past few years it seems that the chance of im-
proved valuations in the general area you speak of has been
practically nothing. With or without the capital expenditure
for curbing, guttering, and paving, I cannot see any reason
for the valuations to increase, especially with the property
market being in somewhat of a depressed nature.
I further feel that the tax payers revenues would be
better invested in an area which would increase Salina's
chance for economic growth.
In closing, I am not in favor of the above mentioned
paving project.

You are hereby notified, as owner of the following described property,
to-wit: 1-00570-02280
Lot 2, Block 17 Plus 10' vacated street Episcopal Military Institute
Addition to the City of Salina, Saline County, Kansas.
That the cost proposed to be assessed against such property for the
curbing, guttering, paving, and grading improvements in North Third
Street, East Harsh Avenue and East Otis Avenue, as authorized by
Resolution Number 83-3596 of the Board of Commissioners of the City of
Salina, Kansas, on the 22nd day of August, 1983 is $1,958.71.
That the Board of Commissioners of the City of Salina, Kansas, will meet
in the City Commission Meeting Room, Room 200, City-County Building, 300
West Ash Street, Salina, Kansas, on Monday the 17th day of September,
1984, at four o'clock p.m. for the purpose of considering written or oral
objections to the proposed assessments.
Done by order of the Board of Commissioners of the City of Salina, Kansas
this 27th day of August, 1984.

AN CRDINANCE LEVYING SPECIAL ASSESSMEHTS ON LOTS, PIECES,
AND PARCELS OF GROUND IN THE C!T'( OF SALiNA, KANSAS FOR THE
PURPOSE OF PAYING A PORTION OF THE COST OF:
Curbing, guttering, paving and grading of THIRD STREET
from the north line of Pacific Avenue to the south
line of Euclid Avenue.
Curbing, guttering, paving and grading of HARSH AVENUE
from the east line of Santa Fe Avenue to the west
line of Third Street.
Curbing, guttering, paving and grading of OTIS AVENUE
from the east line of Fourth Street to the west line
of Third Street.
WHEREAS, pursuant to proceedings regularly had according to law,
contracts have been let for the following improvements in the City of Salina,
Saline County, Kansas:
Curbing, guttering, paving and grading of THIRD STREET
from the north line of Pacific Avenue to the south
line of Euclid Avenue.
Curbing, guttering, paving and grading of HARSH AVENUE
from the east line of Santa Fe Avenue to the west
line of Third Street.
Curbing, guttering, paving and grading of OTIS AVENUE
from the east line of Fourtt~ Street to the west line
of Third Street.
contracts have been duly performed, and
WHEREAS, the Ooard of Commissioners has determined that the total
cost of such improvements is Two Hundred Ninety-nine Thousand Five Hundred
Fourteen and 93/100 dollars ($299,514.93) and that 100.00 percent in the
amount of Two Hundred Ninety-nine Thousand Five Hundred Fourteen and 93/100
dollars ($229,514.93) be assessed against the improvement district and 0.00
percent be assessed against the city-at-large.
WHEREAS, the Goard of Commissioners has, after due notice, met and
determined the amount of special assessments, SO NOW, THEREFORE
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas.
Section 1. That special assessments to pay the cost of such
improvements, with accrued interest, be and the same are hereby levied against
the several lots, pieces and parcels of land liable for special assessments for
said improvements as follows:

Section 2. Said amounts so levied, apportioned and assessed as
aforesaid will be due and collectible in ten equal installments, the first
becoming due with the taxes levied for the year 1984, and one of said
installments falling due each and every year thereafter until all are paid and
all to be collected with interest as in this ordinance provided, HOWEVER,
that the owner of any piece or parcel of property liable for any such
assessments may redeem his property from such liability by paying to the
City Treasurer the entire amount chargeable against the same, as in this
ordinance provided, at any time within thirty days after the publication
of this ordinance and before the issuance of bonds of said City in payment
of the balance of the cost of said improvements, the property so paid on
shall not thereafter be liable for any Further assessments for the cost of
said improvements, nor for any part of said bonds.
Section 3. There is hereby levied further and assessed against such
lots and pieces of ground described in this ordinance, interest at such rate per
annum as shall be bo'-ne by bonds hereafter to be issued for the payment of the
remaining unpaid cost of such improvements to be hereafter determined and fixed
by ordinance, when such bonds are issued on all of said installments mentioned
and provided for in this ordinance, from the date of the bonds which may be
issued at the end of thirty days as specified in the preceding section hereof,
as by law provided, to the time of the collection of the installments as
provided by law, which said interest shati be collected and after the taking
effect of this ordinance and the fixinG of said interest rate when such boreas
are authorized and issued, however such irtterest rate shall not exceed 12
percent per annum, it shall be the duty of she City Clerk of said City to
annually, at the same time other taxes are certified, and until all of said
assessments so apportioned and levied have been certified to the County Clerk of
Saline County, Kansas, certify a full list of all property liable to assessment
and taxation for such work and improvements, except such property on which the
special assessments aforesaid have been paid in full, as hereinbefore provided,
together with the respective amounts due on each of said lots and pieces of
ground, which amounts shall include the annual installments on special
assessments together with the interest for one year at the rate to be fixed
as provided for in this ordinance, on all unpaid balances of such assessments,
such amounts so certified as herein provided shall be placed upon the tax roll
by the County Clerk of Saline County, Kansas, and collected as other taxes are
collected.
Section 4. That this ordinance shall be in full force and effect ,From
and after its adoption and publication once in the official city newspaper.
