RE: Application #Z82-2, filed by Wally Storey, Jr., re~luesting rezoning of a 1.2
acre tract of unplatted property lying west of N. 13th Street and north of W.
Woodland, extended from RS (Single Family Residential Suburban District) to
I-2 (Light Industrial District) (Approximately 801-813 N. 13th Street)
On June 7, 1982 at the recommendation of the City Planning Commission, the Salina
City Commission placed Ordinance #82-8911 on 1st Reading rezoning the above refer-
enced property. 2nd Reading of this ordinance has been withheld pending recording
of a final plat of the property as is required by Section 42-8 of the Zoning
Regulations. This section states that any rezoning request approved subject to
platt{ng (as in this case), shall be for a period not to exceed one year. The
Planning Commission is authorized to grant one extension, not exceeding six months,
upon written application. Mr. Storey requested this 6-month extension and it was
granted by the Planning Commission on June 7, 1983.
On December 20, 1983, the Planning Commission considered a request by Mr. Storey
to grant an additional 6 month extension, but since they lack direct authority to
grant additional extensions and, since they were assured that the plat could be
completed within 6 months, they recommended that the City Commission grant the
request. That extension was granted by the City Commission on January 9, 1984.
On July 17, 1984, the Planning Commission considered another request from Mr.
Storey to grant a third 6 month extension. Since they still have no direct author-
ity to grant this request, a motion was unanimously approved (7-0) recommending
that this request be denied and the City Commission place Ordinance #82-8911 on 2nd
Reading and the vote to deny the ordinance.
