Report on Petition No. 4031 requesting vacation of a 70' x 100' storm sewer
easement and the north 20 feet of a storm sewer easement along the north line of
the vacated Woodland Avenue on Lot 1, Block 1, Trockenbach Addition.
Background
The petition was submitted by James M. Hall IV, representing Morrison Grain
Company, on March 6, 1992. The apparent purpose of the request is the owner's
desire to have full utilization of the currently vacant lot for development
purposes. This area is located at the northwest corner of Thirteenth and
Woodland as shown on the attached sketch.
The lot was platted as part of Trochenbach. Addition in October, 1984. The
easements in question were dedicated for storm drainage purposes. The easement
on the south 40 feet of the lot encompasses an existing 48 -inch storm pipeline
which drains west to the Dry Creek Channel. The 70' x 100' easement was
apparently platted to include a previously dedicated easement for Dry Creek.
When Dry Creek was relocated to the west of this lot, the easement became no
longer needed.
Recommendation
It is recommended that the City Commission approve the ordinance vacating the
70' x 100' storm sewer easement on Lot 1, Block 1, Trockenbach Addition.
However, the 40 foot easement along the south side of Lot 1 should be retained
for storm drainage purposes.
