Gentlemen:
Enclosed is a proposed resolution addressing the
request by Woodrow A. Ross for a quit claim deed to a
small parcel of land in the Chicago Addition. At the
June 6, 1988, City Commission meeting, this matter was
referred to the City Engineer and City Attorney for a
recommendation.
I have also enclosed proposed language for the blue
sheet and copies of the informational items that you
may wish to attach. Please let me know if you have any
questions or suggested changes.

A RESOLUTION DETERMINING THAT NO FURTHER PUBLIC PURPOSE
EXISTS FOR A CERTAIN PARCEL OF LAND OWNED BY THE CITY AND
AUTHORIZING ITS CONVEYANCE TO THE ADJACENT PROPERTY OWNER.
WHEREAS, the following described parcel of land was
acquired through condemnation in 1936 by the City of Salina
for the purpose of constructing the Broadway Boulevard
overpass and Dry Creek channel improvements:

WHEREAS, The only adjacent owners, Woodrow A. Ross and
Ola Ross, husband and wife, have requested that the real
estate be conveyed to them by quit claim deed and are the
only persons in that can effectively utilize the real
estate.
BE IT RESOLVED by the Governing Body of the City of
Salina, Kansas:
Section 1. It is hereby determined that no further
public use is contemplated by the City for the real estate
described above; that no public purpose is to be served by
the City retaining title to the real estate; and that
continued ownership of the real estate will result only in
further maintenance expense to the City.
Section 2. The Mayor is hereby authorized and directed
to execute and the City Clerk to attest a quit claim deed
conveying the City's interest in the above described real
estate to the only adjacent property owners and the only
persons that can to effectively utilize the real estate,
Woodrow A. Ross and Ola Ross, husband and wife.
Adopted by the Board of Commissioners and signed by the
Mayor this _ day of August, 1988.

BLUE SHEET INFORMATION
At the June 6, 1988, City Commission meeting, the
request by Woodrow A. Ross and Ola Ross for a quit claim
deed to a small parcel of land owned by the City and located
in the Chicago Addition was referred to the City Engineer
and City Attorney for recommendation. Attached are copies
of the request letter from Mr. Ross dated May 23, 1988, and
a certificate of survey for the subject parcel of land.
Also attached is a copy of a memo from the Assistant
Director of Engineering and Utilities to the City Attorney
regarding the request. Based upon the recommendation of the
Engineering Department, the proposed resolution determines
that no further public purpose is served by the City
retaining title to the real estate and authorizes the Mayor
to execute a quit claim deed conveying the real estate to
Mr. & Mrs. Ross as the only adjacent property owners and the
only persons that can to effectively utilize the real
estate.
Staff recommends that you adopt the proposed
resolution.

Subject: Request by W. A. Ross
We have reviewed the request submitted by Woodrow Ross (City Commission
Meeting on June 6, 1988) for a quit claim deed to a parcel of land in
the Chicago Addition.
This parcel of land was acquired by the City of Salina in 1936 for the
purpose of constructing the Broadway Boulevard overpass and channel
improvements. This acquisition was a result of condemnation action and
is recorded in Miscellaneous Book 19-214.
Mr. Ross owns all of the adjacent property on the north and west sides
of this triangular tract and Broadway Boulevard R/W adjoins on the
south and east sides. Therefore, only Mr. Ross could utilize this
parcel of land effectively.
We do not need this tract of land for any public use and would recom-
mend that you prepare the necessary paper work to allow the City of
Salina to grant a quit claim deed to Mr. Ross.

This letter is in regards to a parcel of land in Chicago Addition that was
condemned for the Dry Creek Channel Change, as shown on the attached survey.
I have recently purchased the land adjacent to this parcel of land which
is owned by the City of Salina. Since this land was not used for the Channel
Change and is of no real value to the City of Salina, I would appreciate a
quit claim deed from the City of Salina for this property. Thank you for
your consideration in this matter.
