Petition No. 3952, filed by Billy Pittenger for permission to construct a driveway
approach on Ohio Street to serve Lot 2, Block 8, Replat of Dow Addition, was referred
to the City Engineer on March 14, 1988, for a recommendation.
This request involves creating a break in the restricted access control on the east
side of Ohio Street. Restricted access control was granted at this location by the
owner during the platting process of this subdivision in 1976. Consideration was gi
at that time to assure adequate access to all lots within the subdivision. The lot.
owned by Mr. Pittenger was platted with frontage on Louise Lane and presently being
served with a driveway on Louise Lane.
Restricted access control along arterial streets is clearly defined in our Subdivision
Regulations. Other subdivisions, other than Dow Addition and the Replat of Dow
Addition, which were platted in recent years involving access control along arterial
streets include Albers Addition; American Stores Addition; Country Hills Addition;
Eastridge Addition; Georgetown Addition; Gile Addition; Lundberg Addition; Meadowlark
Acres No. 3 Addition; Park West Addition; Parkwood Village Addition; Presbyterian
Manor Addition; Replat of Schippel. Addition; Sullivan Addition; Twin Oaks II Subdivi-
sion; and Wallerius Addition. These subdivisions represent approximately 29,000 L.F.
(5.5 miles) of restricted access.control.
Ohio Street at this location carries.approximately 16,000 vehicles per day. Therefore,
access control along this major arterial street is critical. Breaks in the access
control can only reduce the capacity of Ohio Street and increase the accident risk.
The creation of a situation involving the backing of a vehicle out of a garage onto a
heavily traveled arterial street is not warranted and should be avoided.
Other requests have been received in the past to break the platted restricted access
control along arterial streets. Requests that have been denied on Ohio Street in
recent years included development along Ohio Street, namely Hancock Clinic; Oak Park
Shopping Center; Statcare Clinic; Weis Office Complex; Manchester Manor; Security
Savings & Loan; Church of Jesus Christ L.D.S.; Bruce Johnson, D.D.S.; etc. We can
find no documentation to show that the City Commission has ever granted a break in the
restricted access control along arterial streets without requiring special conditions

to be fulfilled, such as replatting; approving a planned development district (P.D.D.);
etc. to fully consider the impact of a proposed restricted access break.
We, therefore, recommend the request for a break in the restricted access control along
Ohio Street be denied. Public safety must demand precedence over an individuals desire
for convenience.
