I enclose a copy of the October 5, 1989 letter of G. Harold Lamfers of Bucher, Willis &
Ratliff, plus the October 5, 1989 "Contractor's Payment Estimate" signed by Wilbur D.
Beemer and Harold Lamfers, which I approved on October 12, 1989. This calls for a
payment of $26,501.20 subject only to Wilbur Beemer's submitting an affidavit required
by paragraph 2 of Article 52 of the general conditions. That has to do with Beemer's
oath that everyone has been paid plus the statement of the surety on the performance
and payment bond consenting to final payment.
I also enclose a copy of the October 5, 1989 statement of services from Bucher & Willis
for "professional construction engineering services" in the amount of $7,563. Also, you
will find enclosed a copy of the June 26, 1989 statement of Bucher & Willis for
"professional engineering services for final design and preparation of construction plans
and specifications for the detention structure" in the amount of $6,000. We have already
paid this item and submit it for purposes of reimbursement.
Finally, I enclose the August 7, 1989 statement of Bucher & Willis in the amount of
$25,74350 "for professional services to prepare the final design, construction plans, and
specifications for water, sewer, streets and cart paths". In the instance of each Bucher &
Willis statement, we enclose copies of the cover letters from that firm which presented
those statements.
We submit these items for payment by the City as part of special assessments to be
levied against the first 31 lots.

Dear Mr. Graves:
A final inspection of the Detention Dam, Pool Area and
Waste Area was made on October 3, 1989. Those present were
Wilbur Beemer, Terry Martin and Harold Lamfers.
We believe construction has been completed in accordance
with the Plans and Specifications and we recommend final pay-
ment be made. We discussed the quantities with Mr. Beemer.
We are both of the opinion that final quantities are very
near the bid quantities and, therefore, agreed it was not
necessary to perform additional surveys to calculate actual
Excavation, Earth Fill or Seeding & Fertilizer. Excavation
was probably slightly in excess of plan quantity, but it
would be very minor, and Mr. Beemer agreed it was not worth
additional effort to determine the actual quantity in this
regard.
Mr. Beemer had corrected all eroded areas (including
reseeding) except a short segment on the east slope of the
inlet channel at the southeast corner of the ponding area.
We believe the grass in this area (as well as other seeded
areas) will be acceptable by next spring, unless heavy rains
occur in the meantime. In any event, he agreed to reseed
those areas which may be unacceptable next spring. We
believe Mr. Beemer performed admirably and will honor his
verbal commitment in this regard. As additional insurance in
this regard, Articles 48 and 50 of the General Conditions can
be utilized if necessary.

ment regarding the affidavit that Mr. Beemer is to provide
before final payment is made.
We believe this completes our services on this project,
unless additional efforts are required next spring. A
statement for our services will be submitted shortly.

Dear Mr. Beemer:
As indicated during our final inspection on October 3,
1989, we believe construction of the referenced project has been
completed in accordance with the Plans and Specifications and
will so advise the Owner. If they are in agreement, they will
execute the Contractors Payment Estimate and process final
payment.
You must, however, submit a notarized affidavit as required
by the second paragraph of Article 52 of the General Conditions
before acceptance by the Owner. Please provide two copies to
our office. We will forward one copy to Mr. Graves.
An interim copy of the Final Payment Estimate is enclosed
for your reference pending receipt of the final executed copy
from the Owner.
As discussed during the final inspection, it may be neces-
sary to reseed some areas in the spring dependent on grass cover
at that time. The main concern at this time is a short segment
on the east slope of the inlet channel at the southeast corner
of the ponding area. It was agreed that you would broadcast
additional seed in this area at this time with the expectation
that adequate growth would be evident next spring. In the event
this, or other seeded areas, do not provide adequate growth in
the spring, they will be corrected at that time.
We have enjoyed our association with you and all those who
worked on construction of the project. Your performance was
commendable. We will certainly recommend your firm to others
for similar work and look forward to the -opportunity to work
with you again in the future.

Detention Structure
Engineering services for design of the detention
structure and ponding area in the northwest corner of
Mariposa Subdivision have been completed in accordance with
our proposal dated January 26, 1989.
Our costs exceeded the estimated fee of $6,000 noted in
our proposal. As indicated during a recent discussion, we
have decided in this case to charge only the $6,000 estimate
for these services. A statement reflecting this is
enclosed.
Also, a3 discussed recently, we will proceed with
construction phase services (notice to bidders, bid opening
and inspection) on an hourly basis. The hourly rates will
be the same as noted in our previous letter of September 30,
1988. If you are in agreement, please advise. An official
agreement can be provided if you prefer.
