City water main break
Dear Mr. Hoff:
Pursuant to our phone conversation this morning, I was following
up a meeting that Mr. Bob Albers and I had several month ago with
City Engineer Dean Boyer concerning a water main break which
occurred last winter adjacent to the above referred building site.
The site for this building is on the east side of Arnold Road,
directly south to the City water tower at the Airport Industrial
Center.
The background on this issue is that during a cold spell last
winter, the existing city 10" water main ruptured, and flooded the
job site. The contractor had the building and loading dock
foundations excavated, reinforcing placed and was ready to place
concrete in the open excavations. The water from the water main
break flooded the site and filling the open excavations with water.
This caused the contractor to have to removed his reinforcing, and
clean out the excavations of wet soil material. This increased the
amount of concrete required. Since the site was rough graded, the
road way ditches along Arnold Avenue and Southerland filled with
water and dirt which had to be cleaned out.
I feel the city is responsible for the cost for this damage to the
job site, and not the contractor, because the existing water main
was the cities, and the main was not disturbed by the contractor.
Had the water main been part of the construction work, or had the
contractor disturbed it, the damages would have been the
responsibility of the contractor's builders risk insurance.
Several months have gone by since Mr. Boyer was made aware of this
problem, and since Mr. Boyer did not take care of this matter
before he retired, we need your assistance in taking care of this
problem as soon as possible.

Inc.'s letter concerning the cost of the corrective work required.

damages as follows:
Extra concrete for footings, loading: dock. Had to
muck out 4 c.y. @ $48.00 per c.y.
Extra concrete for west wall footings 9 c.y.
@ $48.00 yd.
Labor 24 hrs @ $18.00 hr.
Sump;pump: 20 hrs @ $11.00 hr. (Labor)
Backhoe/ man. 4 hrs, @ $60.00 hr.
Haul in dirt where line broke 2 loads @ $45.00 per load
Spread dirt 545 loader 1 hr. @ $80.00 hr.
Move block with 545 loader 1 hr @ $80.00 hr.
Clean out footings & clean up rebar on building.
62 hours @ $18.00 fir.
Ditch washed full of dirt, clean out ditch &
culvert. 545 loader 6 hrs @ $80.00 hr.
Clean out pipe, 2 hrs labor @ $18.00 fir.
