Dear Don:
This will confirm our phone conversation of Wednesday morning
in which I expressed to you the concern of my client, Wally
Koers, concerning activities of the city along the east
boundary line of his property. Someone from the city advised
Mr. Koers' family or Charlotte Chapman, the neighbor adjoining
the Koers property, that the city intended to construct a
service road to its sewage pump stations behind the Koers
property and that the city would be coming in with bulldozers
and taking out large trees to build this road.
It is my understanding after talking to you that the city is
simply making preliminary surveys of the site and that no
decision has been made as to the location of the road.
This letter will confirm my understanding that prior to the
city making any final decisions on this project, you will
contact me so that my client can be fully advised of what
the city intends to do and'of his rights in response thereto.

Re: Maintenance Road Easement

We have completed our preliminary survey of the platted utility.
easements on Lots 8 and 9, Ridgeview Addition to establish a mainte-
nance road for an existing sanitary sewage pumping station located
in this subdivision. Construction of an access road on any of the
above platted easements would require the removal of trees, shrubs,
etc.
In a conversation with Mr. & Mrs. Douglas Chapman, they indicated
it was their preference, and that of the Koers family, to permit the
city sewage maintenance crews to utilize their existing drive, along
the east side of Lot 9, as an access road to the pumping station.
This suggestion, as an alternate to constructing a new access
road, was accepted by our Sewage Maintenance Supervisor, Mr. George
Pauls, as a workable solution to the pumping station access problem.
This station is checked only once a day and therefore, will not
create heavy traffic flows on their drive.
Enclosed for your review are copies of the easement forms con-
cerning the maintenance road access. If you have any questions con-
cerning these instrument forms, please contact me.
