In order for the City of Salina to acquire a tract of land owned
by the Jefferson Square -Mayfair Limited Partnership as a drainage channel,
the following revisions to the existing Warranty Deed, recorded in Deed
Book 328 (Page 99), must be implemented:
(a) The right of the Grantor (Balaun) to drain storm water
into the channel shall be limited to existing agriculture
runoff from the East -Half (E.1/2) of the Southwest Quarter
(S.W.1/4), Section Thirty (30), Township Fourteen (14)
South, Range Two (2) West of the Sixth Principal Meridian.
(b) The Grantee (Jefferson Square -Mayfair Limited Partnership)
shall be required to dedicate right-of-way for public road-
way purposes across the channel tract at the extension of
Wayne Avenue and at the extension of Sherwood Lane. This
right-of-way dedication will allow the Grantors (Balaun)
permanent right of ingress and egress to their property,
lying east of the channel tract. This dedication action
would eliminate any reference to ingress and egress rights
in the proposed warranty deed.
(c) The existing channel could not be used for drainage of any
area south of Magnolia Road without increasing the hydraulic
capacity of the existing channel accordingly.
(d) The City of Salina will assume the channel maintenance
responsibilities after acquisition by the City.
