A petition, signed by a majority of the affected property owners, has
been filed with the Salina City Commission requesting that Cherokee Street
between Cloud Street and Bachtold Avenue be vacated. This petition request
is scheduled to be considered by the City Commission on September 12, 1983.
In order to prepare our report and recommendation to the City Commission
regarding this vacation request, we need to consider expanding the above
petition request to include all of Cherokee Street between Cloud Street and
Republic Avenue. We, therefore, would appreciate receiving your comments
to the proposal of vacating Cherokee Street between Bachtold Avenue and
Republic Avenue. Our report must be submitted by September 8, so please
notify us by mail or telephone prior to this date.

Re: Vacation of Cherokee Street
Dear Mr. Hoff:
As a property owner, 1206 Apache, my wife and myself_are,completely
against vacating the area between Cloud Street and Republic Avenue.
Especially the area between Bachtold Avenue and Republic Avenue.
We recently built a brand new two car garage which exits on to
Cherokee Street. Cherokee is the only access to our garage and
the garage would be worthless without an exit onto Cherokee.
Cherokee Street is the only through street from Cloud Street to
Crawford and is used very much by the community. We feel that
this street should be left open for access to and from Cloud and
Crawford.

SURFACED, BUT THEY HAVE BEEN TURNED DOWN. AT ONE TIME IT WAS
A COUNTY ROAD BUT NOW WE UNDERSTAND IT IS CITY PROPERTY!
MR. MELVIN WHO HAS A TRAILER PARK IN THIS AREA HAS PROBABLY NDT
BEEN IN FAVOR OF A NEW SURFACE FOR HE WOULD CARRY A LARGE
PORTION OF THE TAXES. THEREFORE, AS SOME OF US ARE TAXPAYERS

CHEROKEE STREET REPORT
Cherokee Street from Cloud Street to Republic Street is classified
as a residential street at the present time. The original cold -mix bi-
tuminous surface on this street deteriorated to the extent that patching
the numerous potholes became an impossible task. In order to provide a
street with an acceptable riding surface, the Street Department scarified
the remaining bituminous surfacing and re -constructed this section as a
light -type aggregate surfaced road. As with any aggregate surfaced road,
dust is a continuing problem.
There are various surface treatments that would improve the dust
problem, but would be very temporary and thus expensive over a period of
time. In order to provide a long term solution to the current problems
the adjacent property owners are experiencing, this section of Cherokee
Street must be constructed to the City of Salina's standards. Our current
standards of construction for a street of this class would require a pave-
ment width of at least 28 feet, with curbing and guttering on both sides.
There are basically two methods this street improvement project can
be initiated. The project can be initiated by petition or the project
can be initiated by the City Commission. These two methods of initiating
a project are described in detail below.
(A). Project Initiated by Petition
The governing body may find the improvement petition to be
sufficient if it is signed by enough owners to fulfill any of these
three requirements; (a) a majority of the resident owners of record
of property liable for assessment under the proposal; or (b) the res-
ident owners of record of more than one-half of the area liable for

assessment under the proposal; or (c) the owners of record (whether
resident or not) of more than one-half of the area liable for assess-
ment under the proposal.
Only those persons who are owners of record at the time of
signing the petition are eligible to sign and the sufficiency of the
petition is determined on that basis. "Resident owners of record"
includes any person who is a record owner of property within the improve-
ment district and who is a resident of the city, even though residing
outside the improvement district itself.
A public hearing on the advisability of the requested improvements
may be held to provide an opportunity for persons to express their veiws.
It is not held for the purpose of taking a public opinion poll. The
question of whether a particular improvement should be made is for the
governing body to decide.
If the governing body determines the petition to be sufficient in
accordance with K.S.A. 12-6aO4, no protests are accepted.
(B). Project Initiated by City Commission
If the governing body elects to initiate the improvements, a public
hearing must be held on the advisability of any improvement before any
work is authorized. The public hearing provides an opportunity for persons
to express their views concerning the proposed improvements. K.S.A. 12-
6aO4 specifies the notification process for the public hearing. The public
hearing must culminate in,a resolution by the governing body, setting out
the findings and determinations of the governing body on the six points
listed below:
(1) The advisability of the improvement.
(2) The nature of the improvement.
(3) The estimated cost.
(4) The boundaries of the improvement district.

(5) The method of assessment of the costs.
(6) The apportionment of the cost, if any, between the district
and the city at large.
When the proposed improvement is initiated by governing body action,
the improvement shall not be commenced, if protests signed by both 51% or
more of the resident owners of record of property within the improvement
district and the owners of more than half of the total area of such district
are filed with the city clerk within 20 days after publication of the
resolution authorizing the improvements (K.S.A. 12-6a06).
The residents whose properties abut Cherokee Street also have the option
of filing a petition with the City Commission requesting that this street be
vacated from Cloud Street to Republic Street. All lots abutting this section
of street presently have direct access to other streets. If the street were
vacated, the street right-of-way would revert to the adjacent property owners
in accordance with the provisions of K.S.A. 13-443.
A preliminary check of the number of record owners of property indicates
there are seventy-eight (78) different owners of property within the improve-
ment district. This number includes both the husband and wife, if the
property is owned jointly.
Attached to this report is a preliminary copy of the improvement district
map. All the property shown within the limits of the improvement district
is subject to special assessments for the improvement of Cherokee Street.
The assessments for the above improvements, in either method of
initiation, are levied as special taxes against the property concurrently
with the general property taxes. These assessments are payable in ten
(10) annual installments.

Our department conducted a twenty-four (24) hour traffic count study
on this section of Cherokee Street. We maintained traffic counters at
eight locations during the study period. The data indicated an average
of 944 vehicles per day use this section of Cherokee Street and approx-
imately 8% more vehicle traffic is generated from the trailer park on the
west side of Cherokee Street than is generated from both Pawnee Avenue
and Bachtold Avenue combined.
A peak hour traffic count on this section of street revealed that
approximately 21% of the total traffic was through traffic. Through traffic,
in this case, is defined as traffic not generated by the trailer park;
Pawnee Avenue; or Bachtold Avenue. The traffic from the trailer park was
approximately equal to the traffic generated from Pawnee Avenue and Bachtold
Avenue combined during this peak hour study.
Our records indicate the traffic count on Cloud Street west of Cherokee
Street, to be 2198 vehicles per day and the traffic count on Republic Avenue,
west of Broadway Blvd., to be 4,281 vehicles per day. These counts are
for comparison purposes only.

In reference to the letter to the City Commissioners from Mrs. Loren
Burkhead, dated March 29, 1982, complaining of the dust on Cherokee Street.
I have discussed the Cherokee Street problem with Mrs. Burkhead several
times. I have prepared a Cherokee Street Report and supplied Mrs. Burkhead
with sufficient copies to supply everyone in the benefit district with a
copy. This report outlines the different methods of initiating a street
improvement project, with each method the cost of the improvement would be
assessed against the adjacent property. Following distribution of this re-
port we had a meeting with the delegation from the benefit district, in-
cluding Mr. Lyle Melvin Jr., owner of the trailer court and largest land-
owner in the benefit district. At this meeting it was felt that for a
petition to be successful it would have to be supported by Mr. Melvin. Mr.
Melvin asked for additional time to discuss the problem with his renters to
determine if he felt he could support the petition for improvement or not.
We had a second meeting on Wednesday, August 11, 1982, and at this time Mr.
Melvin told us by phone he could not support the petition but he was willing
to see it vacated. We then discussed the problem with the delegation present

who felt they must have some form of assistance from the City in order to
afford the improvement.
Cherokee Street is a residential street which butts on the rear of
many of the lots in the benefit district which means the lots would pay for
two (2) streets, one front and one back, if both were paved. The past
policy of the City of Salina in these situations has been the same as any
residential street being initiated by petition and assessed against adjacent
property. This is the situation with lots between Regeant Road and Marymount
Road from Ruskin to Queens, also the lots between Marymount Road and Briar-
cliff Road from Starlight to Crawford and the lots north of Glen Avenue from
Marymount Road to Seitz Drive. The lots on Glen being the most recent as-
sessment. It is my opinion to keep the faith of the people who have already
been assessed for the full cost of their adjacent streets, whether in front
only or on both ends of the lots, we must treat Cherokee Street in a consistent
manner..
