Petition No. 3853 filed on July 18, 1983, by Mr. Dayton Jones requesting the
vacation of Cherokee Street between Cloud Street and Bachtold Street.
The petition was signed by 12 of the 16, or 75%, of the adjacent property
owners on Cherokee Street between Cloud Street and Bachtold Street.
The conditions cited in the petition filed by Mr. Jones are also present in
section of Cherokee Street between Bachtold Street and Republic Avenue. This
department, with the assistance of Mrs. Edna Burkhead, 1012 Apache Street,
polled the adjacent property owners in this section. We found 14 of the 17,
or 82%, of the adjacent property owners supported the vacation concept.
Therefore, the signers of the petition and adjacent property owners responding
to the poll represent 79% of the adjacent property owners on Cherokee Street
between Cloud Street and Republic Avenue. Only 2 property owners were
opposed to the vacation concept and both of their properties were between
Pawnee Avenue and Republic Street. We received no response from 5 adjacent
property owners.
One of the owners opposed to the vacation has a garage that faces and has
access onto Cherokee Street. They would be required to relocate the existing
garage and/or construct an access driveway onto Apache Street to utilize their
garage if Cherokee Street were vacated between Republic Avenue and Pawnee
Avenue.
The utility companies, K.P.L., S.W.B. and Salina Cable TV, will require that
twenty (20) ft. utility easements be granted along both the east and west
right-of-way lines of Cherokee Street, if Cherokee Street is vacated.
Our department would, therefore, recommend the City Commission vacate Cherokee
Street between Cloud Street and Republic Avenue subject to the above
easement requirements. We believe the benefits derived from this vacation

outweigh the hardships imposed on one or two individual adjacent property
owners. Several individuals have also recommended the City remove the
existing surfacing (gravel, etc.) and scarify the roadbed to allow the
vacated street to be utilized by the adjacent property owners to a greater
extent. We agree with this suggestion.

The Salina City Commission has scheduled to consider at their
May 7th meeting, a petition to vacate a portion or all of Cherokee
Street between Cloud Street and Republic Avenue. The Salina City
Commission at their September 19, 1983, meeting,voted to block
Cherokee Drive from Republic Avenue to Cloud Street for a trial
period, until May 1, 1984.
All interested property owners are encouraged to attend this
4:00 p.m. meeting on the 7th to express their views regarding the
vacation of Cherokee Street.
