CITIZEN FORUM
Carol Clark, 417 Irene, said she received a Vietnamese pot-bellied
pig as a gift and asked what she ran do to legally keep the animal in the City.

Dennis M. Kissinger, City Manager, said this issue is being reviewed
by staff and they will let Mrs. Clark know when the issue will be presented to
the Commissioners for their consideration.
Ernest Cole, 153 S. Front, spoke on the Cable TV proposal. He said
he is opposed to the $1.00 tax increase each month for each subscriber.
Ben Frick, 120 Overbill, noted dates of special attractions at the
Central Kansas Flywheels Museum. He requested a waiver of the bond
requirement for moving a donated building to be added to the museum complex.
Dennis M. Kissinger, City Manager, said staff would review the
request this week and this item would be on next week's agenda.

(8.1) Staff report on parking enforcement.
Dennis M. Kissinger, City Manager, reviewed various ways to reduce
expenses without reducing services. He recommended the current staffing for
this activity be maintained at two employees, a fleet of 2 Cushman vehicles be
maintained and that staff be directed to pursue increasing the overtime parking
fines.
The Commissioners and staff discussed various options and funding
mechanisms for parking enforcement.
91-557 Moved by Commissioner Warner, seconded by Commissioner Brungardt
that the staff report on parking enforcement be accepted, that current staff be
maintained at two employees, that a fleet of two Cushman vehicles be
maintained, and that staff be directed to pursue increasing the overtime

the low bid of Loag McArthur, Inc., in the amount of $14,983.00 for the
detective vehicle be accepted and that the purchase of the Cushman vehicles be

91-559 Moved by Commissioner Warner, seconded by Commissioner Brungardt
that the staff recommendation be accepted, that the contract for the detective
vehicle be awarded to Long McArthur, Inc. in the amount of $14,983.00 and the
contract for the two cushman vehicles be awarded to Harley Equipment Company
for $19,525.68. Aye: Brungardt, Warner, Ryan. (3). Nay: Beggs, Divine.

(8.3) Consideration of police weapons changeover.
Dennis M. Kissinger, City Manager, reviewed the firearms used by
Salina police officers. He said this is a long-term capital investment as
semi-automatic weapons would provide the officers with optimum equipment for
many years into the future. He recommended approving the project and the
expenditures.
James Hill, Police Chief, said the current weapons are substandard
andwould be sold to dealers and the funds would go back into the program for
training and ammunition.
The Commissioners and staff discussed capital budgets versus
operating budgets.
91-560 Moved by Commissioner Divine, seconded by Commissioner Brungardt
that $40,000.00 for the total police weapons changeover project, including the
expenditure of $33,130.50 for the purchase of the new semi-automatic weapons
be approved. Aye: Brungardt, Divine, Warner, Ryan. (4). Nay: Beggs.

(8.4) Resolution Number 91-4412, appointing members to the Business
Improvement District Number 1 Board of Advisors.

Resolution 91-4412, appointing members to the Business Improvement District
Number 1 Board of Advisors, be adopted. Aye: (5). Nay: (1). Motion

(8.5) Consider providing a Notice of Intent to Terminate on Interlocal
Agreement with Salina County for Bailiff Services.
Dennis M. Kissinger, said the City currently pays $20,000 each year
to Saline County Sheriff for bailiff services. He recommended giving notice to
terminate the contract and evaluate the merit of the services during the coming
year -

that the City give notice to Saline County of its intent to terminate the
Interlocal Agreement for Bailiff Services effective December 31, 1992. Aye:

appointed General Manager for the Bicentennial Center on Friday, December 27,

91-565 Moved by Commissioner Warner, seconded by Commissioner Brungardt
that the Board of Commissioners recess into executive session for 30 minutes to
discuss a setter subject to the attorney-client privilege, specifically Cable
TV franchise renewal negotiations, for the reason that public discussion would
waive the attorney-client privilege and would jeopardize the City's negotiating
position in the matter. Aye: (5). Nay: (0). Motion adopted.
The City Commissioners recessed into Executive Session at 6:42 p.m.
and reconvened at 7:15 p.m.
Greg Bengtson, City Attorney, reviewed the Executive Session and
the potential agreement regarding the Cable TV franchise.
Dennis M. Kissinger, City Manager, reviewed the Cable negotiations
and the Cable TV Franchise Executive Summary, including settlement of back
franchise fees, rates, terms of renewal franchise for CSI, and franchise fees.

the tentative settlement as outlined in the Executive Summary be approved and
that staff be instructed to draft a formal ordinance for first reading on

In 1986, the City and County signed an agreement whereby the City contracts with the
Sheriff's office for service of legal documents and for bailiff services. That
agreement allows for termination on one year notice. During 1992, City staff wants to
review carefully whether this agreement still provides the most "productive and
efficient" delivery of legal notices and papers and other incidental court services.
We plan to work with the Municipal Court Judge, Sheriff and City Prosecutor and either
(a) negotiate a new agreement, or (b) have this agreement end on December 31, 1992,
so that we may use a different method in 1993. Providing this notice gives everyone
the maximum amount of flexibility.
Recommendation
Authorize (by motion) notice in writing to Saline County of the City's intention to
terminate this agreement, effective December 31, 1992. We would have a staff
recommendation on this matter along with the 1993 budget (July 1992).

This Interlocal Cooperation Agreement is made and entered into this
20th day of May, 1986, pursuant to the Interlocal Cooperation Act,
K.S.A. 12-2901 to 12-2907, inclusive, as amended, by and between the
Saline County, Kansas, hereinafter referred to as the "County", and the
City of Salina, Kansas, hereinafter referred to as the "City";
WHEREAS, K.S.A. 12-2904, as amended, authorizes local
governmental units and other public agencies to make the most efficient
use of their powers by enabling them to cooperate with other
governmental units and public agencies on the basis of mutual advantage
and thereby to provide public services and facilities in a manner :hat
will best meet the needs of the community; and
WHEREAS, the City and the County both serve warrants, writs,
and other legal papers and notices required for the proper administration
of justice; and
WHEREAS, the Saline County Sheriff is responsible for a very large
volume of said legal notices and papers served on behalf of the Saline
County District Court and the Salina Police Department provides similar
services, including bailiff services to the Salina Municipal Court; and
WHEREAS,

NOW, THEREFORE, it is hereby agreed by and between the City
and County as follows:
1. Transfer of Duties: The County hereby agrees to accept the
responsibility for serving a I legal documents related to the operation of
the Municipal Court in a manner acceptable to the Judge of the Municipal
Court and furthermore the County agrees to provide bailiff services for
the Municipal Court as directed by the Judge of the Municipal Court.
The County, through the Office of the Saline County Sheriff, agrees to
hire and supervise the necessary personnel and do all things related to
the provision of these services.
2. Adequacy of Service Level: The County shall provide these
services in a manner acceptable to the City Manager. If said services
are not acceptable to the City Manager and agreement can not be
reached with the County Sheriff- to provide an acceptable level of
services, the City Commission and County Commission shall resolve the
matter in a mutually acceptable manner, including termination of this
Agreement notwithstanding other specific provisions of this Agreement.
3, Compensation: The City agrees to compensate Saline County
in 1986 the annumorated amount of $20,000.00 for the provision of
these services. Compensation shall be paid quarterly, by January 1,
April 1, July 1, and October 1, annually to the Saline County Treasurer
in advance of the provision of services. In addition, the City shall
provide one (1) sedan including operation and maintenance for use by
the County in providing these services. Compensation for 1987 and
following years shall be as determined in paragraph four of this
Agreement titled Annual Budget,
4. Annual Budge : By July 1, 1986, and by June 1, annually
thereafter, they—shall present to the City Manager of the City of
Salina a proposed budget for services in the following fiscal year. The
budget shall be agreed upon between the City Manager and the County
Commission, and the City M1anager shall recommend the agreea upon
budget to the City Commission. The final budget shall be as adopted by
both the City and County Commissioners.
5, Period of Agreement: This agreement shall be in effect for an
initial perw o approximate y five (5) years, ending on December 31,
1991, Furthermore, the agreement shall be in effect indefinitely after
that date unless terminated as provided herein.
6, Termination: Either party may terminate this Agreement after

and between the Saline County, Kansas, hereinafter referred to as the
"County", and the City of Salina, Kansas, hereinafter referred to as the
"City";
WHEREAS, K.S.A. 12-2904, as amended, authorizes local governmental
units and other public agencies to make the most efficient use of their
powers by enabling them to cooperate with other governmental units and
public agencies on the basis of mutual advantage and thereby to provide
public services and facilities in a manner that will best meet the needs
of the community; and
WHEREAS, the City and the County both serve warrants, writs, and
other legal papers and notices required for the proper administration of
justice; and
WHEREAS, the Saline County Sheriff is responsible for a very large
volume of said legal notices and papers served on behalf of the Saline
County District Court and the Salina Police Department provides similar
services, including bailiff services to the Salina Municipal Court; and
WHEREAS, the City and County desire to provide in the most
productive and efficient manner possible for the delivery of legal
notices and papers and other incidental court services
NOW, THEREFORE, it is hereby agreed by and between the City and
County as follows:
1. Transfer of Duties: The County hereby agrees to accept the
responsibility for serving all legal documents related to the operation
of the Municipal Court in a manner acceptable to the Judge of the
Municipal Court and furthermore the County agrees to provide bailiff
services for the Municipal Court as directed by the Judge of the Muncipal
Court. The County, through the Office of the Saline County Sheriff,
agrees to hire and supervise the necessary personnel and do all things
related to the provision of these services.
2. Adequacy of Service Level: The County shall provide these
services in a manner acceptable to the City Manager. If said services
are not acceptable to the City Manager and agreement can not be reached
with the County Sheriff to provide an acceptable level of services, the
City Commission and County Commission shall resolve the matter in a
mutually acceptable manner, including termination of this Agreement
notwithstanding other specific provisions of this Agreement.
3. Compensation: The City agrees to compensate Saline County
in 1986 the annu orated amount of $20,000.00 for the provision of
these services. Compensation shall be paid quarterly, by January 1,
April 1, July 1, and October 1, annually to the Saline County Treasurer
in advance of the provision of services. In addition, the City shall
provide one (1) sedan including operation and maintenance for use by the
County in providing these services. Compensation for 1987 and following
years shall be as determined in paragraph three of this Agreement titled
Annual Budget.
4. Annual Budget: By July 1, 1986 and by June 1, annually
thereafter -, ---5e present to the City Manager of the City of
Salina a proposed budget for services in the following fiscal year.
The budget shall be agreed upon between the City Manager and the County
Commission and the City Manager shall recommend the agreed upon budget
to the City Commission. The final budget shall be as adopted by both the
City and County Commissioners.
5. Period of Agreement: This agreement shall be in effect for an

initial peof approximately five (5) years, ending on December 31,
1991. Furthermore, the agreement shall be in effect indefinitely after
that date unless terminated as provided herein.
6. Termination: Either party may terminate this Agreement after
December 3i—,799r-6y providing to the other party, in writing, notice of
the intention to terminate rovided that said notice to terminate must
be received at least one (1� full year before January 1. Any termination
shall be effective on January 1, and no other date.

force and a ect rom an after its adoption by the Board of County
Commissioners of Saline County and the Board of City Commissioners of
the City of Salina and its approval by the Attorney General of the State
of Kansas.
IN WITNESS WHEREOF, the parties have each taken official and binding
action approving this Agreement and authorizing its execution by their
respective representatives.
